A RESOLU'T'ION OF THE CITY COUNCIL OF THE; CITY OF
LYNWOOD DETERMINING THE PREVAILING RATE OF PER
DIEM WAGES FOR CONTRACTS FOR PUBLIC WORKS
THE CITY COUNCIL OF' THE CITY OF LYNWOOD DOES RESOLVE:
WHEREAS, the staff of the City of Lynwood has submitted to this City
Council recommendations for the determinations of the prevailing rate of per
diem wages in the City of Lynwood and surrounding territory for work to be
performed under the contracts of public work; and,
WHEREAS, Section 1773 of the Labor Code of.the State of California,
as amended by Statutes of 1968, Chapter 699, required the body awarding
any contract for public work to ascertain the general prevailing rate of per
diem wages in the locality in which the public work is to be; performed, and
further provides that in lieu of specifying the prevailing rate of per diem
wages in the call for bids for such contracts, the awarding body may refer
to copies of such prevailing rates on file at its principal office, and in such
event must publish its determination of such prevailing rates in a newspaper
of general circulation at least once during each year; and,
WHEREAS, the City Council of the City of Lynwood has ascertained
and considered the rates and data referred to in said Section 1773;

NOW, THEREFORE, the City Council of the City of Lynwood does
resolve:
1. Said City Council does hereby determine and establish the
general prevailing rate of per diem wages for each type of craft, classi-
fication, or type of work involved in the execution and /or performance
of work under contracts for public wort: in accordance with the following
schedule which is designated as "PREVAILING WAGE SCALE" and attached
hereto as Exhibit "A ".
2. The City Clerk of the City of Lynwood is authorized and dir-
ected to file a copy of this resolution, and of Exhibit "A" hereto, at least
annually with the Director of Industrial Relations of the State of California
and to cause a copy thereof to be published in 'a newspaper of general
circulation at least once during each fiscal year, as provided in Labor
Code Sections 1773 and 1773. 3.

PREVAILING WAGE SCALE
The City Council of the City of Lynwood has ascertained the pre-
vailing rate of per diem wages in dollars, based on a working day of eight
hours, for each craft or type of workman or mechanic needed to execute
any construction contract which may be awarded by the City Council to be
as follows and as detailed below.
Except as otherwise specifically provided for painter classifications,
the rates of per diem wages for each of the various classifications of work
shall be the hereinafter set forth prevailing rates of hourly wages plus
o
the hourly equivalent of any employer payments for health and welfare,
pension, vacation and similar purposes multiplied by eight. Eight hours
shall constitute a day's work; it being understood that in the event that
workmen are employed less than eight hours per day their per diem
wages shall be determined to be that fraction of the per diem wages herein
established that the number of hours of employment bears to eight hours.
APPRENTICES
May be employed in conformity with Sections 1777. 5 and 1777. 6
of the California Labor Code.
RIGGERS
Same wage scale as craft to which rigging is incidental.
WELDERS
Same wage scale as craft to which welding is incidental.
FOREMEN
All foremen not herein separately classified shall be paid not
r less.than 25 cents per hour more than the hourly equivalent of
the daily rate of the highest classification in which lie has super-
vision in the six Basic Trades.

Sec. 1775 Forfeiture for paying less than prevailing rate:
The Contractor shall forfeit twenty -five dollars for each
calendar clay, or portion thereof, for each workman paid less
than the stipulated prevailing rates for any public work done
under the contract by him or by any subcontractor under him.
Provided that overtime, rates, rate of pay for Saturdays,
Sundays and Holidays shall apply to those holidays as recognized
in the collective bargaining agreement applicable to the particu-
lar craft classification or type of workman employed on the
project.
Provided that notwithstanding the general provisions
contained herein, Guards and Watchmen shall be paid one and
one -half times the prevailing rate of overtime. Overtime
shall be time worked in excess of eight hours per day or forty
hours per week and the straight prevailing rate for time worked
on Saturdays, Sundays and where such time does not constitute
overtime.
