SUMMARY STATEMENT:
The City of Driggs’ Mayor Johnson has requested a resolution from the McCall City Council in support of a proposed resort city restaurant liquor license legislation that would allow
all restaurants within the city limits of a resort city as defined in section 50-1044, Idaho Code, to have liquor by the drink license. These licenses would have some restrictions such
as:
Be a Full-Service Restaurant
At least sixty percent (60%) of its gross revenues must be comprised of non-alcohol sales
Serve liquor by the drink only during the hours that meals are served, except no liquor sales may be made before 5:00 p.m. or after 10:30 p.m.
Serve a maximum of three (3) drinks containing liquor per evening per customer ordering a full-course meal
Mayor Johnson would like to emphasize that he has received input from current license holders, legislators, enforcers, and several resort cities. Several provisions within the proposed
legislation are specifically due to requests by those parties.
At the previous Council meeting, staff was directed to seek input from local agencies regarding this proposal. Staff has forwarded the draft legislative language to potentially affected
organizations in McCall for input, and will provide responses from these agencies during this discussion, if received by 14 January.
RECOMMENDED ACTION:
Adopt Resolution 16-05 supporting the efforts to create a new class of liquor licenses which would allow restaurants in resort cities to serve mixed drinks with meals for their customers
while minimizing impacts to existing liquor license holders and authorize the Mayor to sign all necessary documents.
