SUMMARY STATEMENT:
A Conditional Use Permit (CUP-10-02) was approved on May 27, 2010 with conditions of approval for the property located at 324 W. Lake Street (formerly the Alpine Pantry). Over the past
7 years, staff worked extensively to try to get the business owner, Gabriela Hess, to complete the project. Now the business owner who has the CUP is also the property owner and is
leasing the space to a new business. Since there is still outstanding conditions, a Deferred Infrastructure Agreement with the associated financial guarantees was developed to ensure
the improvements are completed by October 1, 2018. This allows the new business to open and operate even though the conditions of the CUP have not been met.
The Deferred Instructure Agreement and signed Conditional Use Permit CUP-10-02 are attached.
RECOMMENDED ACTION:
Approve the Deferred Infrastructure Agreement for 324 W. Lake Street and authorize the Mayor to sign all necessary agreements.
