HomeMy Public PortalAboutORD 83/02` :r 'I ORDINANCE NO. 83_2 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, PROVIDING THAT A FEE OF ONE HUNDRED SEVENTY FIVE DOLLARS ($175.00) BE IMPOSED AGAINST ANY ..PERSON WITHIN THE TOWN WHO CAUSES EMERGENCY MEDICAL EQUIPMENT AND PERSONNEL OF THE CITY OF DELRAY BEACH TO BE DISPATCHED WITHIN THE MUNICIPAL LIMITS OF THE TOWN OF GULFSTREAM. WHEREAS, the Town of Gulf Stream has entered into an Interlocal agreement with the City of Delray Beach, wherein the Town of Gulf Stream employs the services of the City of Delray Beach Emergency Medical Service; and WHEREAS, to provide the above referenced service the City of Delray Beach charges the Town of Gulf Stream the amount of ONE HUNDRED SEVENTY FIVE DOLLARS ($175.00) for each occasion in which the City of Delray Beach dispatches emergency medical equipment and personnel within the limits of the Town of Gulf Stream; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, as follows: Section 1. In the event, because of an emergency situation, it is necessary that the City of Delray Beach dispatch emergency medical equipment and personnel within the municipal limits of the Town of Gulf Stream, for which a charge of ONE HUNDRED SEVENTY FIVE DOLLARS ($175.00) is imposed, it shall be the responsibility of the party for whom the emergency medical equipment and personnel were dispatched to reimburse the Town of Gulf Stream in the amount of ONE HUNDRED SEVENTY FIVE DOLLARS ($175.00) for said services. Said amount shall be paid to the Town no later than thirty days from the date the emergency medical equipment and personnel were dispatched for the benefit of the person for whom the services were employed. Section 2. In the event it becomes necessary for the Town of Gulf Stream to take legal action in order to collect the fee referenced herein from the party responsible therefore, the Town, in the event it prevails in court, shall be entitled to court costs and attorney's fees incurred as a result of having to take said action. Section 3. Should any section or provision of this 6 r _. II /-- 1-1\ , . Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part thereof other than the part declared to be invalid. Section 4 That permission to codify this Ordinance is hereby granted. Section 5 That this Ordinance shall take effect immediately upon its passage and approval as provided by law.
