SUMMARY STATEMENT:
There currently exists a City owned sewer main that transects the northeast corner of 800 Lakeside Avenue. This sewer main is currently located within a sixteen (16) foot wide sewer
utility easement that was granted to the City from the previous property owner. As part of the approval of ZON-15-01 (800 Lakeside Avenue), the City has required that the existing sixteen
(16) foot wide sewer utility easement be increased to twenty (20) feet wide. Twenty (20) feet is a more realistic width within which a repair/replacement project could occur without
impacting property outside the easement. This new easement document will provide the City with necessary rights to access the property to maintain the sewer infrastructure and ensure
that no future encroachments will occur that will jeopardize the operation of this sewer system.
Attached is a draft copy of the proposed easement agreement with two of the three required exhibits. The City Attorney and City Engineeer are finalizing the agreement and the easement
exhibits. Final versions of these documents with all necessary exhibits will be provided to the Council at the meeting.
RECOMMENDED ACTION:
Approve the easement agreement between the property owner and the City, and authorize the Mayor to sign all necessary documents.
