ORDINANCE 2002-
AN ORDINANCE APPROVING THE VACATION
OF ALLEYS AND RIGHTS OF WAY
LOCATED NEAR EAST STREET AND UNION STREET
WHEREAS, Shannon McCullough is the owner of certain real estate located in the area
under jurisdiction of the Common Council of the City of Greencastle; and
WHEREAS, there are certain public ways contiguous to and contained within said real estate;
and
WHEREAS, the abutting land owners of the property wherein the public ways lie are as
follows:

WHEREAS, all public ways to be vacated lie wholly within the jurisdiction of the Conunon
Council of the City of Greencastle, Indiana; and
WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at its regular
meeting held September 23, 2002, approve the petition of the Shannon McCullough for the vacation
of certain public streets, alleys and rights of way located in the city of Greencastle, Indiana; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, pursuant to law,
published notice that this matter would come before the common council for a public hearing at the
regular meeting of the Common Council to be held Tuesday, October 8, 2002, at 7:00 p.m. at the
Greencastle City Hall, One North Locust Street, Greencastle, Indiana; and
WHEREAS, the adjoining property owners have consented to, or have been notified pursuant
to statute, as to the vacation of the public ways; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, has, after public
hearing, determined that vacating the following described public ways is in the public and economic
interest of the City of Greencastle, such closing will not reasonably interfere with the flow of traffic
for the City of Greencastle road system, and that the relief requested in said petition should be
granted, and that the portion of the described public ways located in the City of Greencastle, Indiana,
should be vacated.
NOW THEREFORE be it ordained by the Common Council of the City of Greencastle,
Indiana, that the following public streets and alleys located in the City of Greencastle, Putnam
County, Indiana, and more particularly described as follows:
Situate in the State of Indiana, County of Putnam and being a part of Silvers Survey
to the Town (now City) of Greencastle, Indiana as recorded in Plat Book 1, page 192
in the office of the Recorder of Putnam County, Indiana, more particularly described
to -wit:
® East Street
Beginning at the Northeast corner of Lot 5, Block 3 in Silvers Survey as recorded in
Plat Book 1, page 192 in the office of the Recorder of Putnam County, Indiana;
thence South 469.0 feet with the West right -of -way line of East Street to the
Southeast corner of Lot 5, Block 4 in said Silvers Survey; thence East 20.0 feet to the
East right -of -way line of East Street; thence North 469.0 feet with said East line;
thence West 20.0 feet to the point of beginning, containing 0.22 of an acre, more or
less.
Center Street
Beginning at the Southeast comer of Lot 5, Block 3 in Silvers Survey to the Town
(now City) of Greencastle as recorded in Plat Book 1, page 192 in said Recorder's
office; thence South 40.0 feet to the Northeast corner of Lot 4, Block 4; thence West
82.62 feet, more or less, to the West line of real estate conveyed to J. Shannon
McCullough as recorded in Instrument # 2002006917 in said Recorder's office;
thence North 40.0 feet with said West line; thence East 82.62 feet, more or less, to
the point of beginning, containing 0.08 of an acre, more or less.
Alley
Beginning at the Southeast corner of Lot 4, Block 4 in said Silvers Survey; thence
South 12.0 feet to the Northeast corner of Lot 5, Block 4; thence West 16.62 feet,
® more or less, to the West line of said McCullough tract; thence North 12.0 feet;
thence East 16.62 feet to the point of beginning, containing 0.005 of an acre, more or

are hereby vacated as a public right of way of the City of Greencastle, Putnam County, Indiana, and
that such land shall cease to be a public street, alley or right of way, and that title to such vacated
land shall revert to the landowner pursuant to law.
This Ordinance shall have full force and effect of law immediately upon its passage by the
Common Council of the City of Greencastle, Indiana.

This Ordinance vacates public right of way in the City of Greencastle along segments of East
Street and Center Street.
