One issue the project team has identified is the City’s paved pathway that exists along the abandoned Short Line Railroad Right-of-Way and the eastern boundary of the MDSD High School property is partially constructed within the MDSD High School property. Staff determined a formal easement agreement needed to be established to validate the City’s authority to continue to use and maintain the pathway including snow removal, storage and any underground public utilities the City deems appropriate to be located within the easement limits. On March 13, 2017, the MDSD Board authorized the District’s Superintendent and MDSD legal counsel to work with the City to draft and execute the easement agreement. Attached is the proposed easement agreement (which includes exhibits depicting the location of the easement) that has been prepared by the City’s legal counsel.  RECOMMENDED ACTION: Approve the Railroad Recreational Pathway, Snow Storage and Public Utilities Easement and authorize the Mayor to sign all necessary documents.
