SUMMARY STATEMENT:
On 3 December, a draft contract was presented to City Council for receipt of initial direction regarding continued prosecutor services from Kiiha Law Office PLLC (Jay Kiiha). City Council
provided direction to return on 17 December with a contract for approval to continue prosecutor services with Kiiha Law Office PLLC. One change was made to the enclosed draft contract
which provides the prosecutor with access, at no cost, to law enforcement records from the Idaho Transportation Department for the sole purpose and use under services outlined in the
agreement. This additional provision is supported by the McCall Chief of Police.
Of additional note, following further discussion with Mr. Kiiha it is the recommendation to utilize the term of agreement within the draft contract which follows a fiscal schedule as
opposed to a calendar year schedule, which exists within the current prosecutor contract. The term of the agreement therefore remains the same as the first presentation on 3 December.
RECOMMENDED ACTION:
Approve the agreement for prosecutor services between the City of McCall and Kiiha Law Office PLLC, and authorize the Mayor to sign all necessary documents.
