T, No. 12-48 Date of Adoptio 22, 201 RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH CME ASSOCIATES NJSP MARINE BARRACKS WHEREAS, the Borough of Carteret is in need of specialized geotechnical engineering services with regard to the NJSP Marine Barracks; and WHEREAS, the Borough's Consulting Engineers, CME Associates, possess the requisite skill and expertise to provide said services; and WHEREAS, CME Associates has submitted a proposal to provide said engineering services at a total cost not to exceed $3,500.00; and WHEREAS, the Mayor and Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose to be paid through the Carteret Redevelopment Agency. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from CME Associates for geotecimical engineering services related to the NJSP Marine Barracks at a total cost not to exceed $3,500.00 at the rate set forth in CME's existing contract with the Borough is hereby approved. 2. Annexed hereto is a copy of said proposal. 3. This action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 4. A copy of this resolution be forwarded to Eric Chubenko, Executive Director, Carteret Redevelopment Agency. Thank you for the opportunity to present this fee estimate for Professional Geotechnical Engineering Services relative to the NJSP Marine Barracks. It is our understanding that the proposed project will consist of a 62 feet wide by 80 feet long one -story structure comprising of a footprint area of approximately 4,960 sq. ft., and appurtenant parking area comprising approximately 37,900 square feet. Based upon our review of published geological literature, and our experience in the area, the subsurface conditions are expected to consist of granular historic fills underlain by upper glacial drift soils consisting of fine grained silt and clay with varying percentages of sand and gravel extending to a depth of approximately 25 feet. The upper glacial drift grades with depth into a compact to very compact glacial till consisting also of fine grained silts and clays with varying percentages of gravel and sand, and possibly containing cobbles and boulders. At a depth of approximately 40 feet, very dense sands are expected to occur below the glacial deposits. DuPont, PE, PP, CME March 1, 2012 Re: Proposal for Geotechnical Engineering Services Our Proposal No. 2012 -033 Borough of Carteret, Middlesex County, NJ Page 2 - Prepare test boring logs indicating the subsurface conditions encountered and the techniques utilized. - To prepare a boring location plan. - To evaluate the results of the explorations in order to generate appropriate recommendations for the foundation design of the proposed structure. - To present the results of our studies in a geotechnical report. All test borings will be performed utilizing standard drilling techniques under the full -time controlled observation of a representative of CME Associates. Test borings will be advanced utilizing Hollow Stem Auger and /or Mud Drilling techniques. Soil samples will be obtained from within the borehole by means of a two -inch outside diameter split spoon sampler driven in accordance with ASTM Designation D -1586 for the Standard Penetration Test. Soil samples will be obtained continuously within the upper twelve feet and at five foot intervals thereafter. All soil samples will be classified in the field in accordance with the Burmister Soil Identification System. All soil samples will then be transported to a reputable soil mechanics laboratory for further evaluation and testing. The results of the field explorations and laboratory testing will provide the basis for the preparation of final boring logs and subsequent evaluations and analyses. The analyses will be performed utilizing accepted industry standards under the direction of a licensed geotechnical engineer. The results of our explorations and analyses will be submitted in the report. Estimated Fee For Services ........................................... ............................... $8,500.00 General Conditions of Services Right of Entry The client shall provide for right -of -entry for all CME Associates (CME) personnel and equipment necessary to perform the intended scope of services. The client understands that while CME will take reasonable precaution to minimize any damage to the property, some damage may occur in the normal courses of work, the correction of which is not part of this agreement. Utilities The client agrees to arrange for a markout of all utilities located in the vicinity of CME's intended work. CME will take reasonable precautions to avoid damage or injury to any subsurface utilities or structures. The client agrees to hold CME harmless for any CJ John P. Inferred Conditions The client understands that actual subsurface conditions may vary from those which are encountered at the locations of borings, test pits, or other such subsurface explorations. CME will base`interpretations and recommendations upon conditions inferred from the conditions encountered. Client recognizes that any future determination of conditions different than those which were encountered at the sampling locations may significantly impact the interpretations and recommendations provided by CME. Any such variation of conditions should be brought to the prompt attention of CME to assess the impact of the variations on the previously provided interpretations and recommendations. CME will take no responsibility for any interpretation or recommendation others may make based upon subsurface data provided by CME. Standard of Care Services performed by CME Associates under this agreement will be conducted in a manner consistent with the level of care and skill ordinarily exercised by members of the profession currently practicing in the same locality under similar conditions. No other representation expressed or implied, and no warranty or guarantee is included or intended in this agreement, or in any report, opinion, document or otherwise. Discovery of Unanticipated Hazardous Materials Hazardous materials or certain types of hazardous materials may exist at the site where there is no reason to believe they could or should be present. CME and client agree that the discovery of unanticipated hazardous materials constitutes a changed condition mandating a renegotiation of the scope of work or termination of services. CME and client also agree that the discovery of unanticipated hazardous materials will make it necessary for CME to take immediate measures to protect human health and safety, and /or the environment. CME agrees to notify client as soon as practically possible should unanticipated hazardous materials or suspected hazardous materials be encountered. Client encourages CME to take any and all measures that in CME's professional opinion are justified to preserve and protect the health and safety of CME's personnel and the public, and /or the environment, and client agrees to compensate CME for the additional cost of such work. In addition, client waives any claim against CME, and agrees to indemnify, defend and hold CME harmless from any claim or liability for injury or loss arising from CME encountering of unanticipated hazardous materials. Client also agrees to compensate CME for any time spent and expenses incurred by CME in defense of any such claim, with such compensation to be based upon CME's prevailing fee schedule and expense reimbursement policy. 9 John P. Further storage of samples can be made at the client's expense upon written notice by the client. Exceptions Any engineering and /or land surveying services beyond the scope outlined above will be considered extra. Said fees will be based on the hourly rate or a fixed fee mutually agreed upon in writing. The fees on the hourly rate schedule are subject to change by January 1 of every year. The terms of this contract will remain in effect for a period of one year from the date of this proposal. Should you accept our fee estimate, kindly provide a purchase order or professional services resolution authorizing same.
