Lake, just south of Spruce Street ROW, see attached map) to release a sanitary sewer easement recorded as Instrument #22295 (attached). This sewer easement was granted by the owners of Lots 1 and 2 to the City in 1936 (see attached). Staff’s review indicates that this easement was likely for a sewer main that has since been abandoned. As City sewer mains exist both in E. Lake (downslope) and Mill Street (upslope of these parcels), the Department does not see any foreseeable need for this easement. Additionally, because the recorded instrument number does not include information pertaining to the “survey” (highlighted in yellow on the easement) it is unclear if the City or the property owner could properly prove the location that this easement is intended to exist. It is therefore recommended that Council consider releasing this unneeded and undefined easement, so that the property owners can move forward with an impending sale of the properties. This action will also facilitate future development of these lots. Included with this agenda bill is a Release of Easement that has been prepared by legal counsel to effectuate this action, once signed, and recorded with Valley County. The Release document is attached.  RECOMMENDED ACTION: Release the sanitary sewer easement identified as Instrument #22295 and authorize the mayor to sign all necessary documentation.
