By Cape Cod Engineering Co. Assessor's map 64, parcel 3.The proposed maintenance and replacement of existing gabion array with coir roll extension. Work will occur on a Coastal Bank, in Land Subject to Coastal Storm Flowage, and in the Pleasant Bay ACEC. Bob Perry from Cape Cod Engineering was present. He informed the Commission of his site meeting with Greg Berman. Mr. Jannell read in portions of Mr. Berman's report and noted a few highlights pertaining to obtaining a Chapter 91 license and certain potential special Conditions. The Commission discussed storage of dock components and requested a Condition requiring them to be stored somewhere other than the beach.The Commission was also concerned with sand nourishment and asked for volume and frequency. Mr. Perry explained the area would probably need periodic covering with sand. But it is hard to gauge up front as it changes from year to year. Mr.Jannell suggested a Condition that allows for nourishment within the NHESP time of year restriction should the area become exposed. Ms. Farber requested that coverage calculations be written into the plan notes. Ms. Bruce voiced confusion towards the placement of fiber rolls so close to the water. Mr. Perry explained the graphic on the plan is somewhat skewed. He will blow up the plan for the next meeting so detail can be more accurately represented. Mr.Jannell reiterated potential Special Conditions including a time of year restriction from November 1st to April 1st;the access route to the bank will need to be restored with native fescue; all sand used for nourishment will need to be compatible with DEP guidelines; nourishment over the fiber roll array will be allowed if uncovered, volume not to exceed a certain amount; nourishment will only be allowed if there is no determined negative impact down drift of the property; no work can be done below mean high water without a Chapter 91 license; and the dock float will need to be stored more landward. He also requested a cross section of the intersecting area of gabions and fiber rolls. He advised Mr. Perry to try and include as many of those points in his site plan notes for the next meeting as possible. Motion:A motion to Continue the public hearing to the meeting on 1/28 was made by Ginny Farber and seconded by Judith Bruce. Vote: 6-0-0 Revised Plans Ted Berk and Naomi Weinberg-16 Hayward Ln. The proposed raze and replace of the existing single-family dwelling and guest house with amenities. Work will occur within 100'to the top of a Coastal Bank, Land Subject to Coastal Storm Flowage, and within the Pleasant Bay ACEC. The revision consists of landscape and driveway modifications. • Jen Stevens from Matthew Cunningham Landscape Design was present. She explained the revisions to the driveway, patio areas, and path to the dock. Mr. Brink said he didn't see any issue with the proposed modifications. Mr. North stated he has difficulty with these changes as the site has already been significantly altered as is. Motion:A motion to approve the revisions on the Coastal Engineering site plan dated 12/20/20, was made by Ginny Farber and seconded by Judith Bruce. Vote: 5-1-0 (Mr. North opposed) Eastward Companies—36 Sea Mist Dr. The proposed installation of a patio, retaining wall, and landscape plantings. Work to be done within 100'to the edge of a Vegetated Wetland. The revision consists of landscape and retaining Wall modifications. Susan Ladue from Eastward Companies was present. She explained the revisions with the Commission in agreeance the modifications were minor. Motion:A motion to approve the revisions with the Eastward Companies site plan dated 1/15/20, was made by Ginny Farber and seconded by Judith Bruce. Vote: 5-1-0 (Mr. North opposed) Administrative Reviews Janet Barnard—5 Boulder Ln. Proposed limbing of three trees and removal of one declining oak tree. Work to be done by Estate Landscape Maintenance. Ms. Bruce recused as an abutter. Motion:A motion to approve the Administrative Review was made by Ginny Farber and seconded by Walter North. Vote: 5-0-0 . Colonial Gas Company—10& 12 Deacon's Way Proposed installation of two gas service lines from existing gas main. Work to be done by Colonial Gas Company. Mr. Jannell told the Commission this was a previously approved project, but the work had never been performed due to the gas moratorium. Motion:A motion to approve the Administrative Review was made by Judith Bruce and seconded by Walter North. Vote: 6-0-0 Oyster Trail Realty Trust—10 Oyster Trail Proposed removal of exterior brick chimney. Work to be done by Rick Roy Construction. Motion:A motion to approve the Administrative Review was made by Ginny Farber and seconded by Judith Bruce. Vote: 6-0-0 Peter Lynch—8 Spinnaker Trail Proposed removal of three trees. Work to be done by S& L Tree Service. Motion:A motion to approve the Administrative Review was made by Ginny Farber and seconded by Judith Bruce. Vote: 6-0-0 Betsey Furtney—71 Pochet Rd. Proposed removal of 4 dead cedars, 3 junipers, one oak tree, and removal of invasive bittersweet, privet, and honeysuckle. Work to be done by Timothy Kent Landscaping. Ms. Bruce asked.the method of removal. If the applicant will be doing"cut and wipe" with glyphosate, she has reservations. Motion:A motion to approve the Administrative Review was made by Ginny Farber and seconded by Judith Bruce. Vote: 6-0-0 John and Jodi Cirincione—6 Pheasant Dr. Proposed removal of two sheds, addition to dwelling, and addition of deck landing with steps. Work to be done by DeMartin Dunham Builders. Mr. Jannell recused. The Commission reviewed pictures of the site and had no problem with the proposed work. Motion: A motion to approve the Administrative Review was made by Ginny Farber and seconded by Judith Bruce. • Vote: 6-0-0 Certificate of Compliance Philip and Janine Howarth—16 Snow Way SE 54-2344 Driveway improvements to correct drainage issues and installation of two rain gardens. Work occurred within 100'of a Bordering Vegetated Wetland, an Intermittent Stream, and an unnamed pond. David Lyttle from Ryder and Wilcox, Inc. was present. He explained that a different engineer was hired for the drainage. However,the homeowner is no longer working with them and has hired Ryder and Wilcox to finish the requirements for the project. Mr.Jannell reported that the Commission never received the reports that were required in the Order of Conditions from the other engineering firm. He informed Mr. Lyttle the report is necessary to issue a COC. Mr. Lyttle agreed and added there should be on-going Conditions with the COC as well. Motion: A motion to Continue to the meeting on 1/28 was made by Ginny Farber and seconded by Judith Bruce. Vote: 6-0-0 Other Business 141 Portanimicut Road task force update Mr.Jannell announced that the Shellfish and Waterways Committee has appointed Suzanne Phillips as their representative for the task force. He will update the Commission next week on the other members as well as meeting schedule. , Chairman's Business Approval of the Minutes from the meeting on 1/14 • No action taken Motion: A motion to adjourn the meeting was made by Ginny Farber and seconded by Judith Bruce.
