A RESOLUTION APPROVING A RIGHT-OF-WAY VACATION ADJACENT TO THE RIO
COLORADO CAFE AND BAR AT 2 SOUTH 100 WEST
WHEREAS, the property owner of the Rio Colorado Cafe and Bar, located at 2 South 100 West,
intends to construct a building fat;ade that would encroach 0 03 acres into the city nght of way,
and
WHEREAS, the owner of the Rio Colorado Cafe and Bar intends to construct storm water
drainage improvements and provide a storm water drainage easement to the City as part of the
proposed improvements to the property, and
WHEREAS, a diagram of satd storm water drainage improvements and easement is attached to
thts resolution, and
WHEREAS, the above descnbed improvements provide benefits to the City and would not cause
any detnments to the City, and
WHEREAS, the City has imtiated nght-of-way vacation proceedings for the portion of the nght-
of-way in question, and
WHEREAS, a legal descnption for the portion of the nght of way in question is attached to this
resolution, and
WHEREAS, the fair market value for the portion of the nght-of-way in question is $4,352, and
WHEREAS, the market value of the storm water easement in question has not been determined,
but will be determined based on the value of comparable easements, and
WHEREAS, the property owner of the Rio Colorado Cafe and Bar has agreed pay the City fair
market value of the portion of the nght-of-way in question, minus the value of the above
mentioned easement, in exchange for the City's vacating the portion of the nght-of—way in
question
NOW, THEREFORE, we, the Governing Body of the City of Moab do hereby approve the nght-
of- way vacation for the portion of the City nght-of way descnbed in the legal descnption
attached hereto, and further authonze the Mayor to execute a quit claim deed and easement
agreement consistent with this resolution and state law

This resolution shall take effect immediately upon passage
Passed and adopted by action of the Governing Body of the City of Moab in open session
this 22nd day of May, 2001
