Luwe, Alfred Nieyer This being the time and place of the regular monthly meeting of the Town of ti'�,'ellsburg whereat it was determined to make a final disposition of award of contracts for the construction of a Sewage Treatment Plant and Outfall Sewer in U��ellsburg, Towa. Councilman Lester Huisman introduced the following Resoly- tion and moved its adoption. Councilman Neil O'Kones seconded the motion t�O adopt. A11 of the South Sixteen (16) feet of Lots Four (ta.), Five (5), Six (6), Seven (7), Eight (8), Nine (9),Ten (10) and Eleven (11) in Block One (1) of Lindaman's First Addition to the Town of Wellsburg, Iowa, AND All of the West Sixteen (16) Feet of Lots Fourteen (14), Fifteen (15), Sixteen (16), Seventeen (17), Eighteen (18) and Nineteen (19) in Block One (1) of Lindaman's Anne:c No. 1 adjacent to West Jackson Street, Town of Wellsburg, Grundy County, Iowa, and such acquisition be of substance in the following form, to -wit: THIS AGREE �1T, made this day of July, 1958, by and between party of the first part, and the Town of Wellsburg, a muncipal corporation of the State of Iowa, party of the second part, WITNESSETH: The party of the first part, grantor, in consideration of the sum of Dollars, receipt of which is hereby acknowledged, does here- by grant, bargain, sell and convey .to the party of the second part, grantee, its successors, and assigns, the perpetual right to enter and erect, construct and maintain outfall sewer lines, together with the standard manhole installa- tions, sewer tiles, concrete, precast concrete, bars, anchors and appurtenances thereto, for the transmission and conveyance of the Town sewage along, under, through and across the following described land in the County of Grundy, State of Iowa, to -wit: The grantee shall have the right of ingress and egress to and from said land to survey, erect, install., construct, maintain, inspect, rebuild and re- pair its outfall sewer lines, together with the right to replace, renew and relocate them under and through its right of way, all sewage tile, manholes and appurtenances thereto and the right to remove any or all of said in- stallations or appurtenances. The grantee may erect, maintain and use gates in all fences which cross or which shall hereafter cross the route of said lines. Grantee may trim, cut and clear away any trees, brush, crop or other vegetation on or adjacent to above described land whenever the same will impede, interfere with or endanger the construction, operation and maintenance of said lines. The grantee shall use existing roads or lanes and shall repair any damage caused by its use thereof; however, if no suitable means of access to the said right of way exists the grantee may enter the lands of the grantor wherever nec:�ssary to provide access to and from the above described right of way. If the grantee shall cut orremove trees, vegetation or agricultural crops under the rights hereby granted they shall continue to be the property of the grantor if the same are of .any value, but all other trees or vegetation shall be burned or removed by the grantee. The grantor, his heirs, assigns or successors, may cultivate, use and enjoy the 1 and over said outfall sewer lines, provided such use shall not, in the judgment of the grantee, interfere with or endanger the constructioh, operation or maintenance of said outfall sewer lines. The grantee, its successors or assigns, agrees to pay for any and all permanent damage caused to land, growing crops, fences, livestock, machinery or other personal property of said grantors from the construction, operation or maintenance of said lines. 19 This easement conveyance shall run with the land and shall be binding upon the grantor, his, her or their heirs or its successors and assigns. The said grantee to have and to hold the same, together with all appurtenances and immunities thereunto belonging or in any way appertaining unto the said Town of Wellsburg, an Iowa corporation and unto its successors and assigns, forever. IN WITNESS WHEREOF, the parties herein have set their hands or caused the signature of its President and Secretary and caused the signature of its Mayor and Clerk and its corporate seal to be affixed this day of July, 1958.
