Reiman at 6:00 P.M., Thursday, July 19, 2012, Council Chambers, Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call the following were noted present: Present Councilmember Dennis DiMascio Randy Krum " Susan Naples Noted absent were Councilmembers Vincent Bellino and Joseph Noted Absent Sitarz. Also noted absent was Council President Jorge Diaz. Also noted present was Municipal Clerk Kathleen M. Barney and Also Noted Present Borough Attorney Robert J. Bergen. The meeting was opened with a minute of Silent Prayer and the Silent Prayer/ Pledge of Allegiance led by Mayor Daniel J. Reiman. Pledge of Allegiarre The 2012 Annual Notice was mailed to The Home News Tribune, Statarent of The Star Ledger and posted on the bulletin board on January 9, Meeting Notice 2012. Notice was published in The Home News Tribune on January 9, 2012 and in The Star Ledger on January 10, 2012. 1. July 19, 2012 Minutes for Upon MMS &C by Councilmembers Krum and Naples and Appm unanimous affirmative vote of the three (3) Councilmembers present, the Minutes of July 12, 2012 were approved as transcribed and engrossed by the Clerk. Camprrlation COMMENDATION - Antoran Chandler - Carteret Little League. Ca may or ail � Mayor Reiman presented a check of $100.00 and certificate to Antoran Chandler for the First Home Run of the Season. The check came from The Mayor's Children's Charity Trust Fund. Ordinances Mayor Reiman said Ordinances #13 and #14 are for our annual Ord Ord MCIA Lease Purchase. This is how we finance our Police Vehicles. In this fund we are setting up, one hundred fifty thousand dollars ($150,000.00) is to purchase three (3) police vehicles and also a possible purchase of a CAD System. The acronym means different things but for the Police Department it means Computer Aided Dispatch. It would identify which Police Vehicles are in and around town at any given time. The dispatcher would be able to assign the nearest available vehicle to respond to an emergency. Ordirtiarre #12 -13 ORDINANCE #12 -13 "AN ORDINANCE OF THE BOROUGH OF CARTERET, IN THE First Readi.r COUNTY OF MIDDLESEX, STATE OF NEW JERSEY, APPROVING AND AUTHORIZING THE ENTERING INTO, EXECUTION AND DELIVERY OF A LEASE AND AGREEMENT WITH THE MIDDLESEX 2. ORDINANCE #12 -14 First Reading "A LOAN ORDINANCE OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, STATE OF NEW JERSEY APPROVING AND AUTHORIZING THE ENTERING INTO, EXECUTION AND DELIVERY OF A LOAN AND SECURITY AGREEMENT WITH THE MIDDLESEX COUNTY IMPROPVEMENT AUTHORITY FOR THE UNDERTAKING OF VARIOUS 2012 CAPITAL IMPROVMENTS AND VARIOUS EQUIPMENT WITH AN ESTIMATED COST OF $50,000, THE COST OF SUCH IMPROVEMENTS AND EQUIPMENT TO BE FINANCED THROUGH THE ISSUANCE OF COUNTY - GUARANTEED CAPITAL EQUIPMENT AND IMPROVEMENT REVENUE BONDS, SERIES 2012 OF THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY" Mayor Reiman asked the Municipal Clerk to check if one (1) or both % Mayor asked of these Ordinances for final adoption we need four (4) votes. the Mmicipal Clerk Please make sure we have them. to check hao marry votes sere needed Upon MMS &C by Councilmembers Naples and Krum and Resolutions /Agerda Itens unanimous affirmative vote of the three (3) members present, the & %q Busiress public portion on Resolutions /Agenda Items and New Business was opened to the public. 3. July 19, 2012 Public Portion Upon MMS &C by Councilmembers Krum and DiMascio and Closed unanimous affirmative vote of the three (3) members present the public portion was closed. RESOLUTIONS: IMLUrICN #12 -125 1. #12 -125 Authorizing the Mayor and /or Director of Engineering to Execute a TWA Permit with Regard to NJDEP for Various Projects within the Borough. Mayor Reiman said TWA is a Treatment Works Application permit. This has to do with any time a company or construction project Ca«�ents needs to tie into a sanitary sewer system. There are instances where we usually approve on an individual basis but there may be times where we have to get something executed. For instance we have the TWA application coming up for the State Police Barracks. We also have an application coming up for Kinder Morgan and the new ProLogis Building going into the end of Industrial Highway which is 75% Woodbridge Township and 25% Carteret. RESOLULTCN #12 -126 2. #12 -126 Resolution of the Borough of Carteret, County of Middlesex, New Jersey, Authorizing an Extension of Time for Payment of Municipal Taxes without Interest to September 1, 2012. RESOLUITCN #12 -127 3. #12 -127 Authorizing a Professional Services Contract for Engineering Services with T &M Associates - 2012 Base Repair & County Road Overlay Program /Design Contract Administration & Inspection Services. WSOLUPICN #12 -128 3a. #12 -128 Representation and Remediation Agreement Between the Borough of Carteret, Rahway Arch Properties LLC, Soil Safe Inc. and Albert P. Free, PE, LSRP. 4. July 19, 2012 The Mayor said LSRP is a License Site Remediation Professional. Camnnts Basically the City owns a small piece of property in the middle of the landfill area where Soil Safe is going to be doing their remediation project rather than us. We will hire our own LSRP and to have it as a separate project. We are going to let Soil Safe handle any of the clean up on the property and any Environmental issues dealing with the DEP. We'll still retain ownership of the property and any final decisions of what we will do with the property. Because it is like the donut hole in the donut we are going to let them include it as part of their submittal to the DEP. Resolutions #12 -125 through #12 -128 were introduced by the Consent Agenda Mayor and referred to the Council for action. Upon MMS &C, by Councilmembers Krum and DiMascio was adopted. Upon MMS &C, by Councilmembers DiMascio, Krum Adopted and Naples voted in the affirmative. Councilmembers Bellino, Diaz and Sitarz were noted absent. Buildings & Gra rds BUILDNGS & GROUNDS - Committeewoman Naples reported that the Seasonal maintenance is being performed by the department. They are working with the Open Mic Concert for young talented adults. The emergency lamp work is in progress for the energy efficiency. Thank You. Mayor Reiman said he was there for the Open Mic on Friday night. We had about five (5) or six (6) different groups of bands. We had a Mayor Kamen - few people from Sayreville and Old Bridge and two (2) were from Dion Carteret. It is always a good venue and good of entertainment and of course the weather held up so it worked out nicely. Finance & PdTOni.stration FINANCE & ADMINISTRATION - Committeeman Diaz was noted absent. Progress. Fire & Darestic FIRE AND DOMESTIC PREPAREDNESS - Committeeman Krum Preparedness reported he only had a few items. He said he would like to welcome the newest Fire Fighter Joseph Potter. Joseph just successfully 31 July 19, 2012 completed 130 hours of Fire Fighter training class at our Academy in Sayreville. He recently passed his New Jersey State certification test and will be a great asset to our Volunteer Fire Fighter ranks. Mayor Reiman said he was waiting to hear the word volunteer. He said he knew he didn't miss anything. Committeeman Krum also reported that they put the Homeland Security Boat to good use. We had a water rescue on July 1st. A father and daughter were clinging to a partially submerged jet ski near our Waterfront, directly in our shipping channel. The Firefighters responded with our boat and pulled the two (2) people out of the water and also recovered their jet ski. Progress in the Fire Department. PARKS & RECREATION - Committeeman Bellino was noted absent. Progress. POLICE DEPARTMENT- Committeeman Sitarz was noted absent. Progress. PUBLIC WORKS - Committeeman DiMascio reported the road on Hagaman and Hickory Street is finally repaired. Mayor Reiman said it took awhile because even after they did the base repair, they overfill it, let it sit and then they put another top coat on. It is much better than it was. Committeeman DiMascio said the stop sign on the corner of Chestnut and Jackson; they finally put a flashing light on top of the Stop Sign so that should help a lot. Mayor Reiman said usually when they put a flashing light up they tend to disappear. We've had a least one half of a dozen stolen for whatever reason and there are some who don't like the blinking X Rescue Mission Patios & Recreation Police Departwmt Public [brks .0 1iv'i5'i'Sim- 7. July 19, 2012 lights. They are $1200.00 a piece. Hopefully it will be good public safety and stop some accidents. Committeeman DiMascio said you can't put stop signs on Jackson Avenue. Oaments Mayor Reiman said they should talk to John Riley tomorrow. We have some extra speed- bumps. Let's have a couple of them put down on Jackson Avenue. They are the rubber and plastic ones. So at least it'll slow people. They are going alot faster than twenty-five miles an hour. Committeeman DiMascio said they are still fighting over the Turnpike railing. Mayor Reiman said he referred it to Mr. Bergen. The Turnpike has taken the position that the County is responsible and the County is Dhu�ion taking the position that the Turnpike is responsible. They referenced the 1972 agreement and there's a new letter came in today with a copy of that agreement. The Mayor said he can't see how that agreement applies when they completely re -did everything over there. Borough Attorney Bergen said he has never seen the plan. We should get a copy of it to see what's marked on that plan. Mayor Reiman said he didn't care if they mark it. Their marking it to say you're responsible. We never agreed to take any additional responsibility. Borough Attorney Bergen said at the very least there improvements have nothing to do with that plan. There was no agreement for those improvements. 9 July 19, 2012 Committeeman DiMascio said this is new, it wasn't there before 1972. Borough Attorney Bergen said that is why we want to see what was in effect in 1972. They are going to try to argue Discussion Continued that it is but at least if you marked it and then you have improvements that are not even the same. The improvements are not even in the same perimeter as over there, then clearly ...(inaudible)... Mayor Reiman said it is completely different but he does not know. I don't think they are looking at the maps as much as they are looking at the overall agreement. They say the County is responsible for this and the Turnpike is responsible for that. Committeeman DiMascio said you come to town and it looks beautiful. You come off the Turnpike and you see that mangled rail. Progress. BOARD OF EDUCATION: Committeewoman Naples Thanked mid of Ediration the Mayor. Both the Custodial staff and some of the workers are working hard trying to get the school ready for September, painting and cleaning. A little bit of relocating. There's a major project in both Columbus and Minue Schools. Many years back we had a lease purchase program the new classrooms, she didn't know if they were pre -fab or what but they would ...(inaudible)... They were not conducive to education. So that is being replaced and the new ones are guaranteed to be quiet and comfortable. That is huge.
