EMERGENCY ORDINANCE NO. 84 -6
AN ORDINANCE OF THE TOWN COMMISSION OF
THE TOWN OF GULF STREAM, FLORIDA,
PROVIDING FOR THE PROHIBITION OF
STORAGE OF MATERIALS ON THE ROOFS
OF BUILDINGS OR STRUCTURES LOCATED
WITHIN THE TOWN.
WHEREAS, the storage of materials upon the roofs of
structures or buildings located within the Town creates a hazard
to residents and other structures and buildings located within
the Town; and
WHEREAS, it is the desire of the Town Commission
of the Town of Gulf Stream to provide for the health, safety
and welfare of the residents of the Town by eliminating such
potential hazards;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, FLORIDA, as follows:
Section 1. The storage of materials of any kind
upon the roofs of buildings or structures located within the
Town is hereby prohibited.
Section 2. Temporary storage of materials for periods
of time not to exceed forty -eight (48) hours, which storage
is necessary for roof construction or roof repairs may be allowed
by permit granted by the Town.
Section 3. Each day a violation of this code continues
to exist shall be deemed a separate violation.
Section 4. Anyone found guilty of violating the
provisions of this Ordinance shall be penalized pursuant to
the provisions of the general penalty provisions of the Code
of Ordinances of the Town.
Section 5. If any section, paragraph, clause, phrase
or term of this Ordinance be declared invalid, the same shall
not operate to invalidate any other provisions.
Section 6. This Ordinance shall be codified and
made a part of the official Code of Ordinances of the Town
of Gulf Stream, Florida.
Section 7. This Ordinance shall become effective
immediately upon first and final reading as a genuine emergency
exists because of the fact that the Town is in the midst of
the hurricane season and there exists an immediate need for
the enforcement of the terms of this Ordinance.
