Home My Public Portal About205CITY OF MEDINA ORDINANCE NO. 205 AN ORDINANCE AMENDING ORDINANCE NUMBER 167 REGULATING OVERWEIGHT VEHICLES THE CITY COUNCIL OF THE CITY OF MEDINA DOES ORDAIN AS FOLLOWS: SECTION I: Ordinance Number 167 is amended by deleting the material which is stricken and by adding the material which is underlined. 3.01. Administrative Control. The Road Authority and Local Authority as used herein shall be the Bireeter Supervisor of Public Works of the City of Medina, who is hereby empowered to require permits, surety bonds, insurance contracts, permit fees and all other administrative procedures authorized hereunder. 4.01. Permit Fees. The Greeter Supervisor of Public Works shall require payment of a fee e€ $+8799 for the issuance of any Permit hereunder. - in an amount equal to $25.00 for each ton by which the maximum allowable load per axle exceeds the maximum load per axle specified by law for the street or road being traveled, up to a maximum of nine tons gross weight per axle. Such permits shall be issued upon good cause being shown as required by law, provided that good cause shall be related to the health, safety or welfare of the public or any member thereof. 5.01. Penalties. It shall be unlawful for any person to move a building, structure or motor vehicle upon any street, road, or highway within the City of Medina when such building, structure, or motor vehicle is not in compliance herewith, is not in compliance with any permit issued here- under, or without first obtaining a proper permit therefore. Any violation of this Ordinance for failure to comply with the terms of any permit issued hereunder shall result in automatic cancel- lation of the permit violated and, for the purpose of any civil or criminal penalty prescribed by law, weight calculations shall be made without reference to the canceled permit. Any person violating this Ordinance, upon conviction therefore, shall be pun- ishable by a fine not to exceed $500.00 or by im- prisonment not to exceed 90 days, or both. SECTION II: This ordinance becomes effective upon its adoption and publication. Adopted by the City Council of the City of Medina this 15th day of March , 1983.
