Although the proposed fenced enclosure is to the rear of two existing residential structures, the material would be visible from Conifer and Strawberry Lanes and visible to immediate neighbors. McCall City / Impact Area Code (MCC 3.8.10.D) states that the use of chain link fencing in any residential zone requires administrative approval by city staff prior to issuance of a building permit. McCall Design Guideline #29 states that “Fencing materials should be compatible with the materials and color of the surrounding or the prevailing building materials and color in adjacent developments. The use of natural materials is preferred, as opposed to chain link or plastic or other synthetic materials.” Since 2006, when the ordinance and Design Guidelines were adopted by City Council, no permanent chain link fences have been permitted by the City of McCall. On October 13, 2015, staff issued a letter of administrative determination to the Appellant stating that the use of chain link is not approved. The Appellant then appealed this decision to the McCall Area Planning and Zoning Commission. On December 1, 2015, the Commission held a public hearing and unanimously denied the appeal of staff decision.  RECOMMENDED ACTION: Hold the public hearing. Approve the attached Findings and Conclusions and authorize the Mayor to sign all necessary documents.  RECORD OF COUNCIL ACTION  MEETING DATE ACTION
