HomeMy Public PortalAbout2002-07-30 Special Meeting66 COUNCIL MINUTES SPECIAL MEETING — JULY 30. 2002 The Special Meeting of the Bal Harbour Village Council was held on Tuesday, July 30, 2002, in the Council Chambers, at Bal Harbour Village Hall. The meeting was called to order at 7:13 p.m. by Mayor Berlin. The roll was called and those present were: Also present: Mayor Howard J. Berlin Assistant Mayor Daniel Tantleff Councilman Seymour "Sy" Roth Alfred J. Treppeda, Village Manager Jeanette Horton, Village Clerk Ellisa Horvath, Deputy Village Clerk Michael Popok, Village Attorney Absent: Councilman Peg E. Gorson As a quorum was determined to be present, the meeting commenced. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Bal Harbour resident Joel S. Jacobi. 3. OATH OF OFFICE — COUNCILMAN JOEL JACOBI: The Oath of Office was given to Councilman Joel S. Jacobi by Mrs. Horton. Mayor Berlin advised that the open meeting has been concluded. The time was 7:23 p.m. 4. EXECUTIVE SESSION: Mayor Berlin stated that the Council is going to have an Attorney/Client Session, in accordance with Florida Statute 286.011(8), concerning the pending litigation of Village versus William Welsh, Case Number 02- 10212CA4, Miami -Dade Circuit Court. He advised that the session is estimated to last 15 minutes and the following people will be in attendance at the meeting: Mayor Howard J. Berlin Assistant Mayor Daniel S. Tantleff Councilman Joel S. Jacobi Councilman Seymour "Sy" Roth Alfred J. Treppeda, Village Manager Michael S. Popok, Village Attorney The proceedings were recorded by a Certified Court Reporter. At the conclusion of all litigation discussed, the transcript will be filed with the Village Clerk. All those individuals, who were not named, left the room at this time. Mayor Berlin announced that the Council is back in an open meeting. He explained that the Attorney/Client Session has been terminated and members of the general public are invited back into the Council Chambers for any further proceedings or matters. Treppeda, Village Manager Jeanette Horton, Village Clerk Michael Popok, Village Attorney Mayor Berlin advised that the Council would like the Village Attomey to examine this ordinance as it currently exists, to see if there are ways to tighten it, so that it is more effective in enforcement. In particular, the Council would like the Village Attomey to recommend, at the September Council meeting, additional language that will allow the Village to enforce the removal of any dog, from any household, that has been determined to be a dangerous dog, under Dade County law, regardless of the number of dogs that the household has. He advised that he is concerned about that because someone could replace the dog, if they are underneath the limit, which would put the Village back into the same situation. Mayor Berlin would like the Attorney to effectively block that from happening, if there is a way. Mr. Popok will investigate that. Mayor Berlin clarified that the Village would like some teeth for enforcement. He would also like to know the cost for insurance to cover pets. Mr. Popok will look into a provision, where homeowners would be required to show proof that they have sufficient homeowner's insurance, to cover pets in order to keep the dog. S. OTHER BUSINESS: Mr. Treppeda discussed the problem with weeds on the beach and reported that they have taken over some of the beds. He explained that it is beyond the capabilities of the Village's Public Works Department, so he would like to bring in some outside help, which he started doing on Monday. Mr. Treppeda advised that the Village was able to ride on a bid that Aventura did, with Luke's Landscaping Company. He reported that it will include 5 laborers ($18.00 each per hour) and 1 supervisor ($27.00 per hour). Mayor Berlin questioned how this will be prevented in the future. Mr. Treppeda explained that he is including, in the next budget, funds to bring a company like Luke's in every other month, or whatever it takes. Robert Wheldon, Public Works Director, advised that the plants were slow to grow and the weeds didn't need all the water that the plants did, so they began to thrive. He reported that the vines are taking over the Sea Grapes and the other hedges, and the weeds are taking over the Sea Oats and smaller Buttonwoods. Mr. Treppeda advised that he is using Bill O'Leary, Landscape Architect, who wasn't involved with the project, because he wanted an objective third party. He reported that Mr. O'Leary mentioned that the company could have required sterilized soil for the project, which they didn't. Mr. Treppeda stated that probably would have prevented a lot of weeds that were brought in with the new plants. He explained that as they are pulling the weeds, they are putting a chemical down, which should stop the cycle of the weeds. Mayor Berlin advised that the Village doesn't want an embedded cost to do this every two months forever. Mr. Wheldon advised that they are experimenting to see how long it will take to do the entire beach and how often they will have to do it. Mayor Berlin questioned if there is any responsibility, on the part of the people who put this in. Mr. Treppeda stated not for maintenance, but he can investigate to see if there would be for having weeds in the soil when they planted. He will speak with Mr. O'Leary regarding that. The Council discussed the plaque for the Beach Master Plan. It was the consensus of the Special Council Meeting 07/30/2002 2 68 Council to have it in October/November when more people are in town. Mr. Treppeda reported that the shade structure will be permitted tomorrow and installed ten days from that. Mr. Wheldon advised that the weeds have killed some of the plants already. He explained that, as they are weeding, they will be trying to move the sea oats in an area to save them. Mr. Treppeda stated that the plants right behind the buildings are doing well; it's mostly the large beds of sea oats. 6. ADJOURN: There being no further business to come before the Council, a motion was offered by Assistant Mayor Tantleff and seconded by Councilman Jacobi to adjourn. The motion carried unanimously (4-0), with Councilman Gorson absent, and the meeting adjourned at 7:52 p.m. Mayor Howard J.
