SUMMARY STATEMENT:
The City of McCall entered into an agreement (attached) with the property owner, Vicki Wade, of the McCall Mall on November 13, 2008 as a result for a trash enclosure approval and an
encroachment of the enclosure on City property.
The City and the property owner both agreed to complete a number of items within the agreement. In 2014, there were still a number of items not completed by the property owner and the
City. An extension was agreed upon to allow additional time for staff to further examine the situation and hopefully complete the remaining items. Multiple efforts were made to contact
the property owner with no or little response. The Parks Department designed and planted a screening barrier (funded by McCall Redevelopment Agency) between Legacy Park and the McCall
Mall.
Staff recommends that the City Council not extend the Agreement as little progress has been achieved with the current property owner, and the agreement provides a license agreement,
rather than an easement, for a public pathway. There currently is no City funding for this project.
RECOMMENDED ACTION:
Determine if the City Council would like to let the Addendum to Agreement between Vicki Wade, dba McCall Mall and the City of McCall expire.
