The Regular Meeting af the Mayar and Cauncil af the Barough af
Carteret was called to. arder by Mayar James A. Failace
approximately 7:30 P.M. an Thursday, February 15, 2001
Municipal Caurt/Palice Facility, 230 Raasevelt Avenue, Carteret,
New Jersey.
Upan individual roll call, the fallawing were nated present:
Cauncilmember Jack Fazekas

Ranald Rias
Janet Santaro
Buddy Sahayda
Also. nated present were Business Administratar Nichalas Galdsack
and Barough Attarney Rabert Bergen.
The meeting was apened with a mament af Silent Prayer and The
Pledge af Allegiance led by Mayar James A. Failace.
The Clerk stated that an February 9, 2001, in full campliance with
the Open Public Meeting Act, a natice af tanight's meeting was
sent to. The Harne News Tribune, The Star Ledger and pasted an
the bulletin baard.
Middle Schaal Students - Mayor Failace said he was gaing to. have
Cauncilman Fazekas and Cauncilwaman Santaro, as head af the
Baard af Educatian, give aut the Certificates af Merit.
Cauncilmember Santaro stated the Certificates af Merits were
given a few weeks ago. when Cangressman Menendez came to. the
Middle Schaal to. hanar the students for their tenific citizenship and
fundraising far ane af aur awn Christine Halawatch Redhing. She
said these students did an autstanding jab and this is samething that
Carteret can be very proud af. She then handed Qut the certificates.
Cauncilmember Santaro stated again this is a fine example af aur
yaung citizens af Carteret and we appreciate everything they did.
Mayar James A. Failace said thank yau to. the girls. He said it is
nice to. see yaung peaple get invalved and work hard to. do.
samething. Again, he said thank yau.
Firefighter - Mayar James A. Failace said he is gaing to. have
Cauncilman Rias, as head af Fire, give aut the Certificate af Merit.
He said Jaseph Lambardi was chasen Firefighter af the Year, he
said this is a great hanar.

barn a citizen af the United States af America. It is very interesting
learning abaut the histary af aur cauntry. Being a citizen allaws me
to. do. many things. When 1 became eighteen 1 will be able to. vate,
and that is very impartant because 1 will have a part in deciding the
future af aur cauntry. Every day 1 try to. be a gaad citizen. 1 wark
hard in schaal to. get gaad grades. It is impartant to. abey laws and
rules, whether they came from mam and dad, at harne, at schaal,
from any team sparts that 1 play, the Cub Scauts, ar the state and
gavernment. 1 enjay belanging to. the Cub Scauts. On Memarial
Day, we put up crasses and flags to. hanar the men and wamen who.
served aur cauntry. We also. marched in the parade. We also. had
scauting far faad days where we dropped aff faad and picked them
up in a week filled with faad far paar and hungry peaple. 1 also. try
to. help clean up the streets around my neighborhaad. 1 hape that
the things 1 do. will help me to. grow and be respansible and respect
athers." He then handed aut the certificates. He said he wauld also.
like to. give two. certificates to. the two. peaple who. helped him and
were very instrumental in getting this dane, and were an his back to.
make sure things were dane and that is Tany Aleksandrich and
Elizabeth.. .(inaudible)... He then handed aut the certificates.
Unidentified wamen said an behalf af the Cub Scauts they wauld
like to. give a Certificate af appreciatian to. the Mayar and all the
members af the Barough who. taak the time aut to. work with the
bays. She said the bays had a ball; they learned a lat, and from
what she has heard from the parents the bays have nat stapped
talking abaut it yet.
Mayar James A. Failace said befare he asked far a five-minute
recess he wauld like to. tell a quick stary. "Yau knaw 1 am a big
Giant fan and ane af the girls in the Municipal affice is a big
Minnesata Viking fan. Sa, when the Giants beat the heck aut af
Minnesata 1 sent samething from the flarist. 1 sent her a little bear
with a Giant sweater an it and same Giant stuff and 1 sent a little
card that said deepest sympathy far yaur lass. Sa, when the Giants
lass the Super Bawel pretty handedly 1 came in the affice the next
day and my affice was laaded with Baltimare Raven stuff all aver
the place. Sa, while William and 1 were sitting in the Mayar's
Office the Barough Clerk, Chris brought in a Baltimare Raven's
faatball far me. 1 then asked William to. call the Municipal
emplayee and he called her up and said to. her pack yaur bags yaur
fired. When we had the lunchean Chris came up to. me and said did
yau really fire her. 1 said no. Chris we where anly kidding. It was
just a jake. Again, thank yau, thank yau bays, and leaders for a
wanderful day, "

Cauncilmember Reiman stated with all due respect to. the Mayor, he
understands his pasitian and he respectfully disagrees. He said he
feels it is nat taa much to. ask that a new emplayee be required to.
live in tawn far five years. He said if a qualified individual daes nat
live in tawn there is nathing stapping the Barough Cauncil from
laaking autside the barders af this tawn. He said he feels first
preference shauld be given to. residents and require that they Ii ve in
tawn far at least fi ve years befare they cauld mave aut. He said he
daes nat think there wauld be a mass exadus af Barough emplayees
and he respectfully disagrees with the Mayar.
Cauncilmember Santora said previausly there was a life lang
residency requirement. Even thaugh it had been adjusted to., ane
year she feels that five years is a fair residency requirement to. ask
the Barough' s emplayees to. respect and the cansensus did came
back to. the Cauncil that way. She said the ather thing she wanted
to. say was in the veta indentured servants are mentianed, She
stated the emplayees af the Carteret Barough are probably same af
the Barough' s finest aspects af the tawn. She said she cherishes
they work far the tawn, she respects that they're residents af the
tawn and grateful they live in the tawn.
Mayar Failace asked far clarificatian an the ardinance; if in fact the
ordinance was changed at the end af last year to. say ane year, are
Barough emplayees who. are working ane year in the Barough naw
required to. wait five years. He asked if they were under the
ardinance that was passed last year, which stated they anly had to.
wait ane year.
Barough Attarney Bergen said the last time this came up there was
a discussian cancerning the brief change. He said the intentian is
always unless ane ardinance clearly supercedes anather to. try and
always interpret bath ardinances that exist, unless it is clearly the
attempt af the Cauncil to. supersede ar repeal the priar ardinance. It
was in his understanding that is what the Co. unci I wanted to. do. at
that time. He said in his apinian this ardinance freezes, unless
sameane has gained an invested interest during that periad af time
in which there was a ane-year residency requirement. Everyane
naw is required to. remain in the tawn far a peri ad af five years.
There may be same situatians that sameane maved aut. It is very
difficult against the Barough to. abtain a vested interest from
Municipal emplayees but there cauld be an argument made if
sameane has maved aut. He said if no. ane has maved aut then in
his apinian everyane wauld have to. remain five years. The Cauncil
cauld clarify that and make it anly apply to. peaple hired after this
date if they wish.
Cauncilmember Quinanes said she wauld like to. have anather paint
clarified. She said Cauncilman Reiman stated that natwithstanding

persan. He said if in fact this whale Cauncil, Attarney, and the
Public Defender chase to. take family benefits ar any Cauncil at any

The fact that these peaple may nat take it naw, but each and
everyane ane af us wiIl nat be here farever. The fact that the
benefits may nat be taken naw daes nat mean anything; althaugh he
thinks the thirty thausand... the Barough is spending naw can be
much better spent in this Barough especially with a tax increase
cammg up.
Cauncilmember Santaro stated again she wauldjust like to. reiterate
there can anly be savings when there is a cast. It will nat cast ane
hundred thausand dallars sa there can nat be a charge ar savings af
$84.00 ar $12.00 far every taxpayer. The anly way this can happen
wauld be if every persan taak the benefits and that has nat been the
case far years.
Mayar Failace stated when yau do. what yau do. as Mayar and
Cauncil yau do. nat anly laak at naw, yau laak at the future, and the
years that yau can save maney. He said yau do. nat laak at 2001,
because if in fact yau do. yau are shirking yaur duties as Cauncil if

Cauncilmember Santaro stated then the Cauncil shauld have laaked
years ago. when members taak the benefits five and six years in a
row, and Barough Attarney taak the benefits. She stated to. the

this ardinance regardless af what this Cauncil says he has no.
Mayor's Aide. He said he has no. ane, because whatever their
intentians might be, as Cauncilmember Reiman brought up at the
last meeting that he wanted to. put this an as a Mayar's Aide. He
said he has no. Mayar's Aide.
Cauncilmember Santaro asked Mayar Failace who. did he appaint
to. the pasitian in January.
Mayar Failace said there is no. Mayor's Aide ardinance an the
baaks. There was a salary ardinance that was dane years ago. under
the farmer mayar, but there was no. ardinance far a Mayar's Aide.
He was always under this impressian, as was everyane else an this
Cauncil, that there was a Mayar's Aide, but there was nat. He

Mr. Rabert Hedesh said there is certainly an ardinance, it was
established under Dr. Fenick.
Mayar Failace stated it cauld nat be faund.
Mr. Rabert Hedesh said he daes nat knaw if anybady remembers
abaut (inaudible)... at ane paint in time he did a cadificatian abaut
1984 and the campany never campleted the cadificatian they went
bankrupt. It was the original brown baak if Barough Clerk
Kathleen Barney remembers. What had happened was the Danbaro
Attarney, he said he wauld nat say his name, wauld nat go. through
that baak. He said he himself went through that cadificatian, the
campany was given a list af titles that were referred to. in the
cadificatian, and there was no. ardinance far them. He said far
example the Deputy Mayar but there was no. ardinance far Deputy

#01-54, an applicatian far Regianal Efficiency Aid (REAP) and
hapefully the Baraugh will be eligible far same sart af grant from

(Killam) and Dan Narbut (T&M) the new Barough Engineer. He
said the transitian is maving alang between Mr. Beninata and Mr.
Narbut and by next weeks Agenda Meeting the Cauncil shauld
have a letter suggesting what projects T&M will be handling and
what projects Killam will be handling until campIetian. He said he
just wanted to. assure the residents and the peaple in the audience

Hanisan Avenue statian, which had to. get service this week. He
said Streets and Raads has still been callecting recyclables, which is
pretty much a new thing cansidering there has been same snaw the
last few weeks. The street sweeper is back up and running again

Department has been camputerizing their weight tickets and

has been a taxpayer for fifty-five years, and she feels she has every
right to. came and express her apinian. She said an the health
benefits far the Cauncil she is sarry but she daes nat agree with the
Cauncil. She said she gives the Mayar and Cauncilmember
Quinanes a ¡at af credit, but the rest af the Cauncil farget it. She
said they are all yaung, they are warking, they have haspitalizatian
where they wark, and they cauld nat say they do. nat. She said
their spauses probably work, and they are cavered. She said their
families are cavered. She said she left a critically sick husband at
the haspital tanight to. came and express her apinian. She wants to.
let the Cauncil knaw what she is paying for haspitalizatian a year,
and if the Cauncil daes nat believe her they knaw her address, they
can came to. her hause and she will shaw them her bills. She said
her haspitalizatian carnes to. $4252.32 a year, and that does nat

residency if it included the Palice, Fire, and Barough Emplayees.
Mayar Failace said the Palice and Fire have to. live in the Barough

Cauncilmember Santaro said there was never a requirement far as

Mr. Tazzi said it seems there is discriminatian. He said the Cauncil
is requiring the Barough emplayees to. live in tawn far five years
and the Cauncil is getting everybady else from ather areas who. get
ajab here, take their pay and go. aut af the cammunity and spend it.
He said that is pretty gaad.
Cauncilmember Santaro recammended Mr. Tazzi to. go. to. the next
Baard af Educatian Meeting and ask them abaut a residency
requirement.
Mr. Tazzi said he felt that since she was president af the Schaal
Baard he cauld get an answer from her.

Jim Stane said he has lived in Carteret approximately farty-five
years. He said he has raised his children in this Barough and went
to. schaal with same af the members af the Cauncil. He said it
really upsets him with the medical benefits. He said the reasan it
upsets him, and he has to. plead ignarance, but he did nat knaw the
Cauncil gat medical benefits. He said this was ane af the best-kept
secrets in tawn. He said his friends, the peaple he talks to. do. nat
knaw they get benefits, and that is really strange. He said he wauld
like to. see same way to. put this an the ballat in Navember and let

Barough Attarney Bergen said it carnes up several times and the
Cauncil may ultimately have respansibility with the Schaal Baard
Budget to. deaI with it. He said he cauld anly give his advice that
there is no. legal requirement against it but there may be times when
the Co. unci I has to. fulfill legal respansibility with regards to. their
duties af averseeing the Schaal Baard Budget. He said that is

he realizes the budget is taugh. There is a $400,000.00 increase in
medical expenses, a $179,000.00 increase to. the MCUA plus the
aver usage last year has to. be paid, the under budgeting in the

budget is difficult. The Cauncil is in a difficult time here, no. daubt
abaut it, but that is why $100,000.00 and that $30,000.00 in
benefits and these ather things absalutely mean same thing. He said
whether it was given back to. the peaple in tax reductian or used far
the things that this tawn needs. Mr. Tazzi said it was up to.

appropriatian with the ane-cent that was put aside in Navember.

Jim Stane asked the Mayar if anybady meet with the Turnpike. He
said he sat Tuesday marning an the rocking bridge far a half-haur.
He said he thaught it might fall dawn while he was sitting there.
Cauncilmember Santaro said the Cauncil has a tentative date set up
and that was pastpaned sa mare peaple cauld attend. She said sa
the Cauncil is trying to. get a later time. She said the Cauncil is in
cantact with the Turnpike and will keep in cantact until a time is
set.
Thamas Lang said he missed the last meeting and he has nat read
anything in the paper abaut the Redevelapment Cammissianers and
he wauld like to. knaw if names have been put aut.
Mayar Failace stated that Mr. Lang was an the Redevelapment
Agency. He said no. ane has called and no. ane has said anything
and there was nathing in the paper.
Cauncilmember Quinanes said Mr. Lang is an the Redevelapment
Agency for two. years instead af three.
Mr. Lang said that was fine he just wanted to. knaw because no.
phane calls had been made, and he had no. idea af what was gaing
an,
Cauncilmember Reiman said ane af the appaintments was m
questian sa he did nat think the Barough Clerk had natified
everyane just yet. He said he understands the Barough Attarney is
still reviewing the appaintment.
Mayar Failace said there was same questians an whether peaple
cauld be an the Redevelapment Agency if they were afficials af the
Barough etc., nat Mr. Lang but athers. He said same af thase
questians were answered. He said there may be ane hanging and
that is nat up to. the Barough Attarney it is up to. anather attarney.
Mr. Lang said the Cauncij wauld never have to. warry abaut him
being an afficial af this Barough.
Mayar Failace said well he is naw.
Mr. Lang said yes but he is nat a paid afficiaJ. He said he
sympathize with everyane ane af the Mayor and Cauncil and he
knaws they will do. what they feel is right in their hearts no. matter
what, and he has to. respect that. He said he has ane questian abaut
the street lighting up and dawn Carteret A venue. He wanted to.
knaw who. wauld be respansible for repairing ar reinstalling.
Cauncilmember Sahayda said he had a problem with that in April
af this past year. He said he had the Palice Department call Public
Service and he gat a real quick respanse an it as appase to. calling
himself ar having sameane else call as a safety
