HomeMy Public PortalAbout2001/01/18 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor James A. Failace approximately 7:30 P.M. on Thursday, January 18,2001, Municipal Court/Police Facility, 230 Roosevelt A venue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmember Jack Fazekas " Remy Quinones Daniel Reiman Ronald Rios Janet Santoro Buddy Sohayda Also noted present was Borough Attorney Craig Coughlin and Business Administrator Nicholas Goldsack. The meeting was opened with a moment of silent prayer and pledge of allegiance led by Mayor James A. Failace. The Clerk stated that on January 12,2001 in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune, The Star Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers, Quinones and Fazekas and unanimous affirmative vote of the full Council present, the minutes of November 2 & 14, & December 7, 2000 were approved as transcribed and engrossed by the Clerk. The Clerk stated that Ordinance #0 I-I was introduced and adopted on First Reading and the Clerk authorized and directed same for Public Hearing to be held on February I, 2001, upon MMS&C, by Council members Fazekas and Quinones. Upon individual roll call vote Fazekas, Quinones, Reiman, Rios, Santoro, Sohayda voted in the affirmati ve. ORDINANCE # 01-1 1. "AN ORDINANCE CREATING A CARTERET REDEVELOPMENT AGENCY" Mayor Failace said, as you know we went down to Trenton on January 10, 2001. It was approved overwhelmingly. He said the Council needed to do this after they approved it. He said they have approved it and need to move forward. He said he gave the Local Finance Board the names that he had chosen. He said he gave it to JANUARY 18, 2001 COUNCIL MEETING ROLL CALL PRAYER, PLEDGE OF ALLEGIANCE STATEMENT OF MEETING NOTICE MINUTES FOR APPROVAL ORDINANCE #01-1 CREATING A CARTERET REDEVELOPMENT AGENCY COMMENTS JANUARY 18, 2001 COMMENTS (Continued) ORDINANCE #01-2 AMENDING CHAPTER 38, SECTION 5 OF THE CODE, RE: RESIDENCY COMMENTS the Council last week and was hoping that they would do something at the last meeting, but would wait for the next Agenda Meeting because they might decide to put some names on it. He said he felt the Council needed to move forward with this A.S.A.P. He felt the Council should not to procrastinate. The Clerk stated that Ordinance #01-2 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held on February I, 2001, upon MMS&C, by Council members Santoro and Rios. Upon individual roll call vote, Councilmembers Fazekas, Reiman, Rios, Santoro, Sohayda voted in the affirmative. Councilmember Quinones voted no. ORDINANCE #01-02 "AN ORDINANCE AMENDING CHAPTER 38 SECTION 5 OF THE CODE OF THE BOROUGH OF CARTERET." Mayor Failace said you know that we had last year a change in the residency. He said there was a residency requirement, an Ordinance that said that the Borough Employees had to live in town, except for the Fire and Police. He said the Council changed it so that they had to live in town one year, since that's what they have on the books for Police and Fire. He said the Council required employees to stay one year; this Council has chosen to change it to five years. He said he didn't feel it was the right thing to do. Councilmember Quinones asked the Clerk what it would cost to advertise an Ordinance and change Amendment. The Clerk, Kathleen Barney stated it depends on how many words and spaces. Councilmember Quinones asked again approximately what it would cost to advertise something like this. The Clerk Kathleen Barney said about maybe $30.00 dollars. Council member Quinones said when we first decided last year to eliminate the residency requirement, the change was made really as a result of a situation that arose from an individual who was offered a job and subsequently thought she had a job. She said there was some question as to her understanding of the offer which then turned into a bit of a problem and made her reevaluate this Ordinance and the real necessity for it. She said she felt it wasn't a good Ordinance and she didn't see why the Council would require people to live here. She felt a period of fi ve years was chosen with no logical explanation of that amount of time. She said it seemed to her that the Council was requiring people to act as indentured servants for a period that they see fit. She reiterated there is no logical reason to change this, to advertise this whether is cost $30.00 dollars or $300.00 dollars she felt it was foolish. She said she felt there was potential for a lawsuit and there has been lawsuits filed against Municipalities based on 2. these residency requirements, which these Municipalities have lost and she voted no. Councilmember Reiman said he spoke to Councilmember Quinones and the Mayor about this last year and they were opposed to changing any Ordinance that point in time. He said they were both supportive requiring Borough Employees to live in town I don't know why this was changed last year. He said at the Agenda Meeting Mr. Goldsack actually suggested the five years. He said some members of the Council considered seven years, some thought ten, some thought one or two. He said he supported the five years and voted yes. Councilmember Quinones asked for a clarification on the Ordinance and said no one ever spoke to her on that Ordinance. Councilmember Reiman was inaudible. Councilmember Rios said he felt was a good Ordinance. He said the Council is asking people to stay in Carteret for five years. He said hopefully they stay longer and the money will stay in Carteret. He said he thought it was a good Ordinance and didn't think it would be challenged and voted yes. Council member Santoro said again what you are trying to do is respect those Carteret residents, the ones who were either born or raised here and have lived in this town, or the ones who make their homes in this town. She said the difference between the Fire and the Police, who were allowed to leave after a year; we have no control over that. She said that is by State statutes, or we would amend that one also. She said she supported the five-year requirement and voted yes. Mayor Failace said this has nothing to do whether you are a life long resident of Carteret. He said the old Ordinance said you still have to live in Carteret in order to get the job that never changed that had nothing to do with life long resident of Carteret or fairness of residents of Carteret etc. He said he mentioned that at the Agenda meeting, Councilman Rios asked three, four, six months ago, to change the Ordinance before he was a Councilman he wanted to know why residents needed to be required to live in Carteret. He said he was against it at that time as Councilman Reiman was. He said the more I thought about it, Councilman Sohayda brought it up at an Agenda Meeting that that the Council should do something with this. He said if the Council does it for Police and Fire, the fair thing for all our residents, our employees was to allow them the opportunity to move out of town. 3. Councilmember Rios said the Mayor should understand you said that you weren't going to change this for one person. He said the Mayor asked if this was for one person, it wasn't for one person he had received numerous calls from Borough Employees. He said it gives them the opportunity to stay or go he didn't think they should be locked in forever to stay here, but though they should have the opportunity to move out. He felt a five-years was a good number. JANUARY 18, 2001 COMMENTS (Continued) JANUARY 18, 2001 ORDINANCE #01-3 ESTABLISHING BENEFITS FOR CERTAIN BOROUGH EMPLOYEES COMMENTS The Clerk stated that Ordinance #01-3 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held February I, 200 I, upon MMS&C, by Councilmembers Reiman and Santoro. Upon individual roll call vote, Council members Fazekas, Reiman, Rios, Santoro and Sohayda voted in the affirmative. Councilmember Quinones voted no. ORDINANCE #01-3 "AN ORDINANCE ESTABLISHING BENEFITS FOR CERTAIN BOROUGH EMPLOYEES" Councilmember Quinones said she has some questions before she voted on this and asked if Councilmembers, who intend on taking the benefits, please let me know now. Councilmember Rios and Fazekas said they would not be taking the benefits. Councilmember Reiman said he doesn't see what bearing this has on this. Councilmember Quinones said it has a bearing on my vote. Council member Reiman said you are going to be voting either yes or no, if six people take it or if six people don't take it. Mayor Failace said it is rather a simple question, you don't have to answer if you choose not to. Councilmember Santoro said she might. Councilmember Sohayda said he was. Councilmember Quinones asked if anyone knew if the new Borough Attorney was going to take benefits. Craig Coughlin, current Borough Attorney said he does. Councilmember Quinones said she is going to pass on her vote. To come back to her. The Clerk called the roll. Council member Quinones said she read in the newspaper today how Councilwoman Santoro feels that the benefits are a good way to entice people to run for Council. She said she finds it to be extraordinarily arrogant and just plain stupid why we would we want to offer benefits at the expense of the taxpayers just to encourage people to run for Council is ridiculous. She said she certainly did not run for Council with the intention that she was going to do so only because she was going to reccive a paycheck, benefits or one or the other or both. She said what she found even more fascinating about 4. the position people are taking now, IS these very same Councilmembers last year didn't want to vote to fix the sewers, they didn't want to vote to buy playground equipment. She said they complained about every possible expenditure and made an issue out of the fact that a desk that had been sitting in storage for fifteen years was destroyed and was somehow a waste of taxpayers dollars. She said she didn't really know who was going to take benefits, whose family is going to take them or who would be taking them even though they can get them through their employers. She said the Council potentially could be facing an increase of half a tax point. She felt it made no sense to her particularly in light of the fact that as Councilman Reiman pointed out during an Agenda Meeting the potential insurance cost is going to increase this year in excess of $400,000.00 dollars. She said she thought it was ludicrous and hypocritical and voted no. Councilmember Reiman says what is hypocritical is that you accepted health care benefits for six months in 1999, he said I have the report right here. Councilmember Quinones said she accepted health benefits for thirty days and it overlapped. She said why that shows six months is inaccurate. She said she did inform the Borough Clerk to terminate her insurance coverage, but being a person who is willing to put her money where her mouth was, she will reimburse the Borough for whatever time period those expenses were incurred. 5. Mayor Failace said the bottom line was she thought it was a good thing to take away those benefits. He said the Council does not need to get benefits. He said Councilwoman Quinones had $50,000.00, and maybe this Council could be $50,000.00, another Council and Mayor who chose to take it with full family benefits could be at $12,800.00 as Councilman Fazekas was originally before it was taken away for family benefits. He said he felt they should not be paying for family. He felt if they want to pay for the Council people, take away the benefits for the family, the town shouldn't be paying for the Council families. He said at the last Agenda Meeting, the Council talked about $400,000.00 increase in medical expenses. He said the town needs to do digital tax maps the last time they were done was twenty years ago they are probably illegal. He said the cost of that would be about $48,000.00 dollars he chose to hold off on doing that because of the expense to this Borough. He said that would bring us up to 2001. He said Councilman Fazekas was talking to him today about prompters and cut holes in here and spend money to do that. He felt it was great, it's a good idea, but said they have other things they needed to do and benefits was not one of them. He said this Council should be ashamed of themselves to put the benefits back. He said Councilman Fazekas says he's not taking benefits, Councilmember Rios says he's not taking them, Councilmember Santoro says maybe, she was not sure. He said Councilmember Reiman; we don't know, he won't tell us, Councilman Sohayda said yes. He reiterated there is no reason to do this, there is no reason to burden the tax payers with that and felt the Council could use that money to get digital tax maps. He said we could move ourselves forward to what we've done with Councilman Fazekas with computers and what we've done with this Borough it was money well spent, there's no doubt about it. He said he felt this is money JANUARY 18, 2001 COMMENTS (Continued) JANUARY 18, 2001 COMMENTS (Continued) wasted. He said the Council took it away because they thought it was the right thing to do. He said they still believe it was the right thing to do that we should not spend money on benefits on this Council. He said any Councilmembers that take it should be ashamed of themselves, because as the Councilwoman said we didn't volunteer for this as you saw in the newspaper. He said as Councilwoman Santoro said that it would bring more volunteers back. Councilmember Quinones said no one here volunteers, they get paid. Mayor Failace continues saying now days, a lot of people aren't as likely to volunteer. He said he got paid $10,000.00 and spends most of his money; there is no doubt about that. He said he spends it in the Borough and every where else that he can get. He said we don't volunteer to do this that's not why he believed any member of this Council ran, to get benefits. He said if most of the Council is not taking benefits, he had no idea why they want to put it back unless they are putting it back for a few members. He said quite honestly that's outrageous, it's ludicrous if they wanted to say they wanted to give it back to the Public Defender, he felt that was a good thing and wouldn't mind that. He said he thought the Council was adjusting the salary and thought since they were doing it they would take it out. Councilmember Santoro said why would you remove it from the Attorney if the old Attorney received it for four years. Mayor Failace said that has nothing to do it you want to make it look like that because we are losing a Borough Attorney or we are losing Council people. He said all the Council people are still here and felt it was the right thing to do. He said most of the people in this audience would tell you it's the right thing to do. He said this Borough should not be paying for benefits for this Council at a half a tax point, a whole tax point. He said we have a problem as is and quite honestly the Council should be donating that back and felt it should be going back to the Borough residents. Councilmember Rios said it is ironic how two months, a month before the election the Council wants to do away with these benefits for a few we are doing away with it for. He said he didn't understand your logic when you've been up here in control for how many years. Mayor Failace said as Mayor. Councilmember Rios said your Administration, whether as Mayor and Council. Mayor Failace said well as Mayor it's two years, total of three years. Council member Rios said three years, and you didn't change it in those three years didn't you waste money then. 6. Mayor Failace told Councilmember Rios he never thought about it and said this was discussed long before an Agenda Meeting, long before, long before an election or anything else. He said this Council would tell you it was brought up at an Agenda Meeting with the prior Council. He said they were going to look at it, talk about it, and think about it. He said that was the bottom line and was long before any election. Councilmember Rios said it wasn't done until a month before the election. Mayor Failace said, because you believe it isn't the right thing to do, bottom line is it is the right thing to do. Councilmember Quinones said this isn't about rectifying what you thought was a political injustice. The Clerk stated that Ordinance #01-04 was introduced and adopted on First Reading and Clerk authorized and directed to advertise same for Public Hearing to be held on February I, 2001, upon MMS&C, by Councilmembers Santoro and Rios. Upon individual roll call vote, Council members Fazekas, Reiman, Rios, Santoro and Sohayda voted in the affirmative. Council member Quinones voted no. ORDINANCE #01-4 "ORDINANCE ELIMATING THE POSITION OF DEPUTY MA YOR" 7. Council member Quinones said this one baffles me I can't even understand why we have to spend money to advertise to eliminate the position of Deputy Mayor a position in which is non-salary, non- tenured, non-classified. She said it is merely a position by Ordinance gives an individual chosen by the Mayor certain duties. She said there is nothing significant and said she could read you the Ordinance. She said they have no powers to bind anybody or bind the Borough. She said this came up because the Mayor and this is a third party conversation, so I'll have to admit that it is hearsay. She said the Mayor had a conversation with Dan Reiman they discussed Jeff Pino, who is the Mayor's Aide. She said at the time, the Mayor is being forthright and told him that he was considering giving him the appropriate title under the Ordinance, which is Deputy Mayor. She said at the next Agenda Meeting, low and behold what happens, Councilwoman Santoro says she wants to introduce an Ordinance eliminating a position, the reasoning for that is it could cause confusion amongst the residents. She said they might not know that the Deputy Mayor doesn't have the powers that certain people think he has. She said the people of Carteret are not stupid, this Ordinance is. She voted no. Councilmember Reiman said he had a conversation with the Mayor and explained to him that they wouldn't have a problem, if he appointed; not only the Council would. He said he could appoint anybody he wants as Mayor's Aide this Ordinance has been on the books for some years. He said he knew Mr. Rios has voted against it, when it was established some time back. He said the position of JANUARY 18, 2001 COMMENTS (Continued) ORDINANCE #01-4 ELIMINATING POSITION OF DEPUTY MAYOR COMMENTS JANUARY 18, 2001 COMMENTS (Continued) Deputy Mayor doesn't exist in our form of government they are not held accountable to this Council, under our form of government every employee in the Borough were official is held accountable to this Council. Council member Quinones said the position is held accountable to the Mayor. Councilmember Reiman said exactly, and that's the problem with it. Councilmember Quinones said that's the problem for you. Councilmember Reiman said yes. Mayor Failace goes on to read what the Deputy Mayor does and thought you should know what they should get rid of. He said the position of Deputy Mayor being here is created which appointment shall be made by the Mayor. He said the position of Deputy Mayor should be non-classified and non-salaried. The Deputy Mayor shall serve at the will of the Mayor. The Deputy Mayor shall be exclusively responsible directly to the Mayor, the responsibility of the Deputy Mayor is as follows: To maintain communication levels with County, State and Federal Government so as to express the position of the Mayor. As to the governmental needs of the Borough of Carteret at those times when the Mayor cannot personally express such a position because of other committees. The Deputy Mayor is not authorized to express the opinion or the thinking of any person affiliated with the Carteret Government except that of the Mayor and then only with the Mayor's expressed authority and direction. He said what they have done is taken away Deputy Mayor and had no Aide. He said there is no Ordinance creating an Aide. He said I am, I have to admit even though I spend a lot of time in this Borough, I am a part time Mayor. He said now I have no one to answer my phone and I have no one to make calls for me when the residents call me. He said my Deputy Mayor either responds to the residents or responds to me if it is urgent enough, now I can't do that and the residents will have to wait. He asked if the Council was planning to give him an Aide. Councilmember Reiman said Jim that's not true. Joe Gentile is the Mayor's Aide. Mayor Failace asked Councilmember Reiman where it was stated in the Ordinance. Councilmember Reiman continues saying the Mayor Aide position is not there is a salary ordinance establishing it. Mayor Failace said there is no Mayor's Aide position. Councilmember Reiman said you have a Mayor's Aide. 8. Council member Quinones said you don't have a problem with Joe Gentile, but you have a specific problem with Jeff Pino. Councilmember Reiman said he had no problem if you want to call Mr. Pi no or Joe Gentile the Mayor's Aide. He said he did have a problem with the Deputy Mayor's position it doesn't exist in our form of government they are not held accountable to this Council. He said everybody in the Borough, the Borough Officials or the Borough Employees is accountable to this Council. Councilmember Quinones say the Mayor's Aide should be accountable to the Mayor. Mayor Failace said he didn't understand, if the Mayor's Aide had the same duties as the Deputy Mayor, why is the Council wasting money. He said he felt this was stupid and the Council was only doing this because it was him, because it's my Mayor's Aide, it's my Deputy Mayor. He said there is nothing in this book that says there is a position of Mayor's Aide. He asked the Council to at least draw up an Ordinance that says he has a Mayor's Aide. Councilmember Santoro said at the Agenda, absolutely. Mayor Failace said we are going to do is we've spent money to get rid of this position and we are going to create another position that does the same thing. Councilmember Santoro asked Mayor Failace what the Council did last year. Mayor Failace said a Mayor's Aide, let me explain to you why I had a Mayor's Aide, because Pete Sica, God rest his soul, had a Mayor's Aide. He said he was always under the assumption and the impression that I had to have a Mayor's Aide and when you begun being Mayor, you had an Aide, I never looked it up. He said he took full credit for being stupid for thinking there really was one and not looking in the book. He said when he looked in the book and saw that it was, he mentioned it to Councilmember Reiman in his office and told him he was going to name Jeff Pino and Joe Gentile Deputy Mayor's. Councilmember Santoro asked if the Mayor appointed the Mayor's Aide on January first. Mayor Failace said two Mayor's Aides, absolutely. Councilmember Santoro said so all we have to do is create the Ordinance since it was never done in the past. 9. Mayor Failace said we need to spend more money to create another position, all you would of have to do is allow me to say Joe Gentile, Jeff Pino are Deputy Mayors. He said they answer to me, they speak only for me. He asked what Councilmember Reiman was so worried about; my Aides or my Deputy Mayors are not responsible to this Council. He said what does he expect, they have to come back and answer to him, no, they answer to me. He said he felt it was another waste of money and a waste of time and as Councilmember Sohayda said it is a waste of paper it is written on. He said he felt it was really is a shame that Council members Reiman and Rios said that we are going to do away with the petty politics, in their January 1st speech, no petty politics. He said if this isn't petty politics, its garbage. He JANUARY 18, 2001 COMMENTS (Continued) JANUARY 18, 2001 COMMENTS (Continued) reiterated he felt this was a waste of time. He said why would anybody think a Deputy Mayor could sign papers. ORDINANCElOl-5 AMENDING SALARY ORDINANCE #71-9, RE: PLANNING BOARD/ZONING BOARD CLERK & HOUSING/BUILDING INSPECTOR The Clerk stated that Ordinance #01-5 was introduced and adopted on First Reading and Clerk authorized and directed to advertise same for Public Hearing to be held on February I, 2001, upon MMS&C, by Council members Fazekas and Rios a motion was made to table. Upon individual roll call vote, Council members Fazekas, Quinones, Reiman, Rios, Santoro and Sohayda voted in the affirmative. ORDINANCE # 01-5 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PA YMENTS OF SALARÅ’S FOR THE VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" COMMENTS Councilmember Reiman said when we discussed this at the Agenda Meeting this was at the recommendation of the Zoning and Planning Board. He said he knew the Planning Board because he sat on the Board as Chairman. He said the Planning Board recommended a salary increase for the Clerk for $3000.00 from $2000.00 because of the additional workload, it important to this position and it was recommended by both boards. He said somehow on this Ordinance it may have an automatic increase at the next year and the following year and said he didn't really have a problem with it he just wanted to address this to the Council. Mayor Failace said it has always been a flat rate. Councilmember Reiman said it's been a flat rate that's what he was saying an automatic increase the way this Ordinance is reading. Councilmember Santoro asked who put the increase in. Councilmember Reiman said that's what he wanted to know. Nicholas Goldsack, Business Administrator said historically the increase, whatever kind of contractual increases are g1Ven, historically they are given on the same.... Councilmember Reiman said that's not true. Mayor Failace said not for this position, this position was a flat fee. He said Councilmember Reiman said$3000, he said he thought it was $2500.00 maybe it was $3000. 10. Nicholas Goldsack, Business Administrator said he would check into it. He said normally what happens is it is added to their base pay and the contractual obligations are added to it. Mayor Failace said it never was added in the past. Nicholas Goldsack, Business Administrator said he would verify that. Mayor Failace said he thought maybe this should be tabled in order to do it right. A copy of each Resolution was placed on the table for public review prior to the meeting in accordance with Rules of Council and upon MMS&C, by Council members Rios and Quinones and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be open for input on all Resolutions. John Sudia, resident of Carteret has a question on 01-26 Professional Services Weiner, Lesniak, Esq. regarding Makwinski arbitration in fact it is basically the same that we paid the attorneys for at the last meeting. Craig Coughlin Borough Attorney said Weiner; Lesniak represented the Borough in the same manner. John Sudia asked if they would represent the Borough in the same manner. Mayor Failace and Craig Coughlin, Borough Attorney both said they did. There being no further comments or objections to the Resolutions, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Rios and Reiman and unanimous affirmative vote of the full Council present. RESOLUTION #01-17 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Rios and Quinones RESOLUTON #01-17 11. "DIRECTING THE ISSUANCE OF BINGO LICENSE TO CARTERET JEWISH COMMUNITY CENTER" was adopted. Upon individual roll call vote, Councilmembers Fazekas, Quinones, Reiman, Rios, Santoro and Sohayda voted in the affirmati ve. JANUARY 18, 2001 COMMENTS (Continued) MEETING OPENED PUBLIC INPUT ON ALL RESOLUTIONS COMMENTS MEETING CLOSED RESOLUTION #01-17 DIRECTING THE ISSUANCE OF VARIOUS BINGO LICENSES ADOPTED JANUARY 18, 2001 RESOLUTION #01-18 DIRECTING THE ISSUANCE OF V ARIOUS RAFFLE LICENSES ADOPTED RESOLUTION #01-19 AUTHORIZING PURCHASES FROM STATE CONTRACTORS FOR 2001 ADOPTED RESOLUTION #01-20 AUTHORIZING MAYOR TO EXECUTE INTERLOCAL SERVICE AGREEMENT-DOG WARDEN SERVICES II.DOPTED RESOLUTION #01-18 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Rios and Quinones RESOLUTION #01-18 "DIRECTING THE ISSUANCE OF RAFFLE LICENSES TO CARTERET JEWISH COMMUNITY CENTER, HOLY FAMILY R.C. CHURCH & ST. JOSEPH R.C. CHURCH" was adopted. Upon individual roll call vote, Council members Fazekas, Quinones, Reiman, Rios, Santoro and Sohayda voted in the affirmative. RESOLUTION #01-19 was introduced by the Mayor and referred to the Council for action. Councilmember Reiman said so we would have to adopt a second resolution as far as (inaudible). Borough Attorney, Craig Coughlin said you would have to do that, you also want to have a sense of what the nature was and what the likely hood of success and a budget in terms of proceeding forward. He said it says be it further ordained that this Ordinance shall be effective January I, 2001. He said how are we paying for benefits now for Council members have benefits right now. Borough Attorney, Craig Coughlin said he thought the answer to that question was that the way the period runs the payment last month covers through the period that is now in existence. He said by making it effective January first what you are doing is creating a seamless coverage at no additional costs. He said they never ceased on December 31 st, because that wasn't the policy period. Mayor Failace asked if the members of the Council were covered this month. Craig Coughlin, Borough Attorney said correct anybody who was eligible to receive it in December, when the December payment was made, that carried through the middle of this month. He said if this became effective back, then we will be able to cover it forward without any interruption. BUILDING & GROUNDS: Committee Chairperson Quinones said last weekend Anthony Neibert injured himself, by falling down the stairs at home and he tore some ligaments in his knee. She said he had to undergo surgery today, and she understand from his daughter who contacted the Borough that he was doing well and he sends thanks to everyone who called his home and wished him well. She said he has been really good over the past week he has constantly been in contact with the Borough and Charlie Nagy and Cindy DeCamp. She said the two people she would like to thank because they went out of their way to come in on the weekend and cancel appointments and reschedule for people who had scheduled inspections wouldn't just be left hanging and it is certainly a tribute she thanked their entire department. She said Kenny Krug who does some of the electrical inspections is going to be filIing in for Tony. She said they are going to have to ask that the public give us some leeway and he won't be able to possibly operate under the same timetable as Mr. Neibert, but he was going to try to schedule more inspections. She said they thought Tony might be out for about six (6) weeks on January 5th She said they had an audio system installed in the new Community Center that contained six speakers, a hearing assistance package, and wireless microphones. She said a representative from one of the senior groups was there so he could instruct them on how to use the equipment. She thanked John Riggio for his work with the Community Development Block Grant, which 18. 19. helped us get the equipment. She said they were progressing in moving the Office of the Disabled into the new Center. She said it was to my understanding that JoAnn Kissleman had acquired as to the status and was advised by Councilwoman Santoro that she didn't know. She said she had to inquire as to some of the items that had been done to move it along. She said they are now at a point where we have set up a phone line, a desk and some other furniture so she is ready to move in. She said she directed Mr. Brewer that he was absolutely not to deny access to the Firehouse/Community Center to any individuals who would like to utilize it, without checking with her first. She said if there is anyone who has made an attempt to use the Center and have been denied she would certainly would appreciate it if people would contact her through the Borough Clerk's office. She said there were some complaints in the past about individuals who said they were denied access. She said the YMCA is running some programs temporarily in the Community Center, until we can move them over to the Firehouse Center. She said as for the kitchen in the Senior/Community Center, she spoke to Gloria Goodrich today she advised her of the post drawing of the bids from Potter they sent out for some quotes two of which are returned. She said the lowest is being $17,000.00 dollars, which has gone out today and she understood included in that is a price of a stove, a microwave and some cabinets and that only additional item we may have to purchase above that is a refrigerator. She said she had been going through a lot of paperwork, files, letters and trying to sort out some things that need to be sorted out. She said over the next few weeks, she'd be giving a more detailed report on some open items. She said last thing she wanted to discuss was a letter that was in the newspaper just this past week, regarding the fires that occurred on News Year's Eve. She said she responded to it at an appropriate fashion and wanted to say here today, that it was very discouraging to see that someone who continuously looks to draw attention to himself would engage in blatant lies and attacks against people who have an ax to grind with. She said she checked police reports and checked with Wayne Carrico, the former Chief of the Volunteer Fire Department to confirm what had happened at the scene. She said she went through the logs with Captain Pieczyski regarding exactly what happened that evening, who was called and who was not called. She said nowhere in those reports and at no time did Wayne Carrico mention that anyone had reached out and made any attempt to contact her. She said she certainly would never refuse assistance in that situation and to imply that she would put people in jeopardy is just absolutely disgraceful there is no truth to that. She said anyone who wants to check the records can feel free to go and do that. She said they could speak to the Captain and/or the former Chief of the Volunteer Fire Department. She said they were also advised her that he was very pleased with the support he received from everyone including the Director of Public Works and John Riley who showed up with some equipment to assist that evening. Mayor Failace said he would like to add to that he would like to assure the number of senior citizens that called his office worried. He said he would like that lady to print that in the paper too he wanted the people to understand that our volunteers and our Fire Department do a great job. He said they don't need him to fight a fire or to give them any kind of direction to fight a fire. He reiterated the Fire Fighters did a great job, the Borough responded, the Garage responded, the Parks Department responded. He said he did not hear the phone at 50' clock in the morning, and was sorry for that, Councilman Fazekas was there. He said he felt everything that was needed to be done was done. - FINANCE & ADMINISTRATION: Committee Chairperson Reiman said he attended a couple of meetings so far with Patrick DeBlasio & Nicholas Goldsack in preparation of the 2001 Budget. He said he knew they had been re-doing the Budget requests, department requests with their wish list and their needs with the upcoming year. He said he was going to call a finance meeting for next week with Council members Sohayda Santoro and he would sit down with the Business Administrator, Councilmember Quinones and the Chief Financial Officer to review the budget requests and where the town was. He said he directed Nick and Pat, contacted all the Department Heads and put together an itemized list of old and unused equipment. He said he also compiled a list of Borough property he felt could be auctioned off. He said with that progress. FIRE: Committee Chairperson Rios said he had some sad news, this morning the 1st responders, Fire Department responded to a 911 call. He said a long time Volunteer Fireman, former Fire Chief, John Malyin past away today he said this was sad day; he was a really dedicated volunteer Fireman. He said his sympathy and condolences go out to the family. He said the 1" responders responded very well, unfortunately they couldn't revive him. He said he met with the Fire Superintendent Chief, Brian O'Connor for the first time, approximately three or four days after he was sworn in. He said they went over a few things about the Fire Department, toured both firehouses and met with the Fire Fighters. He said on New Year's Eve there was a large fire in an abandoned house on 64 Union Street. He said it was another job well done by all our Firefighters, their arrival was well advanced. He said the weather was very cold, and was thankful it hadn't become worse. He said on January 12'h, there was a bad accident on Industrial Road, the Firefighters responded and they did a great job on extracting the victim from the car. He said while they were working on that there were wires knocked down due to the accident. He said there was a Volunteer's Chief's banquet, for the former Chief on January 13th which he attended and felt it was a nice affair and wished the former Chief well. He said on January 14th, he went to the swearing in of the new Volunteer Fire Chief Scott Pine and the rest of his officers for the year 200 I, he congratulated them and wished them luck. He said the computers are being installed right now in the Fire Department and should be completed soon and would be able to network with the rest of the Borough. He said they received a few thanks from different people who used the Fire Department for the morning Seniors who received a thank you for our first responders for a rescue of a lady who broke her collar bone and knee. He said they also received a thank you from a teacher for a tour of the Fire Department for the month of September and said he felt the Fire Department does a great job and looked forward to working with them in the year 2001. He said with that progress. 20. PARKS & RECREATION: Committee Chairperson Santoro said we will be having our first committee meeting next Tuesday, with Bob Kately and Beverly Hedesh and by the next meeting they would have more to report for the upcoming year. POLICE: Committee Chairperson Santoro said on January 11th, Detectives Connolly, Singura and Stroka were engaged in a narcotics foot patrol in plain clothes. She commended each one of the Detectives for the continuing efforts not only in reducing the drugs, but also for their creative approach and determination of making apprehensions when possible. She said they do this without incident or injury, which seems to occur at other times. She agreed with Councilmember Rios about the Friday, January 12th, there was a severe accident. She said the driver was knocked unconscious after a head on collision and suffered life threatening internal injuries. She said Officer (inaudible) and Patrolman James Csmbok were first on the scene, immediately after securing the scene, to prevent further acceleration they rendered first aid to the victim until the victim was able to be removed, by cutting open a severely damaged car. She said due to the degree of injuries, the victim was then flown to University Trauma Center by the North Star helicopter. She said she would like to commend the Carteret First Aid Squad, Medic 10 and Carteret Fire Department personnel who responded to the scene for another excellent professional effort. She felt it may have well saved a young man's life and prevented bigger problems in a dangerous situation. She also commended the actions of the officers of the EMF for responding that evening for their excellent work and particularly commended Dispatcher Margaret Grotski, Patrolman James Csmbok and Lt. Barry Auker she said she was sure the Council all share the same sense of pride and the professional effort of these Officers in the extreme circumstances they faced that evening. She said anybody, who saw the accident knew it was a very dangerous situation with the wires, of our services worked well together to eliminate any other problems. She again commended all involved. 21. PUBLIC WORKS: Councilmember Sohayda said the end of last year, he was told he didn't talk about all the departments. He said it was true and thanked everybody for bringing that to his attention. He said this year he would talk about the Municipal Garage, Sewage, Recycling and Streets and Roads Department. He said so far for the New Year they department dealt with the snowstorm as best they could and asked everybody if you could, please remove all cars from the street when it is snowing this will enable the department to do a better job on your street. He said if it keeps snowing and the plow comes down your block and keeps on snowing some more, yes the plow is going to come back and your driveway is going to get plowed in, which is what's going to happen and always does. He said the Municipal Garage has been doing a great job keeping the equipment updated and felt they were trying the best we could for the level of equipment we have with the amount of manpower we have. He said from that point on, we have been doing preventive maintenance on a regular basis on the fleet of the town and believed the fleet for the town of Carteret is up to or close to 100 vehicles. He JANUARY 18, 2001 STANDING COMMITTEES JANUARY 18, 2001 STANDING COMMITTEES (Continued) said the Recycling Department has been doing their best to catch up on the leaf bag program and are entering information into the computer system so next year we know who showed up and who didn't. He said the Recyclable Department has been maintaining a good schedule even during the snowstorm and commended them. He said if anybody is having a problem with his or her garbage, please don't hesitate to call 541-3881. He said they are missing a few streets from time to time and the Manella Sanitation Company seems to have a problem with finding the streets where they belong and what day to pick up the resident's garbage. He said he felt they've been here long enough to know where they are supposed to be. He said for some good news, he was informed that the County reorganization, and after a lot of yelling and screaming, Roosevelt Avenue and Washington Avenue will be paved this Spring after the Water Company dug it all up, the will be at no cost to the Borough of Carteret. He said these roads would be paved from end to end on a County level at no cost, other than that progress. He said was brought to his attention at the Reorganization Meeting in Carteret that he never talked about the Municipal Garage. He said, please, everybody in the audience, I want everybody to know, the Municipal Garage is a viable part of the town of Carteret they keep the cars rolling, the Payloader moving and gassed as well as every other department in Carteret. He said he overlooked thanking them for the year 2000 for everything they've done for the Borough of Carteret and would like to say publicly thank you to the Municipal Garage employees for what they've done for us in the year 2000. BOARD OF EDUCATION: Committee Fazekas said next week would be the first meeting he would be having with the Board of Education. He said at that meeting he would discuss shared services, migrating or creating a computer center for the entire Borough and would give the Council more information concerning that at the next Agenda. He said for the past year, as Commissioner of the Fire Department, he was called several times during the course of the year at certain fires. He said he was at the New Year's Eve fire and no one from the Council was there and they were called. He said there were efforts by not only by the Carteret Fire Department, but also other Fire Departments to a fire and they put out a fire which was 5:30, 6:30 in the morning. He said career and volunteers they put out a fire there were about thirty people running around trying to put out this fire. He said he felt it was unfortunate that in the paper the town overlooked the efforts by somebody making a comment and that did get highlighted. He said he did not think there was any Council member, especially Ms. Quinones that would deny anyone or would turn away any calls and he wanted to make sure everybody knew that over the past years he was there if anybody from this Mayor and Council was called they did react. He said if they were called they did make decisions. He said if someone heard the report from the Fire Commissioner, there is a new network in the Fire Department. He said Ronny (inaudible) put in; we are migrating programs over to the new fire systems one of the things that we plan on doing is to integrate with the Police, the new Police system with the Fire Department. He said the tax maps, which are the GIS stands for Graphical Information Systems and was a very important and vital system that Municipalities are migrating to concerning digital. 22. He said it makes access and also provides the variety of features that the GIS System provides. He said tax maps by law, have to be updated, there's no delay, surveyor comes and they have to update the tax maps. He said not all Municipalities have computerized the tax maps, the tax maps have three systems one of the systems, that have been proposed is x amount of dollars. He said we want to make sure, and he was willing to make sure that the tax map or the GIS System is compatible with the Police system. He said we are going to proceed, which is the GPS system, which is the Global Positions System, so that we can have MVP's located in the patrol cars. He said the council wants to insure that they are compatible, if they are not compatible, it's much more of a cost. He said a GIS System could run a quarter of a million dollars depending on how it is implemented. He reiterated that there are three different types of GIS Systems he was looking at and would be giving information at the next Agenda Meeting where he would make a recommendation. He said he wanted to let everybody know that it is one system that was proposed and wanted to make sure that it could integrate with not only our vital system that we have the tax records, but also for the Police System for the GPS System. He said with that moving along. 23. Mayor Failace said he would like to read a letter that was sent to him by a V. Pauli us. He said he felt the letter told how our Building Department works and what they do up there. "Dear Mayor, during the holiday season I find that spreading some cheer to others makes life better to us all. I wanted to take this time to inform you of a matter, which should do your heart some, good. As you may know, our company is built all over the US and Canada. In that time, we have become well educated in the inner dealings of local Coding Officials. While in the State of New Jersey, our experience remains positive, you should know that in the Borough of Carteret the experience is second to none. My dealings with Anthony Neibert and the rest of the inspectors over the past year or so are a true credit to your Administration. While always remaining responsible Tony has always been courteous and distinguished himself as a true professional that he is. The entire staff continues to go beyond the call of duty in assisting our building division. It has become a pleasure to call, schedule and make arrangements for compliance in your town. I thought a little good news about progress would lift your spirits." He said it was good to hear. He said the department has brought in, if you take the waved fees last year on the Building Department, one million dollars. He said he felt that had to be a record. He said this year we started out again with some good monies coming in for construction in the Borough of Carteret they have done a great job. He said, Council member Quinones, in talking about Tony Neibert's accident, Mr. Neibert forgot to tell you he tripped and he fell, I think that he broke a couple of toes and strained his knee that was operated on. He said he called him during the week to find out because he heard a rumor. He said the rumor in fact was true, when they brought him to the hospital they put him on the gurney, he fell off the gurney. He said he asked him to find out exactly how he injured his knee whether it was from the gurney or the accident at home. He said in the reference to Redevelopment, there is not much to say, the Local Finance Board said in December it was one of the finest and most concise plans ever given to them. He said he was very proud of that fact and proud of the people that JANUARY 18, 2001 STANDING COMMITTEES (Continued) COMMENTS JANUARY 18, 2001 COMMENTS (Continued) worked on that plan, John Riggio was one of the people in Community Development. He said the town would move forward and he would not tolerate it and hoped this Council would not tolerate it either. He said in picking aides, picking the members of the Agency and moving forward, he knew they would have a slight battle, but it won't be a great battle. He said he believed this Council wants to and would move forward as fast as possible and hoped it would happen. He said he received some information and would ask Councilmember Santoro and Councilmember Fazekas because it was concerning the School Board budget. He said he was told in 1999- 2000 that the School Budget was over expended by $800,000.00 dollars and told Councilmember Santoro he heard this last year but the Council never heard about this from her last year. He asked if Council member Fazekas or Santoro knew anything about this. Councilmembers Santoro and Councilmembers Fazekas both said no. Mayor Failace said he was going to ask Council member Fazekas as liaison to the Board of Education to research it to find out exactly. He reiterated that he had some information and said he would pass it on to him. He said he would not say anymore because he was not sure exactly what happened and said he would be discussing this at the next Agenda Meeting. He said as far as the digital tax maps go he hoped that everyone was on the same line and would do this and felt they should check what other Municipalities do. He felt they would be wasting time checking into what other Municipalities do and didn't care what they do in certain instances and this was one of them. He said the town has tax maps that are illegal, and asked Couneilmember Fazekas if that was correct. He said he thought the last one that was done was done in the early 80's, 1979 was the last changeable date. Nicholas Goldsack, Business Administrator said 79. Mayor Failace said the town originally hired E.KA. Associates and gave them the members of last year's Council, he said some of the members were on the Council today. He said he felt the town gave them $5000.00 to put something together, the cost is $48,000.00. He said what they put together, every Councilmember, I don't know if Danny or Ronny had one, but every other Councilmember had a copy of it. He said he looked his computer and felt it was great and something that we should do. He said it was something that Council member Fazekas said earlier. He said the Police can use this the Fire can use it and could do so many things with that. He said he felt it would be an enhancement to the Borough, a great enhancement to the Police, the Fire Department and Construction Department. He felt it was a small price to pay. He said the Council talks about giving back benefits to this Council and felt they absolutely should be thinking that, we could find the 48 grand to do this. 24. PUBLIC DISCUSSION Upon MMS&C, by Councilmembers Rios and Sohayda and unanimous affirmative vote of the full Councilmembers present, the meeting was opened to the public for discussion. John Sudia said in regard to the Redevelopment Agency he hoped at the next Agenda Meeting things would be in place and the Council would have the final reading in the Ordinance to get this thing movmg. He said he felt it was a necessary thing and it was important. He said he had some people telling him with regard to getting involved in businesses down in the Chrome area and he would like to see that moved in a hurry. He said he was glad to see the Makwinski action has been settled. He asked if the Mayor had any idea, what that cost the Borough legally. Mayor Failace said he didn't have those numbers off the top of his head. John Sudia suggested 40,50, $60,000.00. Craig Coughlin, Borough Attorney said his guess would be somewhere in the neighborhood of thirty. John Sudia said he happened to attend an Administrative Law Hearing two weeks ago, with regard to the Dennis Nagy situation and understood there had been a settlement proposed. Craig Coughlin, Borough Attorney said there was a tentative agreement, the documents are being put together. He said he felt it was best if the Council doesn't comment on it until they had a chance to (inaudible) Mayor Failace asked Mr. Sudia how he knew that information. John Sudia said he was at the Administrative Hearing as a possible witness. He asked how much money the Borough spend on the Stowell case. Craig Coughlin, Borough Attorney said $210,000.00. John Sudia said he had a figure of $204,849.00 spent and committed he asked if there would be any more for Stowell or was this it. Mayor Failace said there shouldn't be any more money spent but there may be still a couple of matters that are still under... John Sudia he felt the town was spending money unnecessarily. He said his feelings have been and still are that this $200,000.00 could have been much better spent, for lack of persecution, in our Police Department. 25. Mayor Failaee told Mr. Sudia there was no persecution to the Police Department but that was his opinion, it was certainly not his opinion, he shouldn't speak for the Council. Pastor Amos Dickerson said he is the Pastor of Peoples Ames Zion Church of 77 Union Street in Carteret. He offered his congratulations to the people who had been sworn in recently and said Happy New Year to all everyone. He said he knew the Council knew about the fire that took place on Union Street but his concern JANUARY 18, 2001 PUBLIC DISCUSSION JANUARY 18, 2001 PUBLIC DISCUSSION (Continued) was if there would be a timetable for the removal of the debris that is there and if so what was the timetable. Mayor Failace said the debris would be removed and he knew there was an investigation. Council member Rios said he knew and they are going to try to get it cleaned up. Councilmember Sohayda asked if there were other issues. Pastor Amos Dickerson asked it there was an investigation. Councilmember Quinones said yes, that is a part of it. Pastor Amos Dickerson said on Essex Street, it appears that there is a lot of debris that's been moved somebody has actually moved the debris to the curb. He said it has been there for at least three weeks and he felt the debris has to remove, it is an eye sore in the community. He said he would appreciate it very much if that could be (inaudible)... He said there are several other items that are incorrigible and not appeasing to the eye. Council member Reiman asked Craig Coughlin, Borough Attorney, if they could direct Borough personnel to clean it up and bill the owner of the property. He asked if the Borough had an Ordinance that allowed them to do that. Mayor Failace and Craig Coughlin, Borough Attorney both said yes we do. Pastor Amos Dickerson said he understood that the town was talking about street signs in the lower Carteret area and asked if there was timetable for that. Councilmember Sohayda said he thought Pastor Dickerson or someone else asked the Council last year. He said he addressed that issue and was waiting for the signs to come in. He said now that the ground as hard as it is, it is a little more difficult to do put signs in but assured Pastor Dickerson that in the spring, it would be a better time to get that done. Mayor Failace told Councilmember Sohayda he thought the signs were in or most of them have come in. He said they would address it as soon as possible. Unidentified Lady said her concern was the lower Roosevelt Avenue, they need some crossing guards on Pershing, Roosevelt and Edwin Streets because of the heavy traffic in that area. She said there are no stop signs, there's no traffic lights, there's no crossing guards, there's nothing; kids have to cross that road to go to school. 26. Councilmember Sohayda said at a previous meeting that was asked. He said he met with Captain Hojecki, who is in charge of the crossing guards and went over where the crossing guards were. He suggested that after the meeting, she could speak to Capt. Hojecki about her concerns and on which corner, because the Council did go over each area and they are the ones to assign it. He said he has brought up the concerns of the residents from a previous meeting and suggested she speak to him about her actual concerns. Unidentified Lady said you know that corner store, Soklers, we have kids that have to walk all the way down... Pat Tozzi said he wouldn't normally bring it up, but it is a historical item, at our Board of Health meeting a week ago, on reorganization, I withdrew my name as President of the Board of Health. He said he nominated the first female for President of the Board of Health, Yolanda Delgato, who served on the Board of Health for the past five years in good fashion. He said you name it this week, you were appointed, and felt it was a feather in our hat that we finally realized that we have a good qualified woman that could head the Board of Health. He asked what the status of the handicap accessible ramp at the Board of Health was; it had been approved by the Architects. He said everybody approved it, but there was still no ramp there. He said they still have problems with the handicapped, the Health Department can't give them mammograms, because they can't get in. He felt it was a shame that we have to punish these people, because our ramp is not available. Mayor Failace said you know you are right, Pat it was completed with Janet last year. Councilmember Santoro said the Council has asked about that, and thought it went back to Sam Gregorio... with the door, and Eric Betz, you know is aware of it. She said they put the specs together so that we can... (inaudible)... Mayor Failace assured Mr. Tozzi that he knew they sent the Engineer to the Board of Health meeting and they would move on that with them. 27. Pat Tozzi said for Councilmember Quinones' information, we have two senior groups in this town that utilize the Community Center, there is an afternoon group and evening group. He said he would appreciate in the future any documentation or any information is furnished to both of these groups. He said it seems even thought the evening group, seems to be the adopted person around here, he would appreciate it. He told Councilmember Fazekas that as far as the computers for the seniors, he had been preaching about this for the last six years. He said the town has a lot of computer illiterate seniors who are computer illiterate like Regis on television, he said he is illiterate too. He said he would appreciate it if you would set up some sort of program, try to set up classes and so forth anywhere. He said there are a lot of people who would like to get involved but they are ashamed to go to a same meeting with somebody who knows everything about the internet, and they don't know the difference between the telephone and a computer. Councilmember Fazekas said last year he took a tour of the building and checked the cords. He said he believed there were about four to six outlets he believed they had computers for in the new center that could be hooked up. He said it's just a matter of making sure the two systems, the Library systems, and the system that supports your JANUARY 18, 2001 PUBLIC DISCUSSION (Continued) JANUARY 18, 2001 PUBLIC DISCUSSION (Continued) activities are separate, once that is done, we can run programs and that's one of the things he said he wants to sit down with the Business Administrator about. He said it is a program he wants to try to get for this year for all Borough employees, it is actually a computer based training that you can run yourself. He said you could choose the program that you want for the seniors; you can do that with or without an instructor, there are different types of programs. He said it not only the Internet; there's Microsoft Word, Excel. Pat Tozzi said we just want to start from scratch, just send us some pre-kindergarten kids to get us help. He said last but not least, AARP as you know, is furnishing income tax help again for the seniors, the handicapped and people with low income, which would be starting on February 15th through April 14th. He said this has always taken place at the Community Center, where we are at now. He said he informed them, they put it in the newspaper that again it will be in the Community Center. He said he didn't know if the new Community Center would be open in the ten years or what. Councilmember Quinones said we are going to try to do that soon. Pat Tozzi said last year they helped with 158 returns. He said Carteret is the only community in Middlesex County that does PTR, the majority of PTR that's Property Tax Relief for seniors, disabled and Mobile Home owners. He said they had to give instructions on income tax at a meeting in Woodbridge, they only did one return, and we did 45 last year. This program has helped people save money on their taxes since 1997. Jim Mancuso, of Carteret said he wanted to say several things about Board of Education. He said the Mayor brought up the subject of $800,000.00. He said he was on the phone the last two days, with the Attorney General there is an $800,000 over-expenditure, which he was informed falls under a second-degree crime. He said he called Dr. Vita last week about this and he said he wasn't aware of it. He said he couldn't fathom that the Superintendent of Schools was not aware that they over-expend $800,000. He said the Superintendant couldn't explain it to him, but he would have someone get back to me. He said no sooner did he put the phone down, it rang, and it was the Business Administrator for the Board of Education. He said the first words out of his mouth were this was before I got here. He said all I'm asking is how the Board can spend $800,000 illegally and now you are trying to replace it. He said he checked to see if it could be paid with money form the 2000-2001 budget, which are eight tax points, by the way. He said if you go over their budget, there is nothing in there that states that they're paying an illegal amount of money that they spent. He said he couldn't believe we are talking about 10-$15,000.00. He said he checked with the board and no one can fathom spending over $800,000.00. He said he would get the information when it comes out for September, it was postponed twice, and it's going to come up again. He said he also called the State Board of Education on the last thing we got was the construction where someone got injured. He said the County was lied to by someone down at our Board of Education, He said the County said they were going to fine the town for this. He said there had to have been no fine, there had been no report received by the Board of Education. He asked who committed the lie to the Board, to the 28. State, to the County rather, there's been no action taken. He said there is litigation against the School and the City, which are the taxpayers but never get any information on this. He said no one seems to be aware where the $800,000 went but yet they are looking to pay it off which is nothing by law but a cover. He said he felt this Council, this Board and the Board that represents us at the Board of Education should find out why because a group as well as him self would go further with this. He said this is not something you are going to say we are going to fix he said he felt it is legally a crime, and somebody better be aware of it and do something about it. He told Councilmember Sohayda that he gave a great presentation but wanted to correct him on one thing, the County is doing Washington and Roosevelt A venue at no cost to us, this shouldn't cost us anything; they are not our streets. Mayor Failace said earlier you heard me tell Jack or ask Jack to get a report to the Counci I. 29. Tommy Lang, Colgan A venue said he wanted to wish everybody good luck. He said he felt it was a healthy battle that is going on up there and he hoped Carteret residents would get pretty well informed as to what's going on. He said it looks like a catfight sometimes, but nobody's vindictive or means anything, they are doing what they actually believe in and he respected that. He said he believed his name was mentioned to the Carteret Redevelopment Committee. He said he wanted to let everybody know he doesn't lie, steal or cheat he does the best he can with what he knows and if he doesn't know he asks. He said there is one thing he would like to ask it is to agree to disagree because he is not afraid to get up and say anything. He said the Mayor, Remy and Janet know, he speaks his mind and if he is wrong he will apologize. He said every time he gets up here something is done, whether it was the Borough Attorney making a call to the Turnpike, or asking, Buddy, he missed that meeting about the guardrails it was taken care of. He asked Councilmember Santoro, Parks & Recreation, to have the Parks Department take care of the garbage cans he was tired of seeing in the lake, when the lake gets frozen. He said he felt this sends a mixed signal to the youngsters who are doing it, that one day it is okay, they are out there ice skating within the next two days the garbage cans might still be up, but the ice is thinning. He said he would like to see the Parks & Recreation Department get some kind of concrete or some kind of designer. He said the garbage cans we put inside; where it is locked and we can't remove it we can only throw trash into it. He wished Couneilmember Reiman good luck. He told Council member Sohayda he was glad to see him coming out of his shell because he really didn't give a lot of reports. He said he knows it is tough, but he felt Councilmember Sohayda could get up there and speak because he likes to hear everything that he has to say. He said as far as the plowing goes, during the December 29th storm, on a scale of one to ten, he felt they did a ten because they actually had seen them come down the block more than once and they were actually getting the snow. He said just a follow up, I know it was a holiday that Monday, it went from a ten in my area and then it went to a one, so it averages out to a five. He said he was just disappointed when the kids went back to school on Monday and school was delayed or cancelled. He said he forgot which one was which, Monday or Tuesday, he thought it was a delayed opening on Monday, delayed JANUARY 18, 2001 PUBLIC DISCUSSION (Continued) JANUARY 18, 2001 PUBLIC DISCUSSION (Continued) opening on Tuesday, it was absolutely ridiculous. He said he understand it is for the children's safety. He said he felt the Council should bring it up about people who live on corners, to actually try to make a path so that kids can cross the street, from corner to corner, which is not really done. He said the delayed opening really bothered him on Tuesday and he didn't understand why there was a delayed opening on that Tuesday. Unidentified person said the teachers couldn't get to school. Tom Lang said he felt the teachers should get up a little bit earlier, because he had to get up earlier to get to work to get to his job for 7 o'clock. He said he felt if you know it is going to snow, you get up a half-hour earlier. He said if it is for the kid's safety, by all means keep the delayed opening, if it is for the teachers to get their buts out of bed to get to school, get up earlier he felt they were making plenty of dough; they ought to get up earlier. He said they're doing their job; they deserve their money, get up earlier. He said he didn't understand why Council member Fazekas missed so many meetings last year. He said without badgering Counci1member Fazekas, if it was personal and private he said he would respect that, if it is work related, then he understood that. Councilmember Fazekas said he would try to improve that, unfortunately, last year, toward the end of the year with the merger of his company and what's happening now, it's very difficult. He said he would try to inform everybody when he wouldn't be here and try to keep up with the activities that are necessary. He said such as being Commissioner of the Fire Department and working with the technology, unfortunately, work does play an important part of his family life. He said at times, with 24 by 7 coverage, he is not fully able to attend all the times because he is working Saturday and Sundays or working 3 to 12 o'clock in the morning. He said he would try to make everybody aware and try to give everybody information that is a consideration, this being his last year. He said that was a consideration that he had throughout his two terms in office. He said the Mayor and Council has been very, very sympathetic with him and has worked with him on that. He said he understood and would try to improve on it. He thanked Mr. Lang for bringing it to his attention. Tom Lang said he didn't mean to embarrass Councilmember Fazekas that was not his intention. He said back to the crossing guards, on the delayed opening, he had to stay home from work to get his daughter to school. He said upon walking up to the school, whoever's in charge of crossing guard, he didn't like pointing out one or two, but felt you can't cross kids from sitting in cars. He said he politely went over, knocked on the window, informed the person that he felt you can not cross a child from the windshield of your car. He said the next time he sees it; he is going to report it. He said he gave the crossing guard his name and she politely said okay. He said he felt some one should stay on top of the crossing guards. He said he understood he gets cold, but they get paid to do a job but couldn't understand how you could do it sitting in the car. 30. Council member Santoro told Mr. Lang that he called her on that and she did relay the information to Capt. Hojecki. Councilmember Quinones said she felt for the most part the crossing guards do not do that and if they do sit in their cars, they're pretty aware of the children coming by. Tom Lang said he agreed and it might have been once that the person did it but felt it was the one time that the person did it when he had to walk his kid to school. He said they were there and he pointed it out. He said about two or three weeks ago at school, one of the classes was held after school hours, several children missed the bus, several walkers were late getting home. He said he looked for his children ten to three the normal time, they didn't appear and he went to the school. He said he was told the teacher delayed the whole class from leaving at dismal time; several children missed the bus. He said the parents were not notified by the company that the children left the school late and he felt it was not tolerable. He said he didn't think that teacher had the right or the authority unless it was for the safety of the children and he asked whatever Council member is on the Board of Education, the please find some information out for him. He said the school did handle it, but they only called the parents of the students who missed the bus, they didn't call everybody in that class, the walkers especially, granted it was ten minutes. He said they should not have kept any of the kids after school. He felt you could do whatever you have to do the next day, but none of the kids should miss the bus, because the teacher held them after school. He said he called the school, they said they would take care of it. He said he believed it was whatever happened he didn't know, he didn't follow up on it, yet, and there hasn't been a Board of Education meeting yet. He said he didn't know when the next Board of Education meeting would be held and asked if anyone has any idea when it would be. Councilmember Santoro said it is usually a Wednesday night, towards the end of the month, next week. Tom Lang said he would be bringing that up and that that teacher should be slightly disciplined maybe it was a mistake on her part and felt it should at least be addressed. He said that should not happen and asked if this was policy, he said he didn't know what the right word was, but is that an okay thing to do, to keep a whole entire class after school for whatever reason it might have been. He said it might have been all of them cutting up or just some of them cutting up, whatever it was, all the kids were detained ten minutes and they all missed the bus several at least five of the kids missed the bus. Councilmember Santoro told Mr. Lang he would have to ask the principal and the Board of Education, they are the ones who set the policy. 31. Tom Lang said he just wanted to know who to go to with this problem and thanked Councilmember Santoro. Alfred Miles said he lives on a corner and he is not going to shovel snow, that's what the snow plows are for. He said the plow piles the snow on the corner and asked how anyone could shovel that. He said the corner by St. Joe's school; you can't see anything from any direction. He said if you did cross there, you would have to worry about the next corner. He said he felt at all the corners you could not see while pulling out. Mayor Failace said they shouldn't be parked up to the corner. Alfred Miles said the streets have yellow lines but these yellow lines don't mean anything to some people. Mayor Failace said now that we know especially by your home. Alfred Miles said there is money in the school budget and he would not shovel the corner. Vincent Basilici said do you know that years ago, when the Fire Inspector came to the building they only charged $25.00 to $30.00 dollars but now we are paying $408.00 dollars. He said they told him that they have to hire for the State Board Inspectors and a part of that excess money would go back to the Borough for quality equipment only, not for parts. Mayor Failace asked Mr. Basilici if that was the Fire Inspector of the VFW. Vincent Basilici said no, for all the buildings in the Borough every building by size; they have pay for the size of the building. He said no one knows how much money is coming back to the Borough. He said this was what he was trying to find out, because we are paying more money than some other people with larger buildings are. He said he couldn't see that, when he went to see Greenberg at one time and asked him to see the books, he said I wasn't allowed to see the books. Councilmember Fazekas told Mr. Basilici he would check into that. Vincent Basilici said every building is assessed for a certain amount of money for the size of the building and we receive money from the State. Nicholas Goldsack, Business Administrator said Chico we receive quarterly statements from the State based on the inspections. He said of you would like to come in the Finance Office we will show you the reports. Brian O'Connor, Fire Superintendent said it is called Life Hazzard, we don't set the fee it is set by the State we have no control over what the fees are, but we do receive 70% back. Vincent Basilici said but we don't get a report of how much money the town gets. 32. Mayor Failace said he was sure we could give Mr. Basilici that information. He told Mr. Basilici to see Nicholas Goldsack, Business Administrator tomorrow, he said he would tell you how much money the town receives. Bill Saudeak of Polk Avenue, said he has been a taxpayer in this town for forty-four years. He said as far as the snow removal, which Mr. Sohayda took a ten on, in his opinion he would give him a two. He said after the third snow removal when he camc home from a senior meeting he found a four-foot pile of snow in his driveway at ten o'clock in the evening. He said he couldn't shovel this himself he had to do his sidewalk, after the third time by himself. He said he found that they came so close to the driveway it pushed all the snow back into the sidewalk, and he thanked Mr. Sohayda and his department but Mr. Sohayda would not be getting his vote next time. Mayor Failace said in somewhat defense of Mr. Sohayda, we really tried and he knew the guys doing snow removal really tried to do the job right. He said he had to re-shovel his own driveway also. He said when it did get close to the curb it did get on his sidewalk but he didn't think they did it purposely. He said God willing we will do it better during the next storm.
