A RESOLUTION OF THE CITY OF LYNWOOD CITY COUNCIL APPROVING
AN AGREEMENT WITH PALADIN LAW GROUP® LLP ("PALADIN") FOR
PRO BONO INSURANCE ARCHAEOLOGY SERVICES IN LYNWOOD'S
BROWNFIELD AREAS
WHEREAS, City desires to utilize the services of an independent contractor
to provide consulting services to the City as set forth in the attached Scope of Work
(Exhibit A), specifically insurance archaeology for the recovery and usage of
unused insurance policies on contaminated properties; and
WHEREAS, Paladin specializes in identifying unused insurance policies
of past property occupants that may be responsible for existing contamination on
properties; and
WHEREAS, Paladin will seek to review insurance records of potentially
responsible parties ("PRPs") of contaminated sites within the City; and
WHEREAS, the discovery of responsible party's unused insurance
policies that still hold value may substantially leverage the cost of remediating
contaminated properties; and
WHEREAS, Paladin's main focus areas will be properties that have been
identified with high levels of contamination along Imperial highway/1-105 freeway
between Long Beach Boulevard and Alameda Street, SE 1-105/1-ong Beach Blvd;
and Alameda Triangle property; and
WHEREAS, Paladin represents that it is fully qualified to perform such
consulting services by virtue of its experience and the training, education and
expertise of its principals and employees; and
WHEREAS, Paladin shall conduct insurance archaeology investigations
pro bono.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The City hereby authorizes the discovery of unused
insurance policies (Insurance Archaeology) under the attached Agreement with
Paladin Law Group, LLP and hereby approves said Agreement, subject to
approval of Form by the City Attorney. Paladin Law Group, LLP will provide
services described herein pro bono.
Section 2. The City Council hereby authorizes the City Manager or his
designee to take necessary steps, including the execution of agreements and
other related documents with Paladin, subject to approval of Form of such
agreements by the City Attorney, to undertake the implementation of the all
related services under the attached Agreement and Scope of Work.
Section 3. This Resolution shall become effective immediately upon its
adoption.
