' '20 JAN 29 9:01Am -qAT @D V ORLEANS PLANNING BOARD JANUARY 14,2020-Minutes A meeting of the Orleans Planning Board was called to order at 7:00 p.m. in the Nauset Meeting Room at the Orleans Town Hall. Present: Chairman: Andrea Reed; Vice-Chairman: Richard Hartmann; Clerk: Debra Oakes. Regular Members: Chet Crabtree and Brian Sosner. Associates: Charles Bechtold and Deanna Johnson. Planning Department Staff: George Meservey and Secretary: Karen Sharpless. Also Present: Board of Selectmen Liaison: Cecil Newcomb. PUBLIC COMMENT There were no public comments at this point in the meeting. APPROVAL NOT REQUIRED- HYDRANGEA PROPERTIES LLC-21 GREAT OAK ROAD David Lyttle(Ryder&Wilcox)presented a Perimeter Plan as an Approval Not Required showing the dimensions and buildings located on a 2-acre parcel. Lot 1 contains 2.00 acres of buildable upland and supports a newly constructed dwelling, with the existing dwelling"to be removed"on Great Oak Road. Lyttle noted that the plan protects the property from any zoning changes within three years. Lyttle stated that the historic barn and shed will be moved to property on Barley Neck Road. MOTION: On a motion by Richard Hartmann, seconded by Chet Crabtree,the Board voted to authorize the Planning Board Chair to endorse the Plan of Land prepared for Hydrangea Properties, LLC, dated December 9,2019, scale 1"=30',by Ryder&Wilcox,Inc. VOTE: 5-0-0 The motion passed unanimously. MYLAR ENDORSEMENT OF DEFINITIVE PLAN - RALPH ARABIAN -97 ROCK HARBOR ROAD David Lyttle(Ryder&Wilcox)presented a Mylar for a Definitive Plan on behalf of Tim Brady(East Cape Engineering)for Ralph Arabian for property located at 97 Rock Harbor Road. Lyttle stated that the Town Clerk endorsed the plan acknowledging that no appeals have been filed since the plan was approved by the Planning Board. MOTION: On a motion by Chet Crabtree, seconded by Richard Hartmann,the Board voted to authorize the Planning Board Chair to endorse the Mylar plan for Ralph Arabian, 97 Rock Harbor Road. VOTE: 5-0-0 The motion passed unanimously. Planning Board Minutes-January 14, 2020 Page 1 of 5 All information discussed at Planning Board meetings is kept on file in the Planning Department. 7:00 P.M. - PUBLIC HEARING- PROPOSED ZONING AMENDMENTS Debra Oakes read the legal ad into the record. Meservey presented Planning Board members with a list of five proposed zoning amendments for review. Amend Zoning Bylaw Chapter 164-31. Apartment Development Meservey described a proposed zoning bylaw to eliminate the currently required 30,000 square feet minimum lot size in the General Business and Limited Business Districts to provide for apartment development. COMMENTS Greg DeLory stated his opposition to this zoning proposal in areas of town other than the Village Center District. DeLory noted there are other ways to provide affordable housing such as 40B and through the Affordable Housing Trust. Barry Alper reported that at a meeting at the Fire Station, he heard a frequently repeated need for affordable housing within seven miles for staff. Alper stated his support for this proposal. Mark Matheson stated his opinion that many young people from the school systems end up moving away from Orleans due to the lack of affordable housing. Matheson stated his support for this proposal. Richard Hartmann noted that the Planning Board hears many requests for affordable housing to be made available in town for working professionals. MOTION: On a motion by Richard Hartmann, seconded by Debra Oakes,the Board voted to forward the zoning bylaw to the Board of Selectmen with a recommendation for inclusion on the Annual Town Meeting in May 2020. VOTE: 5-0-0 The motion passed unanimously Amend Zoning Bylaw Chapter 164-4 Definitions MOTION: On a motion by Chet Crabtree, seconded by Richard Hartmann,the Board voted to forward the zoning bylaw to the Board of Selectmen with a recommendation for inclusion on the Annual Town Meeting in May 2020. VOTE: 5-0-0 The motion passed unanimously. Amend Zoning Bylaw Chapter 164-34 A.(1). Off-Street Parking Regulations Planning Board members discussed the need for the dimension of parking spaces to be defined. - Chet Crabtree noted that many cars are large SUV's and stated his agreement with the proposal. MOTION: On a motion by Chet Crabtree, seconded by Richard Hartmann,the Board voted to forward the zoning bylaw to the Board of Selectmen with a recommendation for inclusion on the Annual Town Meeting in May 2020. VOTE: 5-0-0 The motion passed unanimously. Dwellings in Commercial Structures or Accessory to Commercial Uses. MOTION: On a motion by Richard Hartmann, seconded by Debra Oakes,the Board voted to forward the zoning bylaw to the Board of Selectmen with a recommendation for inclusion on the Annual Town Meeting in May 2020. VOTE: 5-0-0 The motion passed unanimously. Amend Zoning Bylaw Chapter 164-4,Definitions and Chapter 164-13, Schedule of Use Regulations Planning Board members discussed the need to provide provisions for the storage of fishing gear under the Customary or Self-Employed Home Occupation section of the zoning bylaws. COMMENTS Bill Amaru stated that commercial fishing is a historic profession in town. Charles Bechtold noted that past issues with fishing storage have been handled with a successful outcome for all parties concerned. MOTION: On a motion by Richard Hartmann, seconded by Brian Sosner,the Board voted to forward the zoning bylaw to the Board of Selectmen with a recommendation for inclusion on the Annual Town Meeting in May 2020. VOTE: 5-0-0 The motion passed unanimously. Andrea Reed closed the public hearing for proposed zoning amendments. COMPLETE STREETS POLICY Meservey reported on a grant received to finalize the Complete Streets Policy and forward it to the Board of Selectmen. Alice Van Oot(Bikeways Committee) stated her opinion of the importance to provide amenities for other modes of transportation including but not limited to pedestrians and bicycles. MOTION: On a motion by Brian Sosner, seconded by Richard Hartmann,the Board voted to authorize the Planning Board Chair to sign a letter of support and forward it to the Board of Selectmen. COMMITTEE REPORTS Board of Water&Sewer Commissioners(Richard Hartmann) Hartmann reported that the Board of Water& Sewer Commissioners are working on documents for Betterment Rules and Sewer Use Regulations with guidance from Town Counsel and the Town Administrator. Hartmann stated the intent to meet with the Board of Selectmen and Finance Committee in February to coordinate articles for the Annual Town Meeting in May. Community Preservation Committee(Brian Sosner) Sosner explained that the Community Preservation Committee has received 22 grants funding requests pending covering all categories. CORRESPONDENCE • Lonnie's Pond Aquaculture/TMDL,Annual Report(Part One),December 30,2019. APPROVAL OF MINUTES: November 12, 2019 MOTION: On a motion by Chet Crabtree, seconded by Richard Hartmann,the Board voted to approve the Planning Board minutes for November 12,2019, as amended. VOTE: 4-0-1 The motion passed by a majority. (Brian Sosner abstained). APPROVAL OF MINUTES: December 10, 2019 MOTION: On a motion by Brian Sosner, seconded by Richard Hartmann,the Board voted to approve the Planning Board minutes for December 10, 2019,. as amended. VOTE: 5-0-0 The motion passed unanimously. TOWN PLANNER'S UPDATE Planning Board members reviewed a list of questions for a Route 6A survey to be filled out on-line by residents.
