SUMMARY STATEMENT:
The property is under new ownership (NABIC, LCC) and the new owners would like to clarify the project’s remaining items to be completed and more accurately reflect project approvals
and as-built conditions. Therefore, Spink-Butler Attorneys at Law have prepared the attached Amended and Restated Development Agreement.
The McCall Area Planning and Zoning Committee held a public hearing on November 12, 2013 and unanimously recommended the proposed Amended and Restated Development Agreement for approval
to the City Council without a second public hearing.
Attached find:
1. Redlined original Development Agreement with explanations of changes.
2. Proposed Amended and Restated Development Agreement.
3. June 26, 2013 letter from City Engineer stating outstanding project conditions.
RECOMMENDED ACTION:
Approve the Granite Falls Condominium Amended and Restated Development Agreement and authorize the Mayor to sign all necessary documents.
