SUMMARY STATEMENT:
The City of McCall entered into an agreement (attached) with the property owner, Vicki Wade, of the McCall Mall on November 13, 2008 as a result for a trash enclosure approval and an
encroachment of the enclosure on City property.
The City and the property owner both agreed to complete a number of items within the agreement. There are still a number of items that have not been completed by the property owner and
the City has not completed the pathway items due to a lack of funding. Staff contacted the City Attorney about the issue since voluntary compliance and regular communication was not
working.
The City Attorney suggested a new agreement be drafted with timelines associated to the tasks. According to the Vicki Wade’s attorney, she has agreed to enter into a new agreement. The
City attorney will further explain status and provide legal recommendations to the City Council regarding the situation.
RECOMMENDED ACTION:
Provide staff direction on the next step for the City of McCall and McCall Mall agreement.
