The Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor James A. Failace approximately
7:30 P.M. on Thursday, March 1, 2001, Municipal Court/Police
Facility, 230 Roosevelt A venue, Carteret, New Jersey.
Upon individual roll call, the following were noted present:
Councilmember Remy Quinones
" Daniel Reiman
" Ronald Rios
Also noted present were Business Administrator Nicholas Goldsack
and Borough Attorney Robert J. Bergen.
Noted absent were Councilmember Jack Fazekas, Janet Santoro and
Buddy Sohayda.
The meeting was opened with a moment of Silent Prayer and the
Pledge of Allegiance led by Mayor James A. Failace. Mayor Failace
asked everyone to remember in their prayers former principal of
Cartcret High School, James Gilrain.
The Clerk stated that on February 23, 2001, in full compliance with the
Open Public Meetings Act, a notice of tonight's meeting was sent to
The Home News Tribune, The Star-Ledger and posted on the bulletin
board.
Mayor Failace administered the oath of office to the new Police
Officer and Firefighter. Sworn in, as patrolman was Louis Muzyka
and Firefighter James McKinney.
Councilmember Reiman said he wanted to make everyone aware that
Councilmember Sohayda and Santoro were attending the beginning
part of the Freeholders meeting in New Brunswick for the possibility
of bringing in a grant to Carteret and said they should be here
momentarily.

guidance. She said she felt this was an excellent move that will save
the town a lot of money and it was a step in the right direction.
ORDINANCE #01-16 was introduced and adopted on First Reading
and the Clerk authorized and directed to advertise same for Public
Hearing to be held on March 15, 2001, upon MMS&C, by
Councilmembers Rios and Sohayda. Upon individual roll call vote,
Councilmember Quinones, Reiman, Rios, Santoro and Sohayda voted
in the affirmative. Council member Fazekas was noted absent.
Councilmember Quinones made a motion to amend some of the
language in the Ordinance to include some of the language in the
Deputy Mayor's Ordinance. She felt it should allow the Mayor's Aide
the ability to maintain communication with County, State and Federal
Governmcnt on behalf of the Mayor and under thc Mayor's authority.
Councilmcmber Santoro said the Council discussed this at thc Agcnda
Mecting and she thought it was clear that one of thc things the Council
did not agree with because as Councilmembers they have the authority
to sit in for the Mayor with State, Local and County Government. She
said the Council was elected and she felt it was their duty and
dedication that allows them to step in if the Mayor is not able to be
present.
Councilmember Quinones said that was fine but felt the Council
should reconsider their positions because the Council is not always
readily available to attcnd various functions or meetings during the
day. She said this was the reason the Mayor wanted to retain an Aide.
Shc said the Mayor should not have to chase anyone in the event he
wanted to send a representative. She told Councilmember Santoro she
was not the Mayor's representative, she could go as a Council member
representing herself, or the Council, not the Mayor. She said the
Mayor's Aide should have the ability to do that.
Councilmember Santoro said she did not feel the Mayor's Aide would
not be a representative of anyone else if he were in an appointed
position when it comes to State and Local Government. She said she
may not be the Mayor, but she does have a vote on things that take
place in this town and said she is available during the day at anyone's
request when they do need her at a meeting. She said she does attend
numerous meetings and reminded Councilmember Quinones they had
discussed this at the Agenda Meeting and if she wanted to move and
see if it goes anywhere amending it, shc should go right ahead.

Mayor Failace said he really did not see the problem and said that was
why he brought it up originally at the Agenda Meeting. He said it
does not effect any of the Council members going somewhere or doing
something. He said it allows him to send his appointee to go nothing-
more than that.
Councilmember Quinones said it does not give that person any
additional authority it is just that the Mayor can send them as his
representative.

therc was no sense attending if Councilmember Santoro was going but
said hc would have been welcome to go. She said she was elected to
sit at Council Mcetings and never neglects that, but felt it was very
important for Carteret to be with the Freeholders to thank them for
giving Carteret the opportunity with the grant and to urge them to
continue the grant in the future. She said while she was there she
spoke to the Freeholders about the Green Acres Grant. She told the
Mayor if he was going to criticize her he would have to criticize her
for caring and trying to get the money for Carteret.
Mayor Failace said he would nevcr criticize her for caring or not being
here. He said Carteret hasn't been able to apply for the Green Acres
grant because they haven't received the information. He said the
meeting was in January and Carteret still hasn't received the
information.

Mayor Failace said when the Council eliminated some of permit fees
last year they omitted some of the zoning fees by mistake, which were
sheds, fences and sidewalks. He said they are now part of it and
seniors would not have to pay permit fees for those things.

The Clerk stated Ordinance #01-11 was introduced and passed upon
First Reading at a Regular Meeting of the Borough Council held on
February 15,2001. It was duly published in the Home News Tribune
on February 22, 2001 with notice that it will be considered for final
passage after Public Hearing to be held on March 1, 2001 at
approximately 7:30 P.M. The Ordinance was posted on the bulletin
board and copies were made available to the general public and
according to law, she read the Ordinance by title.
Upon MMS&C, by Councilmembers Reiman and Rios and unanimous
affirmative vote of the five (5) Councilmembers present, the Mayor
declared the Public Hearing to be open:
Lou Mangieri asked who sponsored this Ordinance.
Councilmember Rios said this was coming through the Fire
Dcpartment and it was for the Fire Superintendant! Chief and is being
done to clarify the title for Civil Service.
Lou Mangieri asked if the Superintendant was going to stay
Superintendant.
Councilmember Rios said this IS going to be the new title for the
Superintendant.
Lou Mangieri asked why.
Councilmember Rios said it was because of Civil Service.
Lou Mangieri said they didn't have to do it before they had a
Superintendant for forty years.
Mayor Failace said Civil Service does not recognize Superintendant.
Councilmember Rios said Civil Service does not recognize the title of
Superintendant/Chief or just Superintendant.
Mayor Failace said there is no more money involved, it is nothing
more than a title.
Lou Mangieri said the Ordinance states the Battalion Fire Chief takes
charge at fires. He said he thought the Volunteer Fire Chief took
charge.

Councilmember Rios said the Volunteer Chief does take charge at a
fire. He said this is to maintain what the paid men will be required to
do. He said at the fire scene the Volunteer Chief would remain in
charge as it has been all along.

Councilmember Santoro made a motion for the Council to approve the
recommendation of the negotiating committee and authorize the
attorney to review the final contract for final approval on the blue-
collar workers.
Mayor Failace asked Borough Attorney Bergen if the Council needed
a Resolution for him to review the contract.
Borough Attorney Bergen said she was just making a motion to
approve the negotiating committee's recommendation and have him
draft and review the language for the final approval. He said the
contract itself would have to be approved by Resolution. He said he
usually recommends the union draft the contract and he will review it.
Mayor Failace said that was what he did not understand, if the union is
going to draft the contract and give it to the Borough Attorney and the
Council will then vote on it. He wanted to know why the Council
would have to do this now and vote on it again.
Councilmember Santoro said this way it is moving forward and they
are actually putting it together.
Mayor Failace asked Councilmember Santoro if they ratified it did she
mean they were not going to put it together and give it to the Borough
Attorney.
Councilmembcr Santoro said she didn't see a problem and asked
Borough Attorney Bergen if there was a problem with doing it this
way.
Borough Attorney Bergen said if the Council wanted to make a
motion, they could make a motion to approve and ask the Council for
their approval. He said it is not a Resolution she would be asking for,
it would be asking for acceptance of the negotiating committee's
recommendation.
Mayor Failace said so; it is not a Resolution.
Borough Attorney Bergen said he had something faxed to his office
yesterday that he looked at and something was faxed again today. He
said there were some changes and he assumed he would want to take a
look at it.

Councilmember Rios said he felt it was someone who he believe has
an interest in the Borough and would like to serve the Borough.
Mary Fountaine asked Councilmember Rios if these people come to
him he would appoint them to the Redevelopment Committee.
Councilmember Rios said if these people come to any
Councilmember, not just him.
Councilmember Sohayda said he believed the procedure was that each
Councilmember handed in a list. He said the Borough Clerk went over
six or seven lists to determine who received more votes. He said as far
as his personal choice, he chose people he felt wanted to be on the
committee, who would have the utmost outlook for the people of
Carteret and wanted to be involved in the endeavors of the meetings
which he felt was not an easy task.
Mary Fountaine asked if Councilmember Sohayda has ever been in the
community that would be redeveloped to see who was doing what
concerning the children and adults and if he has not been down there
how would he know what the people need.
Councilmember Sohayda said that was a valid question, but it was not
why people were asked to be on the committee.
Mary Fountaine said if the Council was going to redevelop an area, the
people should not have to tell them, that is why they were elected to
know these things.
Councilmember Sohayda asked Ms. Fountaine if he put her on the
committee to review West Carteret, would she know what the right
thing to do for the people who live in West Carteret, which he felt
would be no different from what is being done in lower Roosevelt.
Mary Fountaine said she knows how people want to live and felt West
Carteret does not look like lower Roosevelt Avenue. She said the
people who live in West Carteret never come down to lower Roosevelt
Avenue or live down there. She said they could not say anything
about who was on the committee because no one on the committee
lives in Chrome and they do not know what the people want.
Council member Sohayda asked again if she would know the right
decision to make for West Carteret.
Mary Fountaine said no.

Council member Reiman said the Council President sent out a memo
asking the Council to submit names, he submitted names of
individuals he was familiar with that he heard were interested in
serving lower Roosevelt. He said they were people from local
businesses, not specifically in the Redevelopment Agency, but in the
area. He said Mr. Walsh has written him a letter in which said he has
asked his name be removed as an appointment to the Redevelopment
Agency and said he read part of the letter into the record at the Agenda
meeting after which he made a nomination for another commissioner.

Shawn Seymore asked who the Council would be recommending for
the spot.
Mayor Failace said it is his recommendation and appointment with
Council approval.
Shawn Seymore asked if Pastor Dickerson would be on the list.
Mayor Failace said he guessed she would find out when the Council
votes.
Council member Reiman said when he read part of Mr. Walsh's letter;
he recommended an individual to be considered. He said it is the
Mayor's appointment with Council consent, he said the individual he
has nominated is a good individual. He said he nominated Mr.
OIusoga Onafowora who teaches as a professor of Economics at Kean
University and Essex County College, a resident of Carteret, he lives
on Pershing Avenue with his wife and four children. Councilmember
Reiman said Mr. Onafowora is employed as the director of financial
operations at Essex County College and prior to that he served as the
senior budget officer for the city of Newark. He said the Council
wanted some one with a financial background.
Mary Fountaine said they need some one with community
involvement who knows the needs of the people. She said the Council
docs not come down to the area to see what is needed. She said the
burned building is still there and she felt it was disgusting, and if it
were in their neighborhood it would have been down the next day.
Councilmember Reiman said his neighborhood was two blocks away,
on Atlantic Street and he drives through that community every day.
William Kolibas, Jr. said he wasn't going to stand there while
Councilmember Sohayda embarrassed Mary Fountaine. He said
Councilmember Sohayda asked Ms. Fountaine if she was appointed to
a board to fix West Carteret could she do it. He said he felt that was
not a fair question; when Council member Sohayda was asked to
appoint someone to the board to fix the Chrome area, he chose not to
take someone that knew the area and said Councilmember Sohayda
should not embarrass the residents he was elected to represent. He
asked the Council to name who they nominated on their lists.
Councilmember Santoro said Mr. Singh, Patricia Rodriguez, Debbie
Urena, Mike Kepich, Larry Aleksandrich and Tony Neibert,

Andrews, Mike Kepich and Larry Aleksandrich. He said six lists were
submitted and tallied which was how the Council came up with some
of the appointments. He said anyone who allowed their name to be
submitted should be thanked, no matter whose list they were on. He

Councilmember Quinones said Pastor Dickerson serves lower
Roosevelt Avenue. She said Tony Neibert and Mr. Riggio serve the
community. She said Mr. Riggio is directly involved, and asked how
they could remove the director of Community Development.
Councilmember Reiman said Mr. Riggio should be guiding the project
and not voting on the board.
Councilmember Santoro said Mr. Riggio stood up at a meeting and
asked to be removed from the agency.

the people involved. She said people have come to her and asked her
why people want to fix up Chrome because they are going to tear it
down. She said people need to understand we do not own one building
on Roosevelt A venue. She said the property owners have been
allowed to walk away from their property and leave it in the shape it is
in. She said the people that live in the neighborhood get blamed if the
building starts falling down. She said they do not do anything because
they do not own the buildings. She said she told the person that told
her about this to tell her what building that has been put up in the last
ten years has been tom down but said that person shut up. She said her
daughter will be eighteen years old next Saturday and her daughter has
never seen a new building put up in her lifetime. Ms. Miles said she
has not seen a new building put up in the last twenty-five to thirty
years. She said the people are ready to take back their neighborhood
and be involved in their neighborhood. She said the people see a light
in Pastor Dickerson and Pastor Davis and said Pastor Dickerson is
good for the agency and he is the voice of the people. She said she
truly believes the only reason the Council is keeping Pastor Dickerson
off the Redevelopment Agency is to get back at her or the Mayor. She
said the bottom line is the Council is not hurting Daphne or the Mayor,
they would be hurting the children who she felt deserve a better quality
of life.
Councilmember Reiman said if the Council could make the
appointments to the agency the Council has created, the Planning
Board will make a recommendation next week on the border of the
Redevelopment Agency and then it will go in front of the Council for
public hearing. He said once it is done and the commissioners are
schooled, the Council can move on. He said there is no one on the
Council, including the Mayor who would blame the residents of
Chrome for the condition of Roosevelt A venue. He said everyone is
committed to improving not only Carteret, also the lower Roosevelt
A venue district.
Daphne Miles said she felt this was an opportune time for the Council
to say they care about the people and how they feel because they will
be going to the polls to vote and support the Councilmembers. She felt
this is the time the Council should care about the citizens by letting
them be a part of the decision when the Mayor makes his nomination
and the Council should support it for that reason.

Stan Gutowski, New Jersey Avenue asked the Council's position on
Resolution #01-73, and the continued one hundred percent use of RCA
funds that the Borough receives for private homes as opposed to
developers. He said he knew the Borough would be receiving a four
hundred sixty-four-dollar payment this year and knows they would be
receiving another payment next year.
Councilmember Reiman said for Mr. Gutowski's information he
attended a meeting yesterday with the Business Administrator and the
Director of Community Development concerning the additional money
the town would be receiving. He said he asked them to see if some of
the additional money could be used for the redevelopment of lower
Roosevelt A venue, either as grants to individual homeowners or to
start development in the area. He said the Council needs to weigh the
options they have been debating for the last couple of years. He said
he was not sure if using it solely for residents or for developers was the
best answer but felt a proper mix would be the best solution.
Stan Gutowski said they were not speaking only about COAH
regulations, they were also speaking about RCA money. He said he
did not believe RCA money could be used in a Redevelopment
Agency or by a Redevelopment Agency.
Councilmember Reiman said that was what he asked them to look into
and was not sure of the guidelines for COAH.
Mayor Failace said he did not think it could, but if they were able to
use the money it would be worthwhile. He said they have been giving
money to the people in the last couple of years and said he supports
doing that. He said he spoke to Mr. Raia about a number of small
projects because he does good work but the Mayor said he would not
agree to giving Mr. Raia all the money. He said Mr. Raia could get a
small portion of the money with the citizens still getting money. He
said there are still a few pieces of property in the Hill section Mr. Raia
owns which would amount to a hundred thousand dollars, but the town
still has a lot more money coming in.
Stan Gutowski asked if there is still a list, he knew there was one
hundred and twenty people on it.
Mayor Failace said they are on the second list now.
Stan Gutowski said he hoped the Council was going to complete the
list of seventy people who applied for money.
Mayor Failace said it seemed to be the way it was going because no
one spoke against it.

look at this and shave off possibly a few more pennies of the projected

RESOLUTION #01-75 was introduced by the Mayor and referred to
the Council for action.
Upon MMS&C, by Council members Reiman and Santoro
RESOLUTION #01-75
"RESOLUTION APPOINTING A MUNICIPAL JUDGE"
was adopted. Upon individual roll call vote, Council members
Quinones, Reiman, Rios, Santoro and Sohayda voted in the
affirmative. Councilmember Fazekas was noted absent.
Councilmember Quinones made a motion to table this Resolution until
the next Agenda Meeting because another resume was submitted in the
mailboxes of the Councilmembers and she asked them to consider that
person during the week the so Council could take action at the Agenda
meeting.
Council member Reiman said the Council has the resume that was
submitted. He said he did not see any reason not to reappoint judge
Comba, he felt Judge Comba has done a fine job. He asked that the
Mayor appoint judge Comba so the Council could give their consent.
He said the Council does have Council member Quinones'
recommendation and said that was something the Finance Committee
should begin the process of looking into. He said he had met with
Judge Comb a and the Court Administrator for the possibility of
creating the position of Conflict Judge the Council could appoint down
the road. He asked that the Mayor reappoint Judge Comba who he felt
did a fabulous job for Carteret.
Mayor Failace said he had no problem with that. He said he asked the
Council to get back to him but only Councilmember Rios got back to
him and said he had no problem with Allen Comba.
Councilmember Reiman told the Mayor he touched base with him
yesterday about the appointment . . . Friday prior to the Planning
Board meeting and asked if this would be the Mayor's appointment.
Councilmember Quinones said she does not have a problem with Mr.
Comba's appointment and felt he has done a good job for the Borough
but said she would like the Council to consider the other appointment
further, particularly in the case of an alternate Conflict judge,

Councilmember Rios said he has gotten to know Mr. Onafowora and
believed in his heart he will do a good job and will be concerned for
the redevelopment of Chrome and would be a dedicated hard-working
individual.
Councilmember Sohayda said he thought the people at the meeting
know they could still go to the Redevelopment Agency meetings and
voice their opinions concerning the topic that needs to be dealt with.
He said why make noise when it becomes nothing but noise and hoped
people would have the respect and common courtesy of knowing how
to act in public. He said he does not agree with everyone's feelings
and everyone does not agree with his feelings and said that was the
great thing about the United States of America. He said if you do not
like the way things are you could speak at the Redevelopment Agency
Meetings. He said he voted yes on Mr. Onafowora and hoped he
would accomplish things in Carteret that other counties in north jersey
have accomplished.
Councilmember Rios asked the Mayor if the Clerk could send a letter
to every member of the Agency to have a meeting to elect a Chairman
and Vice Chairman and the individuals to start the wheels turning. He
said he would like an April first date so they could meet.
Mayor Failace said they have to be sworn in and they need to attend
classes.
Councilmember Reiman said most of the members have been sworn
in, they just have to attend the classes before they could appoint the
professionals to work in unison with the members.
Council member Sohayda asked if these were the classes the Council
was notified about that were held in Newark and asked if
Councilmember received a card concerning this.
Council member Rios said he understood they may not be able to
appoint the professionals like the Attorney and Engineer but felt they
could at least start setting their agenda as to when they would meet and
start the wheel in motion. He asked if the Council could give them an
April first date.
Mayor Failace said he assumed they could do that and said the Clerk
could mail them something.

Councilmember Reiman said the last two Resolutions were concerning
grants that have come in through the New jersey Department of
Transportation, Municipal Aid Grants for rehabilitation projects on
specific streets in Carteret. He said the grants will not cover the cost
of the projects and the Council would have the option of either scaling
down the project or looking into this year's budget in the Capital
Improvement expenses to see if there would be enough money to fund
the entire project. He thanked last year's administration for applying
and receiving this grant and hoped they could make it work as soon as
possible.
The Clerk stated that she was in receipt of a Communication from
Reichold, Inc.- notice of Developed Classification Exception Area
Petition for groundwater.
The Clerk stated that she was in receipt of a Communication from the
Borough of Spotswood-Resolution asking for appropriation so that
taxpayers will be spared property tax burden because of reduction in
the business personal property liability of Verizon.
The Clerk stated that she was in receipt of a Communication from the
Middlesex County Board of Chosen Freeholders-Resolution adopting
revised rules and regulations governing use of County Parks to update
schedule of fines.
The Mayor asked if the Communication from Spotswood was already
done at one of last year's Council meetings.
Council members Reiman and Quinones agreed and asked for
clarification from Business Administrator Goldsack.
Business Administrator Goldsack said he wasn't sure if they did but
felt this Council should vote and support it.
Mayor Failace told the Borough Clerk to check to see if they did the
Resolution and if they didn't they should put it on the next Agenda
meeting.
Upon MMS&C, by Councilmembers Reiman and Rios and unanimous
affirmative vote of the five (5) Councilmembers present all
Communications were ordered to be received and placed on file.

utilize one hundred thousand dollars of the money to offset the
projected tax increase this year. He said the town would be receiving
two grants for resurfacing of some Borough streets, he thanked
Councilmember Santoro for helping get the grants from the county for
the Washington Avenue rehabilitation program of seventy five
thousand dollars. He felt this would be the start of money the town
could get from the county if the Council works together. He reported
progress.
FIRE: Committee Chairperson Rios congratulated firefighterÆMT
James McKinney who has been working the last few weeks and has
started officially this morning. He said with the help of the
Community Development Fund the Fire Department will be issuing all
firefighters their own personal Scott air mask which would help them
when in contact with blood borne contaminants. He warned the
residents that the town recently had a house fire that was serious, no
one got hurt, but it did extensive damage. The Fire Department is
asking all residents to beware of the dangers of extension cords, which
was the determination of the local Fire Inspector and the County Arson
Inspector to be the cause of the fire. He felt it was sad that something
so small could do so much damage. He reminded everyone what the
Fire Inspector said extension cords should not be kept under rugs or
near curtains, make sure they are not broken or overloaded especially
at Christmas time. He said the next thing they would be doing was
organizing the local industry that handles hazardous materials and the
Fire Department to have training as far as their emergency action plan
being in compliance with Federal regulations. He said they would try
to maintain a steady record and an aggressive agenda to make sure
they are trained and work in cooperation with the local Fire
Department. He reported progress.

PARKS & RECREATION: Committee Chairperson Santoro said
because of the weather the lights at Veterans' Field are temporarily on
hold. She said they feel it will take another week to finish the work
and she hoped everything would end up on schedule. She said the
three-on-three basketball tournament sponsored by the Recreation
Department will be held at the end of the month at the high school,
registration is March first, second and fifth at the Recreation Office in
the Library. She said the tournament is for grades five through twelve
she said they always have a great turn out and she encouraged
everyone to sign up. She said Comcast has given free cable to the
Recreation Building, which is hooked up in the building, and the
Council would be contacting the three groups who use the building
concerning their own personal needs. She said the Council is working
on the Green Acres Grant. She said she spoke to John Riggio
concerning getting the information to present to the Freeholders. She
said she would be calling Freeholder Dalina on Monday to set up the
appointment. She said she would be looking for cooperation on the
grant and said she felt confident they would be getting money.

BOARD OF EDUCATION: Council member Santoro said she knows
Councilmember Fazekas works on technology concerning the Board of
Education. She said last night there was a Board of Education meeting
and the budget should be ready at the end of the month which she felt
would be an interest to taxpayers between the Council's budget and
the Board of Education's budget. She said the Council would be
waiting to receive the Board of Education's budget. She said the high
school basketball teams are going to the State Tournament and she
hoped the town would be getting winning teams this year. She said
there is a School Board Election in April and encouraged everyone to
get out and vote. She reported progress.
Mayor Failace congratulated Officer Muzyka and Firefighter
McKinney on their positions and wished them a safe journey. He said
he knew the Council was in favor of training but disagreed with not
sending the Officers to the Federal training course that is given by the
Federal Gòvernment and is a free course. He said he understood
Captain Pieczyski's position but he also understood Director Elg's
position that the Officers do get trained. He said that does not
eliminate other training. He said under Director Elg, everyone has the
opportunity to get training and there is more training since he has
become the Director. He said the Officers are able to have
Breathalyzer, DWI, Domestic Violence, CPR Certification, Law
Enforcement Supervision, and Juvenile Homicide just to name a few.
Councilmember Rios said the firefighters in the Borough have a CPR
training course, which is available to the Police Officers.

Mayor Failace said the CPR course is a free course as are a number of
the courses he had mentioned. He said he didn't see why the Officers
were not allowed to attend the training course in New Mexico for
terrorist bombing which was a twenty-eight hour four day course and
was offered to Police, Fire and members EMS and he felt as many
members as possible should be trained without having a burden on the
Borough. He said he did not feel the schedule the Director set up for
the training was not a burden to the Borough or the Police Department
and urged the Council to rethink their position on the courses. He said
liability come in when Officers, Firefighters and EMS are not educated
and when they are educated liabilities are limited. He said four of the
officers said they would go on their own time but he didn't feel they
should be doing it on their time. He said if the Council would
reconsider allowing them to go he would sign for it. He said when he
read this morning's newspaper he was happy, vindicated and some
what sad because for the last two years he has asked the administration
and the Council to consider privatizing Carteret's wastewater. He said
the MCIA is a proponent of this and said North Brunswick is saving
forty-six million dollars and New Brunswick is saving thirty-one
million dollars over twenty years. He felt the town was in direr straits
with problems that need to be taken care of but the sewers would have
to be repaired separately and urged the Council to seriously move
forward to look at this, He said the MCIA is hoping all twenty-five
municipalities in Middlesex County will consider privatizing their
water and wastewater systems. He said he knows some of the Council
is against privatizing and said he felt they have to seriously look at this
and move forward. He said he feels vindicated reading the article

said there are potholes at the intersection of Edwin and Essex Street
that have been there for twenty years.
Councilmember Sohayda said he has told the residents if they had
potholes they should call 541-3881 and it would be put on the list.
David Crudup said the men have been putting stuff in the potholes for
the passed thirty years. He said there was a house put there and the
sewer was not capped he said that was what the problem was and
wanted to know why this only seemed to happen in Chrome. He said
the other sections of town the flooding problems are always taken care
of but they are not taken care of in Chrome.
Councilmember Sohayda said he would be happy to look into it for
him.
David Crudup asked Councilmember Sohayda how long he would
have to look into it.
Councilmember Sohayda said he hasn't looked into it yet because Mr.
Crudup was the first person that said anything about the problem.
David Crudup said he wished the Council would get the tapes of other
meetings where he had addressed the Council with the same problems.
He said at the intersection of Salem and Bergen Street the manholes
pop off when it rains heavily. He said if a child fell into the hole or
some one backed into it there would be a problem. He felt someone
should put a grate over the manhole cover so that any excessive
amount of water would not back up and no one would fall in.
Councilmember Sohayda said he did not have a problem doing that as
long as the State, Federal Government, Department of Transportation
and OSHA say it would be all right to put a grate over the manhole
cover.
David Crudup asked why the engineers could not do this.
Councilmember Sohayda said they would have the engineers look at it.
David Crudup said the Council is taking a band-aid and trying to fix
things. He said the sewer on Mercer Street has been backing up for
years also.
Councilmember Sohayda said he is not an engineer and he did not
know the engineer would have to address the issues.

inflow an infiltration and they would be going over all the manholes to

David Crudup said he works for a local utility company and if he does
not solve the problem, his boss wants to know why the problem is not
taken care of. He said he felt some one would get hurt and sue the
Borough and the taxpayers would have to pay.
Councilmember Rios said the Council would address the problem and
give it to the engineer. He said as far as the concrete, he would have
the Public Works employees pick it up. He said their hands were tied
but they could do certain things.
David Crudup asked when Chrome Park would be repaired.
Councilmember Santoro said Chrome Park is still in the process of
being repaired, it started last year but needed more work to be
completed.
David Crudup asked why it took so long to put up two by fours and
felt it was putting a band-aid on the situation.
Councilmember Santoro said last year they tried to rush getting some
of the parks in order and agreed with Mr. Crudup about putting band-
aids on things to fix them.
Mayor Failace said he did not think Mr. Crudup was right when he
said they were putting a band-aid on the situation. He said as far as
Chrome Park, they put the new basketball courts, redid the baseball
field and put the new playground in.
David Crudup said he knew they were trying but he wanted to know
when it would be done so his daughter could play at the park.
Councilmember Santoro said when the weather breaks which should
be in a few weeks. She said if Mr. Crudup came back to the meetings
in two to four weeks she hoped things would be completed.
David Crudup said he would be back to remind the Council about
these things. He said he spoke to Pastor Dickinson who he felt was a
good man. He said he has known the Mayor for a few years and urged
the Council to consider Pastor Dickinson because he felt the pastor is
needed in the community because he is accessible to the residents. He
said they could not speak to Mr. Onafowora any time of the day and
asked why the Council would nominate some one from another area to
represent the people of Chrome.
Jessie Bagala said she has heard a rumor that she would be moved
from the Park to the Library and asked Mr. Kately if it were true and
he told her it was true. She said she has worked in the Park for
twenty-six years and was the founder of the seniors, worked with
Democrats and Republicans with no problems but now in the last four
41. months there is nothing but chaos. She said Mr. Kately told her she
had to move her office to the Library because he can not take what is
going on anymore. She said Business Administrator Goldsack said it
should be ready for Mrs. Hedesh and she said Mrs. Hedesh was at the
Park Department two times a day. She said she didn't know what
difference it would make if Mrs. Hedesh worked from her office at the
Library or the office in the Parks and felt this was vindictive and the
people are rotten that are doing this. She said she has cleaned toilets,

Council member Quinones said the Council can not control what Mr.
Kately says but she is very strongly against moving her and did not see
the need for it.
Mrs. Bagala said she feels hurt about this and there will be a lot of
complaints every day if she is moved.
Mayor Failace said he felt as Councilmember Quinones did about
moving her and agreed with Councilmember Santoro that Mr. Kately
could make recommendations but the Council has not made a decision.
Mrs. Bagala thanked the Council for their time.
Mr. Sudia, Cypress Street said the Redevelopment Agency falls in line
with other Redevelopment Agencies in the state of New Jersey and in
the United States. He said he agreed with the people in Chrome that
there should be an advisory committee made up of African Americans,
and members of the Indian and Hispanic communities. He said the
Indian community consists of seventy percent, the Black community is
thirty percent in Chrome. He said each group of people should put
together an advisory committee through the Redevelopment Agency
that could interact with the Redevelopment Agency and show they are
working together to move this forward.
Councilmember Reiman felt it was a great idea and asked if Borough
Attorney Bergen would put something together to discuss at the
Agenda meeting or suggested Mr. Sudia discuss this with the
Redevelopment Agency members.
John Sudia said if anyone tried to move "Aunt jessie", he was seventy-
eight years old but felt he was still in good shape and would take
anyone one on one or all at once and said leave her alone, she has been
there and done a great job. He asked the Mayor if he said the raise in
the blue-collar union contracts was excessive.
Mayor Failace said he did say that.
John Sudia said this Council has gIven raises that exceeded three
percent; the Business Administrator over a three year period, received
a twenty one percent raise, the Police Director received over a four
year period, a nineteen percent raise. He said the Clerk who he felt
was underpaid got a raise but was not enough of an increase because
she does most of the work for the Borough. He asked how the Council
could justify twelve; fifteen or eighteen percent raises and discuss a
three- percent raise to the blue-collar workers.

Mayor Failace said they would be talking apples and oranges. He said
the Council chose people in the management area and said Mr.
Goldsack was hired at well under what the going rate for a Business
Administrator was and the Council gave him a one year contract to see
how well he did. He said Mr. Goldsack was told if they did that and it
worked out, he would be moved to a more favorable rate for a
Business Administrator and said he was still well below other Business
Administrators. He said he felt he offered a good contract and gave a
fair contract. He said the white-collar workers accepted the contract,
the Police union went to arbitration and got what they wanted the
supervisors accepted their contract. He said he felt this was excessive

Mayor Failace said he was not picking on anyone, he offered all the
unions the exact same thing.
Councilmember Rios said the Mayor should have increased their
percentage somewhat close to parody to what a manager would be
getting.
Council member Quinones asked why.
Councilmember Rios said why not and asked if the Council felt the
blue-collar workers were second class citizens.
Council member Quinones said it was a different job classification.
Mayor Failace said no matter what Council member Rios wanted to
make it sound like, it was not the case.
Councilmember Quinones said the Council is fair and the unions have
made several tentative agreements, which they chose to go back on.
Councilmember Reiman said although he can not vote on the contract,
he felt it was a fair contract that the union and the Borough should be
proud of.
Mayor Failace said they did not hear him go off on this or go crazy on
this he was just saying the other unions should be opening up their
contracts to give them the same.
Council member Rios said that was an unfortunate part of negotiating.
Mayor Failace said it was not an unfortunate thing when they
negotiated, it was unfortunate what they accepted. He said if they
accepted it had to be fair.
Sue Ivanitski said a few children asked her today when the Skate Park
would be ready. She said the children said a lot of the equipment was
taken and they are waiting for the equipment to come back. She said it
is a new park and she did not understand why things are broken she
felt it should be maintained.
Councilmember Santoro said it was not really new and asked Mr.
Kately how many years it has been there.
Robert Kately said the last three weeks his department has been fixing
the six of the eight pieces of equipment, one missing right now.
Sue Ivanitski asked when the Skate Park would be open and ready.

said the union did not get everything they wanted and the Council did
not get everything they wanted. He told the Mayor maybe the white-
collar workers deserve to open their negotiations, but asked if the
white-collar workers will give back the eighteen days the blue-collar
members did not get on the buyback to give the other percentages to
the Borough. He said he felt eighteen days was a lot of money.
Mayor Failace said that was his choice not to accept the contract.
Michael Buscak said the Mayor was right for a better percentage point.
Mayor Failace said he could have settled with the men two years ago
for another percent and a half.
Councilmember Rios said this Council saved a lot of money because
prior administration spent one hundred and seventy thousand dollars in
labor lawyers.
Mayor Failace asked if Councilmember Rios was nuts, it was not with
the blue-collar union. He asked Mr. Buscak who negotiated with the
men last year.
Michael Buscak said they had the lawyer and Business Administrator
Goldsack.
Mayor Failace said he could understand Nick negotiating with them,
but did not think former Borough Attorney Craig Coughlin made a
hundred thousand dollars.
Michael Buscak said the members are happy with the agreement and
look forward to serving the Borough with the utmost integrity.
Gary Cordero, Pennsylvania Avenue, said it has been in the newspaper
that in one year, the year two thousand, the Council has given thirty
thousand dollars to four individuals and that Council felt it was
correct.
Mayor Failace said there were other individuals on the Council who
also voted to approve that. He said there were three out of five
Council people who voted to approve the raises.
Gary Cordero said that was four indi viduals at thirty thousand dollars
over a three-year period and asked how many workers the town has.
He said the Borough workers would be receiving sixteen thousand
dollars a year and said that was not a bad investment. He said they are
working with the town and see what needs to be done at three and a
half percent. He said the Mayor felt the raises are fair and paraded that
fact in the newspaper. He said now they are making it seem the
workers would be breaking the bank this year but when they did
47. something like giving thirty thousand dollars to four individuals last
year, that was not a problem. He said he felt it was something the
town should not have done and the Council was making a laughing
stock of the Borough of Carteret.

Councilmember Reiman asked how much it cost the Borough to move
the Police Director.
Gary Cordero said his point was it was unfortunate last year and OK
this year, it is not OK. He said he felt that was politics in the wrong
way, which is bad for Carteret. He said what was done for the union
was good and they should be proud of that, if not he felt they look
foolish to the whole County. He said people read that in the
newspaper and say the town really got screwed because of what they
paid these people and he felt it was not the case but could understand
why the people would resent that and asked the Mayor not to do things
like that.
Mayor Failace said he freely spoke what he believed and would
continue to do so as everyone of the Councilmembers does.
Gary Cordero said he should speak freely but urged him to be
consistent with what is in the newspaper.
Mayor Failace said he is consistent. He said Mr. Cordero wants to
make comparisons and since he was a businessman, he should know in
some instances certain positions pay more money and make more
money. He said he has been in business for a long time as Mr.
Cordero is and has negotiated with unions and worked with upper
management he said it may not always be fair and equitable up and
down as it should be but unfortunately it does not work that way.
Gary Cordero said the Mayor felt that way last year and did that, it was
OK but this year what they did is not OK and felt it is inconsistent. He
said he felt the Mayor was doing this to get reelected at any cost.
Mayor Failace said what was in the newspaper would not get him
reelected or not reelected and Mr. Cordero knows him better than that
and he should know it is not true.
Gary Cordero asked about the comment to the blue-collar workers he
made.
Mayor Failace said he believes in what he said and that was not going
to get him reelected. He said the same people that support this Council
now, have supported him and he chose not to increase their salaries
and felt that was the difference. He said they got exactly what they
wanted.
Councilmember Reiman said the Business Administrator position got a
twenty one percent raise, the Clerk's position got an eighteen percent
raise, the Police Director got a nineteen point two percent raise after
opening and renegotiating his contract, the Director of Public Works

Stan Gutowski asked why Council member Rios felt the Police have to
have a professional representative negotiate with the Borough of
Carteret. He said he felt the Council did not know Police contracts.
Councilmember Rios said if the Police want to hire a labor lawyer that
was their prerogative within their union by-laws or constitution. He
said if he were negotiating as a Council member and felt that the
Council needed an attorney he might decide to do that at a later time.
He said he would try to negotiate the contract as a committee.
Stan Gutowski said as Chairman of the Police committee he made the
offer for the Police RBA to withdraw the labor negotiator and they
could do it as gentleman but unfortunately the Police would not do it.
He said the Council felt everyone should be equally represented and
that was part of the money the Borough spent.
Council member Quinones said they should see where sentiments
change in a few years because she felt loyalties in this town fly like the
wind.
Councilmember Santoro said if Council member Quinones lived here
longer she would pick the choice of it . . .
Councilmember Quinones said just because Councilmember Santoro
has lived here for a hundred years that does not make her a better
representative or more knowledgeable as to what goes on in this town.
Councilmember Santoro said it absolutely does, She said someone
who comes into the town does not have a clue to the make up or the
people of this town and it would take them a while to learn this town.
She felt it could not be learned.
Stan Gutowski said he respected the opinion that they got the best deal
for the Borough and said it was a deal. He said it would not be a
contract until it was in writing, he said unfortunately the Borough
Attorney has not had a chance to look at it.
Borough Attorney Bergen said he looked at the agreement last night.

Stan Gutowski said negotiation was the art of the deal, with a contract,
negotiation, people make compromises. He said he hoped they did not
make as many compromises as he thought they did. He said before
Council member Rios makes any statements about wasting money even
if he clarified the seventy thousand dollars was over a three-year
period. He said if you break it down it is about sixteen thousand
dollars a sixty thousand dollars a year, which he felt, was not bad. He
said the prior Council inherited seven labor contracts and negotiated
them at one time. He said he would like to see how much this Council
would spend. He said they should divide the seventy thousand dollars
among the seven contracts and the Council should watch what they are
doing because if they do not feel; the taxpayers and the professionals
the labor unions bring in, the people would let the Council know that.
William Kolibas, Jr. asked Councilmember Santoro what she abstained
on when voting on Ordinance #01-13.
