HomeMy Public PortalAbout21-9861 Crime Stoppers Program for Illegal DumpingSponsored by: Vice Mayor -Williams RESOLUTION NO. 21-9861 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, DIRECTING THE CITY MANAGER TO DEVELOP AND IMPLEMENT A CRIME STOPPERS PROGRAM, "OPA-LOCKA KEEP IT CLEAN", TO DETER ILLEGAL DUMPING IN THE CITY OF OPA-LOCKA; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Opa-Locka ("City") desires to develop a policy that will assist with identifying illegal dumping problems which have plagued the City for several years. WHEREAS, this policy will give residents an incentive to inform law enforcement about problems related to illegal dumping; and WHEREAS, the City desires to engage the general public to report illegal dumping; and WHEREAS, it is the intent of the City to establish the "Opa-Locka, Keep It Clean" program, attached hereto as Exhibit "A", which aim is to provide a greater awareness in the community regarding the problem of illegal / open dumping; and WHEREAS, a program goal is to increase the willingness of community members to take proactive measures to help eliminate illegal / open dumping within the City; improve the quality of life for the community; motivate and improve the relationship between the City and the community -at -large; and provide a cash award for residents. WHEREAS, this City Commission finds it in the best interest of the City to establish an initiative to deter illegal dumping in the City of Opa-Locka. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION Resolution No. 21-9861 The City Commission of the City of Opa-Locka hereby directs the City Manager to develop and implement a Crime Stoppers Program, "Opa-Locka, Keep It Clean", attached hereto as Exhibit "A", to deter illegal dumping within the City of Opa-Locka. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon adoption and is subject to the approval of the Governor or his designee. PASSED AND ADOPTED this 28th day of April, 2021. Staff Summary: It is in the best interest of the City to develop a policy which will help with the existing problem of illegal dumping which has plagued the City for a while. This initiative will give the community an incentive to help the City with the problem of illegal dumping. Financial Impact - Budget Amendment #3 will include $10,000 added to Account 50-534520 - Illegal Dumping Removal Division - Operating Expense. Proposed Action: Staff recommends the approval of this legislation and upon adoption staff will implement the policy. Attachment: Draft policy List of illegal dumping areas Caller Reporting Form CITY OF OPA-LOCKA ILLEGAL DUMPING POLICY TITLE: Illegal Dumping ("OPA-LOCKA, KEEP IT CLEAN") SECTION 1. THE PROGRAM "OPA-LOCKA, KEEP IT CLEAN" relies on cooperation between the City and the general public to provide an open dialogue of information regarding illegal dumping and criminal activity. Illegal dumping is defined as the unlawful disposal of trash, in an area not designated for such materials, by an individual(s) who is/are not the lawful owner or occupant of the property. It is hereby the intent of the City to establish a successful "Opa-locka, Keep It Clean" program which will aim to provide a greater awareness in the community of the problem with illegal / open dumping, increase the willingness of community members to take proactive measures to help eliminate the illegal / open dumping problem, to improve the quality of life for the community and to motivate and improve relationships between the city and the public at large. SECTION 2. PROCEDURES All calls shall be received by the City's Contact Center at 305.XXX.)00CX (telephone number to be determined). Upon receiving the report(s) of illegal dumping, the information will be processed in the City's central work order management software (SeeClickFix). A specific category for illegal dumping will be selected which will in turn be assigned a case to a pre- determined staff member. The case will follow a workflow order ensuring that all necessary departments are notified and complete their portion of the request. If the person making the request provides an email address or is using the City's mobile app (Build Better Opa-locka) they will receive live notifications as the issue is resolved. A member of the community can also submit their notification of illegal dumping via the Build Better Opa-locka mobile app or by visiting the City's website at www.opalockafl.gov and select the Build Better Opa-locka button on the main page. The tipster must provide evidence of proof for the illegal dumping. Evidence should include a photo and if dumping took place in a vehicle, include a description of the vehicle. Photos should be uploaded as an attachment on the (SeeClickFix) software. Callers who attempt to communicate their own criminal acts shall not be considered an "Opa- locka, Keep It Clean" tipsters; and will not be eligible for any type of reward from the program. SECTION 3. SPECIAL MAGISTRATE All illegal dumping reports will be evaluated by Code Enforcement and forwarded to the Special Magistrate who will further evaluate offense(s), relevant facts from the caller and shall thereafter be based on the totality of the circumstances, determine the amount of a reward to be paid, ranging from $50 up to $1,000. Rewards shall then be distributed to the caller in either a private or public manner, depending on the preference of the caller. If staff does not evaluate the offense and forward to the Special Magistrate within one week, the Build Better Opa-locka app (SeeClickFix) will escalate the ticket to a supervisor, then to the City Manager. The tipster will receive notification of every step being made until the ticket is closed. The reward amount will be based on the severity of the Special Magistrates ruling and will also be determined by the approximate amount dumped, per tonnage. The reward amount will be 25% of the total dumping fee (example 70.26 tonnage will cost the City $1,164.81, therefore the tipster will receive an award in the amount of $291.20). After the Special Magistrate makes the final determination, the Police Department will process and make the award. SECTION 4. ELIGIBILITY If an "Opa-locka, Keep It Clean" tip leads to an arrest and prosecution of an individual involved in an illegal dumping crime, then the provider of said tip may be eligible to receive a cash reward. The reward amount shall range from $50 up to $1,000, depending upon the nature of the crime and the significance of the information provided by the caller which ultimately led to a successful arrest of the violator. SECTION 5. NON -ELIGIBLE PARTICIPANTS Any person or persons who committed or were otherwise involved in the planning or commission of the crime of illegal dumping or, who at any time, harbored or concealed the person(s) responsible for the illegal dumping shall not be eligible to receive any reward from the "Opa-locka, Keep It Clean" program. SECTION 6. EMPLOYEES AND FAMILY MEMBERS OF EMPLOYEES PROHIBITED FROM PARTICIPATING IN THE PROGRAM Pursuant to this policy an employee shall not solicit or accept anything of value, including a gift, loan, contribution, reward, or promise of future employment based on an agreement that the vote, official action or judgement of the employee would be influenced thereby. The following policy shall be applied to all employees and violations thereof shall subject that employee to disciplinary action up to and including discharge. The definition of family members are as follows: Family or household member" means spouses, former spouses, persons related by blood or marriage, persons who are presently residing together as if a family or who have resided together in the past as if a family, and persons who are parents of a child in common regardless of whether they have been married.
