RESOLUTION NO.2018-67
RESOLUTION GRANTING CONDITIONAL USE PERMIT APPROVAL
TO BOB AND KIM A. GRIFFIN FOR ACCESSORY STRUCTURES
IN EXCESS OF 5,000 SQUARE FEET AT 2820 COUNTY ROAD 24
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, Bob and Kim A. Griffin (the "Owners") owns property located at 2820
County Road 24 (the "Property"), which is legally described in Exhibit A, attached hereto; and
WHEREAS, Section 825.19 of the City Code states that the City may grant a conditional use
permit to allow accessory buildings in excess of 5,000 square feet in aggregate footprint. The
owners have requested approval of a conditional use permit for accessory structures with an
aggregate footprint not to exceed 6,240 square feet; and
WHEREAS, the Planning Commission held a public hearing and reviewed the requested
conditional use permit on September 11, 2018, heard testimony from the Owners, City staff, and
interested parties, and recommended approval subject to certain conditions; and
WHEREAS, the City Council reviewed the request at the October 2, 2018 meeting,
reviewed the testimony, and recommendation of the Planning Commission; and
WHEREAS, based on the written and oral record before the Planning Commission and
City Council on the above dates as well as all additional testimony submitted to the City, the City
Council has made the following findings:
1) The proposed accessory structures are consistent with the specific requirements for the
conditional use as described in Section 825.19 and 826.98 of the City Code, subject to
the conditions noted in this resolution.
2) The proposed uses are consistent with the general criteria described for conditional
uses in Section 825.39 of the City Code.
NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota
hereby approves the conditional use permit for Bob and Kim A. Griffin, subject to the following
terms and conditions:
1) Accessory structures on the Property shall be limited to the following, as displayed on the
plans received by the City on August 10, 2018, and others explicitly permitted by relevant
code requirements:
a. 4,800 square foot barn
b. 1,440 square foot storage building

Legal Description of the Property
The East 500 feet of that part of the Southeast Quarter of the Southwest Quarter lying North of the
South 275 feet thereof, Section 16, Township 118 North, Range 23 West of the 5th Principal
Meridian.
ALSO
That part of the West 400 feet of the Southwest Quarter of the Southeast Quarter of Section 16,
Township 118 North, Range 23 West of the 5th Principal Meridian lying North of the South 25
acres thereof.
ALSO
The South 275 feet of the East 500 feet of the Southeast Quarter of the Southwest Quarter of
Section 16, Township 118 North, Range 23 West of the 5th Principal Meridian; AND that part of
the Northeast Quarter of the Northwest Quarter of Section 21, Township 118 North, Range 23
West of the 5th Principal Meridian, lying North of County Road No. 24 and East of the southerly
extension of the West line of said East 500 feet.
ALSO
That part of the South 25 acres of the Southwest Quarter of the Southeast Quarter of Section 16,
Township 118 North, Range 23 West of the 5th Principal Meridian which lies North of the South
483 feet of said South 25 acres and West of the East 851.33 feet of said South 25 acres.
ALSO
That part of the Southwest Quarter of the Southeast Quarter of said Section 16 which lies north of
the South 25 acres of said Southwest Quarter of the Southeast Quarter, south of the North 15 acres
of said Southwest Quarter of the Southeast Quarter, East of the West 400.00 feet of said
Southwest Quarter of the Southeast Quarter, and west of the East 851.33 feet of said Southwest
Quarter of the Southeast Quarter.
