AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, ADDING
SECTION 6- 6.8(A) OF THE LYNWOOD MUNICIPAL CODE RELATING TO
PIGGYBACKING ON PUBLIC WORKS CONTRACTS AND PURCHASES
WHEREAS, section 6 -6 8 of the Lynwood Municipal Code regarding the
purchasing of supplies, equipment, and contracting for professional services have not
been updated since 2005, and
WHEREAS, the City Council wishes to update and streamline the City
purchasing and professional services procurement procedures to increase efficiency,
cost effectiveness; and responsiveness; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That Section 6- 6.8(A) of this Chapter is hereby added in its
entirety.
6- 6.8(A) Exemptions from formal and informal bidding procedures and
purchasing authority limits: The provisions of this section 6 -6 requiring formal or
informal bids shall not apply when the City is able to secure a contract for a
public project through Piggyback procurement.
"Piggyback Procurement' shall mean, utilizing another public agency's contract or
agreement to obtain more advantageous prices and terms than can be otherwise
obtained on the open market.
A piggyback contract is available under which
1 Competitive bid procedures have already been utilized, for the supplies,
equipment, or services by any California city, county, school district, state, and
federal government or any of their respective agencies within twelve months, and
2. The supplies, equipment, or services are supplied to the city at the same or
better price as was obtained by the vendor via any California city, county, school
district, state, and federal government or any of their respective agencies using a
competitive bid procedure.
Section 2. If any sentence, clause, or phrase of this Ordinance is for any
reason held to be unconstitutional or otherwise invalid, such decision shall not affect the
validity of the remaining provisions of this Ordinance The City Council hereby declares
that it would have passed this Ordinance and each sentence, clause or phrase thereof
irrespective of the fact that any one or more sentences, clauses or phrases be declared
unconstitutional or otherwise invalid
Section 3. Any provisions of the Lynwood Municipal Code, or appendices
thereto, or any other Ordinance -of the City, to the extent that they are inconsistent with
this Ordinance, and no further, are hereby repealed.
Section 4. This Ordinance shall go into effect and be in full force and operation
from and after thirty days after its final passage and adoption.
Section 5. The City Clerk shall cause this Ordinance to be, published and if
appropriate, posted, as provided by law Within fifteen (15) days after the adoption of
this Ordinance, the City Clerk shall and shall post in the Office of the City Clerk a
certified copy of the full text of this Ordinance along with the names of those City
Council members voting for and against the Ordinance.
First read at a regular meeting of the City Council'held on the 6th day of December,
2011 and adopted and ordered published. at a regular meeting of said Council on 20th
day of December, 2011
