HomeMy Public PortalAboutResolution 62-19 PC" " 1 " RESOLUTION NO. 62 -19 PC RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPT) CITY RECOMMENDING TO THE CITY COUNCIL THE GRANTING OF A ZONE VARIANCE TO HAROLD AND ELEANOR nIErEBLE TO CONSTRUCT A DUPLEX ON APPLICANTS' LOT HAVING LESS THAN THE REQUIRED SQUARE FOOTAGE AT 5809 NORTH ENCINITA, TEMPLE CITY, THE PLANNING COMMISSION OF Ti E CITY OF TEMPLE CITY DOES .RESOLVE AS FOLLOWS: WHEREAS, Harold and Eleanor Kreeble, hereinafter referred to as Applicant, filed on or about May 15, 1962, Application No., PC 62 -35 for a zone variance, requesting a variance on their property located at 5809 North Encinita, Temple City, to construct thereon .a duplex building; and WHEREAS, the real property located at 5809 North Encinita Avenue, Temple City, is presently zoned R -2; and WHEREAS, Applicant's real property lacks the re-- quired square footage; and WHEREAS, on June 4, 1962, after notice duly given pursuant to law, a public hearing was held before the Planning Commission; and WHEREAS, the Planning Commission has duly delibe- rated on the merits of the application for zone variance, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY -0F TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. The property of the Applicant, located at 5809 North Encinita Avenue, Temple City, is in zone R -2 and zoned for multiple buildings, but lacks the required square footage for a duplex unit. SECTION 2. The circumstances of said property are exceptional, particularly as to location of the present structure thereon, and do not apply generally to the property or class of use located in the same vicinity. SECTION 3. The granting of the variance requested' by the Applicant will not be detrimental to the public health, general welfare and convenience of the community and will not be injurious to the property in_the same vicinity. SECTION 4. The Planning Commission recommends that the City Council grant the variance as requested, sub - ject to the following conditions: (a) That the property be developed substantially in compliance with the plot plan (as revised)., (b) The real property shall remain under one ownership at all times. (e) That the variance, if approved by the City Council, shall not be effective for any purpose until the owner of the property involved has filed with the -1- " 1 " 1 " City Clerk of Temple City their affidavit stating that they are aware of and accept all of the conditions of the variance as granted.
