AN ORDINANCE OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA, AMENDING SECTION 3 -1
AND SECTION 3 -6 OF THE CODE OF ORDINANCES
OF THE TOWN OF GULF STREAM TO PROVIDE THAT
PERSONS FOUND TO BE IN VIOLATION OF SAID
SECTIONS SHALL BE GUILTY OF A CIVIL INFRACTION
ONLY AND SHALL NOT BE SUBJECT TO CRIMINAL
PROSECUTION; PROVIDING FOR A FINE TO PERSONS
FOUND TO BE IN VIOLATION OF THE PROVISIONS
OF THE ORDINANCE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, FLORIDA, AS FOLLOWS:
Section 1. Sections 3 -1 and 3 -6 of the Code of Ordinances
of the Town of Gulf Stream are hereby amended to provide that
any person found to be in violation of the provisions thereof
shall not be subject to criminal penalties but shall be subject
only to a civil infraction and the payment of a fine in the
amount of twenty -five dollars ($25.00) for each occurrence for
which they are found to be in violation.
Section 2. An infraction for purposes of this ordinance
is a non - criminal violation which is not punishable by incarceration
and for which there is no right to a trial by jury or a right
to court - appointed counsel.
Section 3. Any person wishing to contest any fine
imposed under the provisions of this section may do so by appearing
in the County Court of Palm Beach County.
Section 4. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 5. This ordinance shall be codified and made
a part of the Official Code of Ordinances of the Town of Gulf
Stream, Florida.
Section 6. If any section, paragraph, clause, phrase
or term of this ordinance be declared invalid, the same shall
not operate to invalidate any other provisions.
Section 7. This ordinance shall be in full force
and effect from and after its passage and approval according
to law.
