I. Call to Order; Roll Call
A. Mayor Murray called the regular meeting of the Common Council to order at 7:00
PM. Upon roll call the following were found to be present; Adam Cohen, Jinsie
Bingham and Terry J. Smith; Absent: Mark Hammer and Phyllis Rokicki.
II. Public Hearing
A. Ordinance 2009 -12, An Ordinance For Appropriations And Tax Rates
1. Mayor Murray opened the Public Hearing for both Ordinance 2009 -12 at 7:01
PM
2. No comments heard; Mayor Murray closed hearing at 7:02 PM with motion by
Adam Cohen, second by Terry J. Smith, unanimous approval.
B. Ordinance 2009 -13, An Ordinance Approving The Vacation Of An Alleyway
Between Franklin Street and Columbia Street Located in the City of Greencastle,
Putnam County, Indiana
1. Mayor Murray opened Public Hearing at 7:03 PM by reading petition. Mayor
Murray asked those wishing to speak regarding this Ordinance to come to the
podium and speak. Jerry Miller, petitioner spoke as to his request. Darlene
Cox, 301 W. Franklin Street spoke regarding her opposing vacating this
alleyway. Discussion. Attorney Hardwick addressed issue of utility right -of-
way. Tim Haig, Senior Engineer for Vectren spoke next addressing issue of
utility right -of -ways. Stated that Vectren is not in a position to waive their
rights to this easement. Can not allow permanent structures over easements.
Will check on dog kennel. Carla Ricketts, 310 W Columbia house behind Mr.
Miller. Presented a petition with 140 signatures to save the alley way. Ms.
Ricketts also presented pictures showing fencing and debris blocking alley
way. Concerned with open dog pen and the potential for harm from dogs.
Concerned that the concrete was poured over gas lines and in alley way.
Darlene Cox read a letter written by Carla Ricketts. Tony Burdine, 302 W
Columbia opposed to closing alley way spoke also. Mayor Murray clarified
some question regarding sidewalk. Discussion and asked Brad Phillips to
investigate the drainage issue at Betty Sillery's house. Mr. Joe Miller spoke
again regarding the alley issue.
2. Motion by Jinsie Bingham to close public hearing at 7:45 PM, second by Terry
J. Smith, unanimous approval.

A. Lisa Eaton, Columbia Street Lot Closure request
a
1. Asking for extension for Columbia Street Parking lot use on September 12,
2009 from 6:00 AM to 2:00 PM as well as closing Columbia from Indiana to
Vine from 9:00 AM to 11:30 AM.
a. Motion by Terry J. Smith to approve this request, second by Jinsie
Bingham, unanimous approval.
B. Greencastle High School — Terri Collins (not present)
1. September 25, 2009 - Homecoming Parade
a. Beginning at 5:30 PM, Motion by Adam Cohen to approve as
requested, second by Terry J. Smith, unanimous approval.
C. Elks Lodge 1077 — Teresa Parrish
1. September 26, 2009 - Noise Ordinance Waiver
a. Teresa Parrish here for this request to change to October 3
extension from 10:00 PM to 12:00 AM. Motion by Terry J. Smith to
approve as requested, second by Jinsie Bingham, unanimous
approval.
D. DePauw University — Angela Nally
1. October 2, 2009 — Old Gold Weekend — Street Closures
a. Angela Nally present for this request; due to fireworks asking for this
closure to protect vehicles. Motion by Adam Cohen to approve as
requested, second by Terry J. Smith, unanimous approval.
E. Annual Berry Street Flea Market — Cheryl Salsman (not present)
1. October 3, 2009 — Street Closure
a. Mayor Murray presented this request on behalf of Cheryl Salsman.
Motion by Terry J. Smith to approve as requested, second by Jinsie
Bingham, unanimous approval.

Bingham, unanimous approval.

A. Ordinance 2009 -10, An Ordinance Designating Stop Intersections, Second
Reading
1. Motion to approve as presented by Adam Cohen, second by Terry J. Smith,

B. Ordinance 2009 -11, An Ordinance Establishing The Size Of The Departments Of
City Government Of The City Of Greencastle, Indiana, Fixing Salaries For The
Employees Of Such Departments And Fixing Salaries Of Certain Other Appointed
Officials For The Year 2010, Second Reading
1. Mayor Murray asked that a change be made under Department of Public
Works from Truck Driver /Labor II to Foreman/Tree Maintenance, motion by
Terry J. Smith, second by Jinsie Bingham, unanimous approval. 8:07 PM
VIII. New Business
A. Ordinance 2009 -13, An Ordinance Approving The Vacation Of An Alleyway
Between Franklin Street and Columbia Street Located in the City of Greencastle,
Putnam County, Indiana, First Reading
1. Mayor Murray read this Ordinance in its entirety. Planner Shannon Norman
spoke to Council relating that all utilities have been notified and will not waive
their rights to use of this right -of -way. Attorney Hardwick clarified that City
does not have any utilities in this right -of -way. Discussion. Motion by Terry J.
Smith to not pass Ordinance 2009 -13 and deny petition as presented, second
by Adam Cohen, unanimous approval. 3 — 0 Motion carried.
B. Ordinance 2009 -12, An Ordinance For Appropriations And Tax Rates, First
Reading
1. Mayor Murray read this Ordinance in its entirety. Motion by Jinsie Bingham to
approve as presented, second by Adam Cohen. Discussion. Terry J. Smith
moved that Clerk Treasurer Budget line item for CPA be restored to requested
amount of $3,000, motion died for lack of second.

A. Mayor's Report
1. IACT State Meeting in October Planner Shannon Norman has been asked to
speak on Green Communities. Recognized Chief Bill Newgent for being
named Chief of the Year.
B. Clerk- Treasurer's Report
C. Councilors
1. Adam Cohen commented on recent State Board of Account audit and
comments from Auditor regarding the state of the City books being good.

A. Motion to adjourn at 8:46 PM by Jinsie Bingham, second by Terry J. Smith,
unanimous approval.
