SUMMARY STATEMENT:
This is a request for the McCall City Council to remove the following deed restrictions on Lot 3, Block 1 of Fairway:
Structure setback of at least 50’from the north property line (adjoin the McCall Municipal Golf course.)
Residential structure minimum of 1,000 sq. ft in living area and only one story in height.
These deed restrictions were recorded in 1968 and there is no public benefit in having these restrictions in place anymore. The process for releasing these restrictions is a quitclaim
deed that requires City Council approval.
The City Attorney has reviewed the attached quitclaim deed documents that were prepared by First American Title. The request was brought to the City, because the lot is under contract
given that the restrictions are removed.
RECOMMENDED ACTION:
Approve the Quitclaim deed for Paul V. Hakes on Lot 3, Block 1 of Fairway Subdivision and authorize the Mayor to sign all necessary documents.
