HomeMy Public PortalAboutResolution 67-255 PC-ARESOLUTION NO. 67- 255PC -A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING CONDITIONAL USE PERMIT NO. 67 -217. The Planning Commission of the City of Temple City does resolve as follows: SECTION 1. That the Planning Commission does hereby find, deter- mine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, 'located at 4906 Encinita Avenue, in said City, more particularly described as Lots 11 and 12, Parcel 11, Tract No. 1238, Book 17, page 196 of Maps in the Office of the County Recorder, Los Angeles County, have heretofore filed an application for a Conditional Use Permit to allow a breeding dog kennel operation in an M -1 zone. (b) That the Planning Commission conducted a duly noticed public hearing on such application; that said hearing was duly closed; and (c) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each member 0 of the Commission being familiar with the proposed site, said Commission determines that the facts required by the Temple City Zoning Ordinance. were present and therefore the Conditional Use Permit application should be granted. SECTION 2. That the Conditional Use Permit application, herein - above described be and the same is hereby granted subject to the follow- ing conditions: (a) Place a deposit or bond in an amount sufficient to guarantee installation of curb, gutter, sidewalk, driveway approach and street trees as specified by the Director of Public Works. (b) Erect a concrete block wall 6 ft. in height around the kennel structures starting 49 ft. from the front property line and along 90 ft. of the northerly and southerly boundaries of the subject area. This wall to be erected within 60 days from the date of approval of this applica- tion. 1 1 • (c) Utilize view - obscuring partitions to enclose the individual kennel runs and exercise yards in the event that upon in- spection by the City it is the determination of the inspect- ing agency that such will aid in noise supression. (d) Conduct kennel operations within a wholly enclosed and sound- proofed building, except for exercise yards and runs. (e) Provide and maintain all structures and buildings intended for the housing of animals so as to prevent the escape there- from of animals. (f) Provide and maintain in all kennel runs and exercise yards concrete flooring with adequate drainage. (g) Provide and maintain proper ventilation, lighting and sanita- tion facilities in all kennel buildings and structures. (h) Provide sufficient accomodations in all animal housing cages and kennel runs to prevent overcrowding (the cages should be 12" longer than the length of the dog and 6'r higher than the height of the dog). (i) Clean all exercise yards and kennel runs at least once a day and store droppings in suitable metal covered con- tainers which shall be removed from the premises no less than twice a week. (j) All buildings and structures utilized in the kennel opera- tion shall be operated and maintained in such a manner as to eliminate excessive noise, and offensive odors emanat- ing therefrom. (k) All animals utilizing the kennel facilities shall be kept in enclosed shelters between 9 :00 P.M. and 7:00 A.M. of any day. (1) Obtain all required building permits for past and present work immediately and complete all work within 60 days. (m) Provide two additional off - street parking places. (n) That the property be developed substantially as Exhibit "A attached to the application. (o) This Conditional Use Permit shall expire and be of no effect: un less :exercised :within a :period of one year from and after the date of adoption of this resolution. (p) Applicant shall file, or cause to be filed, with the City Clerk a document which the City may record, which shall acknowledge that the owner of the Subject Property is aware of and accepts the conditions set forth in paragraphs (a) through (o) above, and that the Subject Property, re- gardless of any change in ownership, is bound by and sub- ject to the provisions of this Resolution and the conditions contained therein. SECTION 3. The Secretary shall certify to the adoption of this Resolution.
