RESOLUTION NO. 21-9853
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA EXPRESSING
ITS DESIRE FOR IMMEDIATE TRANSFER OF
CONTROL FROM MIAMI-DADE COUNTY TO THE
CITY OF OPA-LOCKA UPON CREATION OF THE
PINE TREE LAKE MULTIPURPOSE MAINTENANCE
SPECIAL TAXING DISTRICT PURSUANT TO
SECTION 18-3.1 OF THE CODE OF MIAMI-DADE
COUNTY; PROVIDING FOR TRANSMITTAL;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the owners of the property within the geographic boundaries of
the Pine Tree Lake community within the City of Opa-Locka (the "City") as legally
described in Exhibit "A" (the "Property") have petitioned the City to establish a
special taxing district for the purpose of providing multipurpose maintenance
services; and
WHEREAS, the City has voted to support the creation of a dormant multipurpose
special taxing district for the Property pursuant to Resolution No. 21-9853; and
WHEREAS, Miami -Dade County (the "County") adopted section 18-3.1, Miami -
Dade County Code, which allows the County and a municipality, by joint resolutions, to
designate the governing body of such municipality as the governing body of a new
special taxing district created wholly within the boundaries of such municipality, subject
to majority vote of the qualified electors of the special taxing district when applicable;
and
WHEREAS, the proposed dormant multipurpose special taxing district is located
entirely within the City; and
WHEREAS, the City hereby expresses its support of the establishment of the Pine
Tree Lake Multipurpose Maintenance Special Taxing District and hereby requests
immediate transfer of control and operation of the district upon its creation by the
County; and
WHEREAS, the City hereby agrees that any costs to establish the district shall be
paid to the County by the City; and
WHEREAS, the City will be reimbursed from the first year's special assessments
collected from the residents of the Pine Tree Lake Multipurpose Maintenance Special
Taxing District; and

WHEREAS, the next steps in the process are for the Board of County
Commissioners to establish the Pine Tree Lake Multipurpose Maintenance Special Taxing
District, adopt a resolution authorizing the transfer of the district to the City, and
execution of an interlocal agreement between the City and the County relating to the
transfer of the district.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS:
Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Resolution upon
adoption thereof.
Section 2. The City Commission of the City of Opa-Locka hereby expresses its
desire for Miami -Dade County to create and immediately transfer control of the Pine Tree
Lake Multipurpose Maintenance Special Taxing District to the City of Opa-Locka upon
its establishment in accordance with Section 18-3.1 of the Miami -Dade County Code.
Section 3. The City Clerk is hereby directed to send a certified copy of this
Resolution to the Miami -Dade County Board of County Commissioners.
Section 4. This resolution shall become effective upon the date of its passage and
adoption herein.

Staff Summary:
A Resolution of the City Commission of the City of Opa-locka, Florida, requesting approval for the City Manager
to enter into an Interlocal Agreement with Miami -Dade County, Special Assessment District Division to give
permission to create a special taxing district to maintain Pine Tree Lake. This is a private body of water that
runs from NW 17th Avenue to NW 19th Avenue between Opa-locka Boulevard and NW 135th Street in Opa-locka
that is currently not being maintained. Its current state poses a health and safety concern to the residents that
reside around the lake. If approved, the proceeds from the assessed taxes will be used to fund the maintenance
of this lake.
Financial Impact
If approved and implemented in FY 21, the City will first receive reimbursement for these services from an
assessment on the FY 22 property tax bill.
Proposed Action:
Staff recommends approval of this resolution.
