Pledge of Allegiance: Adjustments to the Agenda: None Director's Report: Update on Conditional Use Permit for Fumo Cigar Lounge PUBLIC COMMENT PERIOD: None 1) Approval of the Minutes of the Regular Meeting of August 13, 2013. Recommendation: Approval of the Minutes of August 13, 2013 as presented. Motion by Commissioner Bennecke, Seconded by Commissioner Wirick to approve the minutes as presented. Vote: 510 2) Scheduled Matters/Public Hearings a. Minor Variance No. 13 -MV -24 to Allow Additional Wall Signs at 525 Highland Springs Avenue (Wendy's Restaurant) Applicant: John Dodson Recommendation: Review the proposed additional wall signs; determine if the signs are of appropriate size, height and location; and Approve or Deny Minor Variance 13 - MV -24. Staff report was given by Rebecca Deming, Director of Planning Open Public Hearing 6:05 p.m. No Speakers Closed Public Hearing 6:05 p.m. Motion by Commissioner Bennecke, Seconded by Commissioner Dale to approve as presented. Vote: 510 b. Conditional Use Permit No. 13 -CUP -10, Request for Alcohol Sales for Type 41 — On -Sale Beer and Wine Sales at "Pizza N Pasta Lover" Located at 762 Beaumont Avenue Applicant: Olivier Preciado Recommendation: Hold a Public Hearing and Approve Conditional Use Permit No. 13 - CUP -10, Subject to the conditions of approval. Staff report was given by Kyle Warsinski, Community Development Analyst Open Public Hearing 6:14 p.m. Olivier Preciado - Applicant Rosemarie Salinas - Opposed Closed Public Hearing 6:23 p.m. Motion by Commissioner Tinker, Seconded by Commissioner Bennecke to approve Conditional Use Permit No. 13 -CUP -10 with the added condition that there is no alcohol to be taken off the premises. Vote: 510 C. Conditional Use Permit No. 13 -CUP -11, Request for Alcohol Sales for On - Site Consumption at "Victor's Restaurant and Bar" Located at 1620 E. Second Street Marketplace, Suite C. Applicant: Victor Rosetti Recommendation: Hold a Public Hearing and Approve Conditional Use Permit No. 13 - CUP -11, subject to the conditions of approval. Staff report was given by Kyle Warsinski, Community Development Analyst Open Public Hearing 6:27p.m. Victor Rosetti - Applicant Closed Public Hearing 6:28 p.m. Motion by Commissioner Wirick, Seconded by Commissioner Dale to approve Conditional Use Permit No. 13 -CUP -11, with the with the added condition that there is no alcohol to be taken off the premises. Vote: 510 d. Ordinance — Proposal to Amend Chapter 17.03 of the Municipal Code with Regards to Educational Establishments Recommendation: Receive Staff Report, Hold a Public Hearing, and Recommend to the City Council approval of the ordinance. Staff report was given by Rebecca Deming, Director of Planning Open Public Hearing 6:35 p.m. No Speakers Closed Public Hearing 6:35 p.m. Motion by Commissioner Bennecke, Seconded by Commissioner Tinker to recommend to the City Council consideration of the proposed ordinance, with the understanding that a policy will be put in place and return to the commission for review, for these types of condition use permit considerations. Vote: 5/0 e. Conditional Use Permit No. 13 -CUP -09 — "Hope Academy" Located at 240 Maple Avenue, Suite A Recommendation: Receive Staff Report, Open the Public Hearing, and Continue the Public Hearing to the Regular Meeting of November 12, 2013 at approximately 6:00 p.m. Staff report was given by Rebecca Deming, Director of Planning Open Public Hearing 7:04 p.m. No Speakers Motion by Commissioner Wirick, Seconded by Commissioner Bennecke to continue the public hearing to the regular Planning Commission Meeting of November 12, 2013.
