SUMMARY STATEMENT:
Mayor Bailey has requested that the Council discuss what constitutes a “lodge” as referenced in the McCall City Code 3.3.02 (attached). Mayor Bailey has asked for a status update regarding
the requirements for a Conditional Use Permit (CUP) and short term rentals referred to as a “lodge”. See the attached memo.
Staff has met on this issue and has determined that The Conifer Lodge is a large vacation rental, but is not unlike numerous other vacation rentals found throughout the City and Impact
Area. The Conifer Lodge is a large house for the neighborhood; however, it was not built to any commercial standards. Currently, the zoning or building codes do not regulate the number
of people occupying a dwelling. While McCall City Code does not include a definition of "lodge," its grouping with social hall and club as requiring a CUP in the land use table 3.3.02,
leads staff to conclude that a "lodge" within that provision of City Code means along the lines of the following definition (from Oxford Dictionary online): "a branch or meeting place
of an organizations such as the Freemasons." Staff discussed the idea of creating a standard for the number of occupants but ran into a number of issues such as violations of the Fair
Housing Act, family reunions, weddings, enforcement, etc.
It is staff’s opinion that the property does not need a CUP. To date the City has not regulated the land use associated with vacation rentals. From a staff perspective, we do not feel
that the City has the resources or tools to regulate this use. Currently there are approximately 170 Single family homes that are used for short term rentals. Several of those short
term rentals refers to themselves as a “lodge” and sleep as few as 7 and as many as 40. Attached are the websites for some of the rentals referred to as a “lodge” including the Conifer
Lodge.
