A CAPITAL PROJECT AUTHORIZING RESOLUTION OF
THE VILLAGE COUNCIL OF THE VILLAGE OF KEY
BISCAYNE, FLORIDA, APPROVING MUSCO SPORTS
LIGHTING, LLC FOR THE PURCHASE AND
INSTALLATION OF A LIGHTING SYSTEM AT KEY
BISCAYNE K-8 CENTER; PROVIDING FOR
AUTHORIZATION; PROVIDING FOR
IMPLEMENTATION; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to Section 3.07(b) of the Village Charter, the Village Council desires
to authorize the expenditure of Village funds for the capital project consisting of the purchase and
installation of a lighting structure system at the Key Biscayne K-8 Center ("Lighting System"); and
WHEREAS, the Village may, pursuant to Section 2-86 of the Village Code of
Ordinances (the "Village Code"), enter into bids or contracts entered into by another
governmental authority, provided that the governmental authority has gone through a
competitive bidding procedure leading to the award of the bid or contract in question; and
WHEREAS, the Village Council desires to purchase the Lighting System from Musco
Sports Lighting, LLC ("Musco") based upon the Clay County RFP# 13/14-8 (the "Clay County
Bid"), which was awarded on February 11, 2014; and
WHEREAS, Musco has agreed to provide the Village with the same or better pricing and
terms as provided in the Clay County Bid for the Lighting System; and
WHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted
and confirmed.
Section 2. Approval. That the Village Council hereby approves Musco for the
purchase and installation of the Lighting System for the Key Biscayne K-8 Center.
Section 3. Authorization. That the Village Council hereby authorizes the Village
Manager to purchase the Lighting System from Musco at a cost not to exceed $332,500.00. The
terms of the purchase and installation of the Lighting System shall be the same or better than
what was provided in the Clay County Bid, which is attached as Exhibit "A."
Section 4. Implementation. That the Village Manager is authorized to take any
necessary action to implement the purposes of this Resolution.
Section 5. Effective Date. That this Resolution shall be effective immediately upon
adoption hereof.
