ORDINANCE NO. 2008 - 2780 AN ORDINANCE ENACTING CHAPTER 5, ARTICLE III, SECTION 5-73 OF THE VILLAGE OF PLAINFIELD CODE OF ORDINANCES An Ordinance Relating to Vehicle Weight Restrictions WHEREAS, pursuant to the laws of the State of Illinois, the Village of Plainfield, Will County, Illinois (the "Village") has the authority, with respect to streets and highways under its jurisdiction, to prohibit the operation of trucks or other commercial vehicles, or impose limitations as to the weight thereof; and WHEREAS, the Village President and the Village Board of Trustees have determined it necessary and desirable to amend the Code of Ordinances of the Village of Plainfield to establish vehicle weight restrictions on certain streets and highways under the jurisdiction of the Village of Plainfield; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS, as follows: SECTION ONE. That the Preamble to this Ordinance is adopted by this reference as if fully set forth herein. SECTION TWO. That Chapter 5, Article III, Section 5-73 of the Village's Code of Ordinances, entitled "Restrictions on vehicles; vehicle weight", be and hereby is enacted as set forth in Section Three below. The text enacting this Article of the Village's Code of Ordinances with document markings is attached hereto as Exhibit "A". Additions to the code are double underlined. SECTION THREE. Sec. 5-73. Restrictions on vehicles; vehicle weight. (a) Prohibition. It shall be unlawful for any vehicle having a grass weight in excess of twenty-thousand (20,000) pounds to park, use or be operated upon the fallowing streets or highways located within the Village: (1) Lockport Street between Route 59 and James Street. (b) Exceptions. pperators of vehicles having a gross weight in excess of twenty-thousand (20,000) pounds may, for the purpose of making deliveries or picking up material or merchandise, use the above designated street(s) or portion thereof, but only by entering such street at the intersection nearest the destination of the vehicle and proceeding thereon no further than the nearest intersection thereafter. The following vehicles shall also be exempt from the provisions of paragraph (a) above: (1) Vehicles owned and operated by government agencies. (2) Vehicles engaged in the activities of collection of refuse. (3) Vehicles owned and operated by private utilities. (4) Buses. (5) Snow removal vehicles performing their functions on private property or under contract by the Village. (c) Signage. Signs giving notice of the weight restriction set forth herein shall be erected and maintained at each end of that portion of the highway(s) ar street(s) identified in paragraph (a) above for which this weight restriction applies.
