Pledge of Allegiance Affidavit of Posting Adjustments to the Agenda - None ORAL AND WRITTEN COMMUNICATIONS: None 1) Approval of the Minutes of the Regular Meeting of February 14, 2012. Recommendation: Approval of the Minutes of February 14, 2012 as presented. Motion by Commissioner Bennecke, Seconded by Commissioner Davis to approve the minutes of February 14, 2012 as presented. Vote: 5/0 2) Scheduled Matters/Public Hearings a. Appeal of the Denial of 11-APP-74, 196 E. 6th Street. Applicant: Cherry Tree Cottage/Robb Foskett Recommendation: Close the Public Hearing and Deny the Appeal and Uphold the staff denial of 11-APP-74. (Continued from January 10, 2012 and February 14, 2012). Staff report was given by Kyle Warsinski, Economic Development Analyst Close Public Hearing 6:12 p.m. Motion by Commissioner Bennecke, Seconded by Commissioner Smith to Approve the appeal with the condition that the CUP is revisited in two years for reconsideration. Vote: 5/0 b. Conditional Use Permit No. 12-CUP-02; A Conditional Use Permit for the Operation of a Class IV Kennel and Caretaker's Unit Located at 49 California Avenue. Applicant: David Castaldo Recommendation: Hold a Public Hearing and Approve Conditional Use Permit No. 12- CUP-02, based upon the findings, subject to the conditions of approval. What can the residents do? Staff explained that the residents can come into the City at anytime they feel that the conditions are not being met and ask that the city check into the situation. Motion by Commissioner Bennecke, Seconded by Commissioner Davis to approve Conditional Use Permit No. 12-CUP-02 as presented. Vote: 5/0 c. Second Unit Regulations (17.03.060D) Recommendation: Hold a Public Hearing and Direct staff on any amendments to the 17.03.060D "Guest Unit" recommended to the City Council. Staff report was given by Rebecca Deming, Planning Director Open Public Hearing 7:03 p.m. Speakers: Ann Connors - Neutral Closed Public Hearing 7:10 p.m. Motion by Commissioner Bennecke, Seconded by Commissioner Smith to recommend to City Council that there be a 1,200 sq. ft maximum or 50% maximum of original structure, for any second units and a 15 foot rear yard setback. Vote: 5/0 d. Conditional Use Permit No. 12-CUP-01, A request for an indoor paint spray booth located at "New Image Auto Body" at 153 E. 3'd Street. Applicant: Leslie E. Magness Recommendation: Hold a Public Hearing and Approve Conditional Use Permit No. 12- CUP-01, subject to the conditions of approval. Staff report was given by Chris Tracy, Associate Planner Open Public Hearing 7:26 p.m. Speakers: Leslie Magness -Applicant Close Public Hearing 7:28 p.m. Motion by Commissioner Davis, Seconded by Commissioner Salinas to approve Conditional Use Permit No. 12-CUP-01 as presented. Vote: 5/0 e. Two-Year Time Extension — Plot Plan No. 07-PP-16 and Mitigated Negative Declaration 07-MND-02, for an industrial building totaling 606,117 square feet located North of Fourth Street and East of Nicolas Rd. Applicant: CT Realty Investors. Recommendation: Approve a two-year extension of time for the approval of Plot Plan 07-PP-16 and Mitigated Negative Declaration 07-MND-17, which would expire June 10, 2014. Staff report was given by Chris Tracy, Associate Planner Open Public Hearing 7:34p.m. No Speakers Closed Public Hearing 7:34 p.m. Motion by Commissioner Smith, Seconded by Commissioner Davis to approve a two- year extension of time on Plot Plan No. 07-PP-16 and Mitigated Negative Declaration No. 07-MD-17 which will expire on June 10, 2014.
