HomeMy Public PortalAbout2002-01 - AMENDMENT - ZONING MAPORDINANCE 2002- t AN ORDINANtCE AMENDING THE GREENCASTLE PLANNING AND ZONING ORDINANCE BY AMENDING THE ZONING MAP WHEREAS, the Plan Commission of the City of Greencastle, pursuant to the petition of DePauw University, has prepared this Ordinance to amend the Greencastle Planning and Zoning Ordinance by amending the zoning map; and WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this Ordinance on December 17, 2001, after timely notice of the hearing was given by publication in the Banner - Graphic, Greencastle, Indiana on December 7, 2001; and WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the following factors enumerated in I.C. 36 -7 -4 -603 in consideration of the Ordinance and determination of a recommendation to be made to the Common Council: 1. Comprehensive Plan; 2. Current conditions and the character of current structures and uses in each district; 3. The most desirable use for which land in each district is adapted; 4. The conservation of property values throughout the jurisdiction; and ;® 5. Responsible growth and development; and WHEREAS, the Greencastle Plan Commission has certified this Ordinance to the Common Council with a recommendation by a majority vote in favor of adoption; and WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factors enumerated in I.C. 36 -7 -4 -603 before acting on this Ordinance; and WHEREAS, the Common Council has determined that this Ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. NOW THEREFORE be it ordained and adopted by the Common Council of the City of Greencastle, Indiana, that: 1. The City of Greencastle Zoning Map, Chapter 10 -38 of the City of Greencastle Code is hereby amended by changing the Zoning classification for the following described real estate from R3 to C2, in accordance with I.C. 36- 7 -4 -614. Said real estate is described as follows: ® Part of Lots 197, 198, and 208 along with parts of vacated Center Street, Vine Street and Hill Street within the original plat of the town, now City, of Greencastle, Indiana as recorded in Plat Book 1 page 6 in the Office of the Recorder of Putnam County, Indiana, and more particularly described as follows: Commencing at the Northwest corner of Lot 198, being monumented by a 518 "rebarfound, thence South 89 degrees 52 minutes 31 seconds East (record bearing) 218 feet along the North lines of Lot 198 to the Northeast corner of Lot 198 and the Point of Beginning being monumented by a rebar found; thence continuing South 89 degrees 52 minutes 31 seconds East 264.4 feet along the North lines of Lot 198 extended and Lot 197 to the Northeast corner of Lot 197 being monumented by a cut "x" in the concrete; thence South 00 degrees 01 minutes 11 seconds East 147.30 feet along the East line ofsaid lot to its intersection the South line of with vacated Center Street; thence North 89 degrees 52 minutes 31 seconds West 208.83 feet along said South line; thence South 01 degrees 08 seconds 04 seconds East 0.96 feet; thence South 89 degrees 43 minutes 18 seconds West 54.00 feet; thence South 00 degrees 08 minutes 22 seconds West 79.05 feet; thence North 89 degrees 52 minutes 31 seconds West 140.51 feet; thence South 00 degrees 08 minutes 22 seconds West 149.34 feet; thence North 89 degrees 52 minutes 31 seconds West 79.50 feet to the West line of Lot 208; thence North 00 degrees 08 minutes 22 seconds East 269.73 feet along the West lines of Lots 208 and 198 to the North line of vacated Center Street; thence East 218 feel along said North line to the East line of Lot 198; thence North 107.3 feet along said East line to the Point of Beginning and containing 1.775 acres more or less. This Ordinance shall have full force and effect upon passage. The Clerk- Treasurer ofthe City of Greencastle is ordered to have this Ordinance published by inserting a copy of the Ordinance in each of the two (2) sets of the City of Greencastle Code, maintained on file for public inspection in the office of the Clerk- Treasurer.
