The caller, John Heck, requested to speak to an officer in reference to a male causing a disturbance at the event. Upon arrival I made contact with Andrew Sheets in the parking lot. Upon contact with Sheets he informed officers that he was a member of the press and he was wearing a body camera. Upon arriving on scene, he was in the process of leaving the event. Sheets was claiming to have been illegally kicked out of the public event, which was being held at the Charlotte High School football stadium by an organization called Drug Free Charlotte County. Mr Sheets was carrying a sign that contained names of past Charlotte County Sheriff Deputies who had allegations against them in the past. While on the premises, Mr. Sheets was showing the sign to both vendors and patrons and asking them for their opinions on the subjects written on the sign. Sheets claims he was assaulted by John Heck while he was being asked to leave the event. (Sheets did not mention this to officers at the time, but later called to report it.) Sheets also claims he had the assault on video. After reportedly offending several people at the event, the caller, John Heck, told Mr. Sheets that he had to leave the event. Mr. Sheets was upset about being asked to leave and stated that he was illegally kicked out of a public event. After speaking with Mr. Sheets, officers made contact with the caller, John Heck. Mr. Heck informed officers that he is an off-duty Charlotte County Sheriff Deputy and that he was working the Drug Free Charlotte County event. Mr. Heck told officers that Sheets was inside of the event harassing attendees and vendors and making them feel uncomfortable. Mr. Heck also advised that the event was a private event hosted by Drug Free Charlotte County on contract with Charlotte High School for the space. Several other vendors at the event expressed concern with Sheets' actions and claimed it made them feel uncomfortable. Mr. Sheets left the property willingly and no further police action was taken at this time. Waldrop and I were dispatched to 1250 Cooper St. (Charlotte High School), in reference to a report of a disturbance. The caller, John Heck, requested to speak to an officer in reference to a male causing a disturbance. "Drug Free Punta Gorda" was hosting a 5k event at this location. According to John W. Heck, the race manager, this event was open to the public and publicly advertised, but privately hosted by the Drug Free Punta Gorda organization. Prior to hosting the event, the organization followed the proper procedures and attained a special event permit from the City of Punta Gorda, to allow them to utilize the Charlotte High School facilities during their event. A copy of the event permit will be attached to this report. Prior to our arrival, officers were informed that a male, who was later identified as Andrew B. Sheets, had entered the event and had begun causing a disturbance. Upon arriving to Charlotte High School, officers made contact with Sheets in the parking lot. Sheets was displaying a sign with names of previously employed Charlotte County Deputies who he claimed had been discharged for drug usage and not held criminally accountable. No obscene content was observed on the sign. Upon making contact with Sheets, he expressed to officers that he was illegally kicked out of a publically announced event after expressing his first amendment freedom of speech and asking attendees if they were aware of deputies who were not criminally charged after using drugs. At this time, upon speaking to Sheets on scene, he did not report that a battery had occurred. Sheets contacted officers later during the day via telephone to report that Heck had battered him. He stated that he was so angry at the time that the incident occurred that he forgot to mention it to officers while we were on scene. Sheets informed officers that he would like to pursue charges against Heck for Battery. After speaking with Sheets, officers made contact with John Heck, an off-duty Charlotte County Deputy, who advised that he was the race manager for the Drug Free Punta Gorda 5k event. He informed officers that several people had approached him and advised him that Sheets was on location, disturbing vendors and attendees. He was informed that several attendees asked Sheets to walk away after expressing to him that they had no interest in hearing his viewpoints, at which time, he remained in their immediate vicinity and continued to express his opinions. Several vendors complained that some of the topics that Sheets had discussed were not appropriate for the young children and families attending the event. Heck reported that after receiving the complaints, he approached Sheets, acting in his duty as the event manager, and politely asked him to step outside of the event to wait for the arrival of police. Again, Heck asked Sheets to walk outside two more times to wait for the arrival of police. After being asked to step out several times, Sheets began yelling loudly to a crowd of nearby event attendees, "These are all the people that did drugs at the Charlotte County Sheriff's Office and were never charged." At this time, Heck placed his right hand on Sheets' elbow, in an effort to redirect him away from the other event attendees that he was disrupting. Immediately after redirecting sheets toward the event exit, Heck removed his hand and Sheets proceeded to walk towards the exit on his own while Heck followed. As he was walking Sheets continued to dispute that this was a public event and that Heck had no right to kick him out. Heck reaffirmed that Sheets is not permitted to express his opinions inside of the event, but has every right to do so in the parking lot. Heck stated that he would like to pursue charges against Sheets for Breach of Peace. On Sunday, February 24, 2019, Sheets arrived in the lobby of the Punta Gorda Police Department and made contact with Lt. Lipker. He provided Lt. Lipker with a DVD, which Sheets advised was the unedited version of the incident in which he said he was "assaulted." The DVD, which A. Sheets signed, was submitted into evidence via property receipt. Upon viewing the content on the DVD, I observed that it had been edited and did not contain raw footage from Sheets' camera as requested. On February 26, 2019, I contacted Sheets via telephone and requested that he provide a voluntary sworn recorded statement. The statement was conducted at the Punta Gorda Police Department and will be submitted to records to be attached to this report. Sheets did not have any new information to add to this report. While taking the sworn statement from Sheets, I again requested him to provide a raw, unedited version of his camera footage, at which time he stated that the copy he provided was the unedited version. On March 16, 2019, I made contact with two witnesses who were at the Drug Free Punta Gorda 5k event on the date of the incident. I spoke to Kristi Lynn Pirches and Kathleen Skavroneck, who were both vendors at the event representing Deep Creek Elementary. Both Pirches and Skavroneck reported that Sheets entered the event with no apparent intention on participating. They stated that he had a sign with him and was harassing event attendees, even after being requested by several people to walk away. Perches and Skavroneck advised that what was most concerning was the fact that he was discussing topics such as date rape, which they stated was inappropriate for the children that were present. I asked Perches and Skavroneck if they observed any physical altercation occur at the event and both advised that they did not. Both Pirches and Skavroneck responded to the Punta Gorda Police Department and provided voluntary sworn recorded witness statements on March 16th, 2019. Both statements will be submitted to records to be attached to this report. After observing the video footage, which was supplied by Sheets, Heck is observed pointing toward the event exit numerous times while requesting Sheets to wait for the arrival of officers in the parking lot. After refusing several times, Sheets begins to raise his voice at which time, Heck moves his right hand toward Sheets, seemingly in an attempt to redirect him toward the exit. Due to the video being from Sheet' first person perspective, the camera does not capture Heck's hand touching Sheets. After Heck redirects Sheets toward the exit, Sheets asks, 'Did you touch me, sir?" at which time, Heck responds, "Yes I did." After reviewing the video it cannot be determined if Heck actually and intentionally touched or struck Sheets against his will. In addition, Heck did not intentionally cause any bodily harm to Sheets. At this time, this report will be forwarded to the State Attorney's Office for further review to determine if the offense of Battery was committed on Sheets or if Sheets committed the offense of Breach of Peace.
