Hi Rene – catching up, let’s take the 1 step by trying to keep it simple.
In that connection, my suggestion is that you start by doing a search excluding emails sent to or by anyone with an email
address ending in @commerce-group.com; or @oboylelawfirm.com, as Jonathan or I would already have them; and I am
not interested in any such emails.
Next, provide all records which were not sent directly to a member of the Town Commission it’s staff or it’s police
rd
department from its counsel, with no 3 parties copied.

Based upon the above, there should be no need for attorney review.
Please price this. Upon receipt, I will advise if I am interested in proceeding. Assuming that I am, let me see what this
search uncovers, after which, I will advise if there is a need to proceed.
Renee, I am still puzzled as to the basis for some of what you say. Examples:
1.Does the law say that I must “offer up” 100% of your estimated costs?
2.Most troubling is “how do you get your estimate”. Before tendering any money, I need to understand; since, as
I now go back and review the various unfulfilled or not properly fulfilled, records (some of which I no longer
need filled), I point out that as to the sensitive ones, such as 1930 , 1978, 1979 & 1980, your estimates, given
what I perceive as the scope, were designed to discourage the requestor from proceeding. I’m sure you
understand that.
Thank you, good day; and I await your prompt response!

Dear Martin E. O’Boyle [mail to: meo@commerce-group.com]:
This request dates back to June of 2018, which is more than ten months ago, and therefore has
been administratively closed. The internal policy for the Town of Gulf Stream is if we do not
hear back from you within 30 days of our estimate to you, we consider the request closed. The
Florida Statutes does not specify an amount of time between requesting a deposit and receiving
it. Anything that is not defined in the Florida Statutes is left up to each individual agency to
define in their internal policies. The onus is on the requestor to properly respond to the
requirements set in our agency’s policy, which is 30 days. We communicate this policy in our
correspondence and consider this a reasonable amount of time for a response before
administratively closing the request. Ten months would be an unreasonable amount of time to
hold a request open pending receipt of a deposit or response.
If you would like to request records, please provide a Facilitation Fee in accordance with the
Settlement Agreement.
Sincerely,
Reneé Rowan Basel

Town Clerk, Custodian of the Records
