SUMMARY STATEMENT:
As discussed with the Council, existing agreements with landowners for disposal of recycled water will terminate at the end of January 2017. City and PLRWSD staff have coordinated for
an extension of these agreements to allow for continued disposal of recycled water on these properties until December 1, 2018. This extension will allow for execution of a ballot measure
in May of 2017 and tentative construction of a new pipeline in 2017/2018 before the new and permitted system is online for the irrigating season of 2019.
Attached are agreement extensions for Nissula, Purdom, Maki, and Norwood Ranch LLC (Cruzen Ranch). The Fairbrother Ranch has declined the offer to extend under this agreement and will
pursue use of fresh water. The attached agreements provide sufficient capacity to support our disposal needs for the 2017 irrigating season. The extensions were drafted by John Hucks
(legal counsel to PLRWSD) and Bill Gigray (from White Peterson).
Staff will provide an update on the final extension component, easement extensions with Simplot Corporation, during presentation of this agenda bill.
RECOMMENDED ACTION:
Approve the Extensions of Water User and Supply Agreements between the City of McCall and Thomasine Nissula, Kenneth R. Purdom II, Will Maki, and Norwood Ranch LLC, and authorize the
Mayor to sign all necessary documents.
