Pledge of Allegiance Affidavit of Posting Adjustments to the Agenda: None ORAL AND WRITTEN COMMUNICATIONS: None 1) Approval of the Minutes of the Regular Meeting of May 8, 2012. Recommendation: Approval of the Minutes of May 8, 2012 as presented. Motion by Commissioner Bennecke, Seconded by Commissioner Davis to approve the Minutes of May 8, 2012 as presented. Vote: 5/0 2) Scheduled Matters/Public Hearings a. Conditional Use Permit No. 12-CUP-05, Request for Tattoo Parlor and Body Piercing Services "Living Canvas Tattoo and Body Piercing", Located at 800 E. Sixth Street Applicant: Edward Guillen Recommendation: Hold a Public Hearing and Approve Conditional Use Permit No. 12-CUP-05, subject to the conditions of approval. Staff report was given by Chris Tracy, Associate Planner Open Public Hearing 6:07 p.m. Speakers: Edward Guillen -Applicant Closed Public Hearing 6:09 p.m. Motion by commissioner Bennecke, Seconded by Commissioner Davis to Approve Conditional Use Permit No. 12-CUP-05, subject to the conditions of approval. Vote: 5/0 b. Conditional Use Permit No. 12-CUP-06, Request for Alcohol Sales for On- Sale Consumption at "Toluca's Mexican Food", Located at 892 Oak Valley Parkway, Suite E. Applicant: Jenero Jordan Recommendation: Approve Conditional Use Permit No. 12-CUP-06, subject to the conditions of approval. Staff report was given by Kyle Warsinski, Community Development Analyst. Open Public Hearing 6:12 p.m. Speakers: Jenero Jordan —Applicant Closed Public Hearing 6:13 p.m. Motion by Commissioner Davis, Seconded by Commissioner Bennecke to approve Conditional Use Permit No, 12-CUP-06, subject to the conditions of approval. Vote: 5/0 c. Two Year Planning Commission Review of 10-APP-10 for "R.G. Canning Productions, Inc." Outdoor Market and Swap Meet, Located at 1501 E. Sixth Street. Recommendation: Review the proposed project and extend the required improvements for an additional year. Staff report was given by Rebecca Deming, Planning Director Speakers: Timothy Ellis— in favor Motion by Commissioner Bennecke, Seconded by Commissioner Salinas to extend the required improvements for an additional 2 year period. Vote: 5/0 d. Revocation/Modification of Conditional Use Permit No. 11-CUP-08: a Conditional Use Permit for the Operation of a Church, Located at 451 Seventh Street. Recommendation: Hold a Public Hearing and Review the Conditional Use Permit and either amend the Conditions of Approval or Revoke Conditional Use Permit No. 11- CUP-08. Staff report was given by Rebecca Deming, Planning Director Open Public Hearing 6:34 p.m. Speakers: Susan Kelly— In favor of revocation/modification Michelle Allshouse - In favor of revocation/modification George Lopez— Pastor Opposed to revocation/modification Closed Public Hearing 7:20 p.m. Motion by Commissioner to Bennecke, Seconded by Commissioner Davis, to require all services/events to end by 8:00 p.m. with premises being cleared by 8:30 p.m., 7 days a week; no band and no amplification shall be used until such time that sound proofing can be put in place; Compliance of Condition 4.4 — removal of unpermitted structure at the front of the building; special events permits shall be obtained for all carwashes, yard sales, etc.; and the Conditional Use Permit shall return to the Planning Commission for review in a 6 month period.
