SUMMARY STATEMENT:
Bid submission deadline for 6 x 6 snow plow was June 2, 2016 @ 2pm. One timely, conforming bid was received from M-B Companies Inc. One bid was received from Legacy Equipment 15 minutes
past deadline and was returned unopened as required by bid procedure. A protest of award letter from Legacy Equipment was received June 8 stating a lack of responsiveness to bid questions
resulted in their bid arriving late. As of the time this agenda bill is written, we are still awaiting legal assessment of the risk of going forward with the bid as the complainant
delayed two weeks in downloading the specifications, the bid deadline had already been extended to a date of the complainant’s request, and the response time to the complainant’s question
was three business days after eliminating the Federal Holiday weekend.

RECOMMENDED ACTION:
Award contract for snow removal equipment to M-B Companies Inc and authorize the Mayor to sign all necessary documents.
OR
Reject all bids and authorize staff to rebid the project on the shortest timeline allowed under the statute.
