ORDINANCE N0. 493 AN ORDINANCE OF THE CITY Or LY1\1Wd00D REGULATING TRAFFIC UPON THE'PUBLIC STREETS AND REPEALING ORDINANCES NOS. 404 AND 436, AND ALL OTHER OR- DI1NANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. follows: 0 The City Council of the City of Lynwood does ordain as ARTICLE I DEFINITIONS Section 1: Definitions of Words and Phrases. (a) The following phrases when used in this ordinance shall for the purpose of this ordinance have the meanings respectively ascribed to them in this article. 9 (b) Whenever any words or phrases used in this ordinance are not defined herein, but re now or hereafter defined in the vehicle code of this State, such definitions are incorporated herein and shall be deemed to apply to such words and phrases used herein as though set forth herein in full. Section 2: Alley Any unnamed street less than 25 feet in width between property lines. Section 3: Central Traffic District All streets and por- tions of streets within the entire corporate boundaries of the City of Lynwood shall be deemed within the central traffic,district. Section 4: Loading Zon e. The space adjacent to a curb re- served for the exclusive use of vehicles during the loading or un- loading of passengers or materials. Section 5: Official Time Standard Whenever certain hours are named herein, they shall mean standard time or daylight saving time as may be in current use in this city. Section 6: Official Traffic Control Devices. All signs, signals, markings and devices not inconsistent with this ordinance placed or erected by authority of a public body or official having jurisdiction for the purpose of regulating, warning, or guiding traffic. Section 7: Official Traffic Signals Any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and proceed and which is erected by authority of a public body or official having ,jurisdiction. Section 8: Park To stand or leave standing any vehicle, whether occupied or not, otherwise than temporarily for'the purpose of and while actually engaged in loading or unloading of passengers or materials. Section 9: Parkway That portion of a street other than a roadway or a sidewalk. Section 10: Passenger Loading Zone The space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers. Section 11; Pedestrian Any person afoot. Section 12: Person Every natural person, firm, copartner- ship, association, corporation, street car company, or interurban railroad company. Section 13: Police Officer Every officer of the police department of this city. Section 14: (a) Stop When required means complete cessation movement. (b) Stop or Stand When prohibited means any stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device. Section 15: Street Car A car other than a railroad train for transporting persons or property and operated upon rails within any part of the City of Lynwood. The term "Street Car" whenever used in this ordinance shall include interurban car. Section 16. Traffic Pedestrians, ridden or herded animals, vehicles, street cars and other conveyances either singly or together -2- while using any street for purposes of travel. ARTICLE II TRAFFIC ADMINISTRATION Section 30: Police Administration There is hereby estab- lished in the police department of this city a traffic division to be under the control of an officer of police appointed by and directly responsible to the chief of police. Section 31: Duty of Traffic Division It shall be the duty of the traffic division with such aid as may be rendered by other members of the police department to enforce the street traffic regula- tions of this city and all of the state vehicle laws applicable to street traffic in this city, to make arrests for traffic violations, to investigate traffic accidents and to cooperate with all officers of the City in the administration of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties specially imposed upon said division by this ordinance and the traffic ordinances of this city. Section 32: Traffic Accident Reports The traffic division shall maintain a suitable system of filing traffic accident reports. Accident reports or cards referring to them shall be filed alphabetically by location. Section 33: Chief of Police The Chief of Police of the City of Lynwood shall exercise the powers and duties as provided in this ordinance and in the ordinances of this city. It shall be the general duty of the Chief of Police so far as his duties under this ordinance are concerned, to determine the installation and proper timing and maintenance of traffic control devices and signals, to con- duct or cause to be conducted engineering analyses of traffic acci- dents and to devise remedial measures to conduct engineering investi- gation of traffic conditions and to cooperate with other city officials and civic bodies in the development of ways and means to improve traffic conditions and generally to supervise the enforcement of this ordinance. -3- ARTICLE III ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS. Section 50: Authority of Police and Fire Department Officials (a) It shall be the duty of the officers of the Police Department and such officers as are assigned by the Chief of Police, to enforce all provisions of this ordinance, all street traffic laws of this city, and all of the State vehicle laws applicable to street traffic in this city. (b) Officers of the Police Department and such officers as are assigned by the Chief of Police are hereby authorized to direct all traffic by voice, hand or signal in conformance with traffic laws, pro- vided that in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the Police Department traffic may direct as conditions may require, notwithstanding the provisions of the traffic laws. (c) Members of the Fire Department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. I Section 51: Required Obedience to Traffic Ordinance It is a misdemeanor for any person to do any act forbidden or fail to perform any act required in this ordinance. Section 52: Obedience to Police and Fire Department.Officials No person shall wilfully fail or refuse to comply with any lawful order of a police officer or member of the Fire Department when directing traffic. Section 53: Persons Other -Than Officials Shall Not Direct Traffic No person other than an officer of the Police Department or a person, by the Chief of Police or person authorized by law shall direct or attempt to direct traffic by voice, hand or other signal (except that persons may operate'r:hen and as herein provided any mechani- cal - pushbutton signal erected by order of the Chief of Police, as here- inafter provided.) -4- Section 54: Public Employees to Obey Traffic Regulations The provisions of this ordinance shall apply to the driver of any vehicle owned by or used in the service of the United States Government, this State, any county or city and it shall be unlawful for any said driver to violate any of the provisions of this ordinance except as otherwise permitted in this ordinance or by state statute. Section S5: Exemptions to Certain Vehicles (a) The pro- visions of this ordinance regulating the operation, parking and standing of vehicles shall not apply to any vehicle of the police or Fire Depart- ment, any public ambulance or any public utility vehicle or any private ambulance, which public utility vehicle or private ambulance has quali- fied as an authorized emergency vehicle, when any vehicle mentioned in this section is operated in the,manner specified in the vehicle code in response to an emergency call. (b) The foregoing exemptions shall not, however, protect the driver of any such vehicle from the consequences of his willful disregard of the safety of others. (c) The provisions of this ordinance regulating the parking or standing of vehicles shall not apply to any vehicle of a city depart- ment or public utility while necessarily in use for construction or,re- pair work or any vehicle owned by the United States mile in use for the collection, transportation or delivery of the United States Mail. Section 56: Report of Damage to Certain Property (a) The driver of a vehicle or the person in charge of any animal involved in any accident resulting in damage to any property publicly owned or owned by a public utility, including but not limited to any fire hydrant,or- namental lighting post, telephone pole, electric light or power pole, or resulting in damage to any ornamental shade tree, traffic control device or other property of a like nature located in or along any street, alley, park, or public place, shall within twenty -four (24) hours after such accident make a written report of such accident to the Police Department of this City. -5- (b) Every such report shall state the time when and the place where the accident took place, the name and address of the person owning and of the person driving or in charge of such vehicle or animal, the license number of every such vehicle, and shall briefly describe the property damaged in such accident. (c) A driver involved in an accident shall not be subject to the requirements or penalties of this section if and during the time such driver is physically incapable of making a report, but in such event said driver shall make a report as required in subdivision (a) within 24 hours after regaining ability to make such report. ARTICLE IV TRAFFIC CONTROL DEVICES Section 60: Authority to Install Traffic Control Devices (a) The Chief of Police of the City of Lynwood shall have the power and duty to place and maintain or cause to be placed and maintained official traffic control devices when and as required, to make effective provisions of this and other traffic ordinances of the City of Lynwood. (b) 1dhenever the vehicle code of this state requires for the effectiveness of any provision thereof that traffic control devices be installed to give notice to the public of the application of such law, the Chief of Police is hereby authorized to install the necessary devices subject to any limitations or restrictions set forth in the law applicable thereto. (c) The Chief of Police may also place and maintain such additional traffic control devices as he may deem necessary to regulate - traffic or to guide or warn traffic. (d) The Chief of Police shall report in writing to the City Council the contemplated installation or removal of any traffic control device installed pursuant to subdivision (a), (b), or (c) of this section. The Chief of Police shall report in writing to the City Council the completion of the installation of any traffic control device pur- suant to subdivisions (a), (b), or (c), of this section, stating in -6- such written report his reasons for the contemplated installation or removal. The failure of the Chief of Police to so report either the installation or completion of such traffic control device shall not affect the validity thereof. The City Council hereby confirms and approves the location of all traffic control devices now in operation in the City of Lynwood. Whenever the Chief of Police has installed any traffic control device pursuant to subdivisions (a), (b), or (e) of this section, it shall be presumed that there was necessity to regulate or to guide or warn traffic at places where such traffic control de- vices are installed. Section 61: When Traffic Control Devices Required for En forcemeat Purposes No provision of "the,vehicle -code or of this ordin- ance for which signs are required shall be enforced against an alleged violator unless appropriate signs are in place and sufficiently legible to be seen by an ordinarily observant person. Section 62: Obedience to Traffic Control Devices The driver of any vehicle and the motorman of any street car or interurban street car shall obey the instructions of any official traffic control device applicable thereto placed in accordance with this ordinance unless otherwise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle when responding to emergency calls. Section 63: Installation of Traffic Signals (a) The Chief of Police is hereby directed to install and maintain official traffic signals at those intersections and other places where traffic conditions are such as to require that the flow of traffic be alternately inter- rupted and released in order to prevent or relieve traffic congestion or to protect life or property from hazard. (b) The Chief of Police shall ascertain and determine the locations where such signals are required by resort to field observation, traffic counts and other traffic information as may be pertinent and his determinations therefrom shall be made in accordance with those -7- traffic engineering and safety standards and instructions set forth in the California Maintenance Manual issued by the Division of Highways of the State Department of Public Works. (c) The Chief of Police shall report in writing to the City Council the contemplated installation or removal of any official traffic signals, installed pursuant to subdivision (a) or (b) of this section. The Chief of Police shall report in writing to the City Council the completion of any such installation, stating in such written report his reasons for the contemplated installation or removal. The failure of the Chief of Police to so report either the installation or the com- pletion of such traffic signals shall not affect the validity thereof. The City Council hereby confirms and approves the location of all official traffic signals as now located and in operation in the City of Lynwood. Whenever the Chief of Police has installed any official traffic signals pursuant to this ordinance, it shall be presumed that his determinations were made in accordance with the aforesaid Mainten- ance Manual. Section 63.1: Obedience to Official Traffic Signals The driver of any vehicle street car shall obey applicable thereto pl otherwise directed by granted the driver of to emergency calls. and the motorman of any street car or interurban the instructions of any official traffic signal aced in accordance with this ordinance unless a police officer subject,to the exceptions an authorized emergency vehicle when responding Section 64: Lane Markings The Chief of Police is hereby authorized to mark center lines and lane lines upon the surface of the roadway to indicate the course to be traveled by vehicles and may place signs temporarily designating lanes to be used by traffic moving in a particular direction, regardless of the center line of the highway. When authorized signs have been placed designating off - center traffic lanes, no person shall disobey the instructions given by such signs. Section 65: Authority to Remove. R or Discontinue Traffic Control Devices The Chief of Police is hereby authorized to remove, relocate or discontinue the operation of any traffic control device not specifically required by state law or this ordinance when- ever he shall determine in any particular case that the conditions which warranted or required the installation no longer exist or obtain. The Chief of Police shall report to the City Council as provided in Section 60, subdivision (d) hereof, the removal, relocation, or discon- tinuance of'any traffic {control device, as provided in this section, or the installation or discontinuance of any traffic control device pursuant to Section 63 hereof, giving his reasons therefor. Section 66: Traffic Control Devices- -Hours of Operation The Chief of Police shall determine the hours and days during which any traffic control device shall be in operation or be in effect, ex- cept in those cases where such hours or days are specified in this or- dinance. ARTICLE V TURNING MOVEMENTS Section 70: Authority to Place and Obedience to Turning Markers (a) The Chief of Police is authorized to place markers, buttons, or signs within or adjacent to intersections indicating the course to be traveled by vehicles turning at such intersections. (b) When authorized markers, buttons, or other,ind.ications are placed within an intersection indicating the course to be traveled by vehicles turning thereat, no driver of a vehicle shall disobey the directions of such markers, buttons, or other indications. Section 71: Authority to Place Restricted Turn Signs The Chief of Police is hereby authorized to determine those intersections at which drivers of vehicles shall not make a right, left, or U turn, and shall place proper signs at such intersections. The making of such turns may be prohibited between certain hours of any day and per- mitted at other hours, in which event the same shall be plainly indicated �'1ii on the signs or they may be removed when such turns are permitted. Section 72: Obedience to No -turn Sims Whenever authorized signs are erected indicating that no right or left or U turn is Der- mitted, no driver of a vehicle shall disobey the directions of any such sign. Section 73: Signal Controlled Intersections - -Right Turns No driver of a vehicle shall make a right turn against a red or stop signal at any intersection within the central traffic district of the City of Lynwood unless a right turn is authorized by an appropriate sign. No such right turn shall be made so as to interfere with the flow of traffic nor until a complete stop has been made prior to under- taking such right turn. 0 ARTICLE VI ONE -'WAY STREETS AND ALLEYS Section 80: The Chief of Police to Sian One -Way Streets and Alleys, The Chief of Police shall place and maintain signs giving notice of one -way streets or alleys designated as such in Section 190 hereof. Signs indicating the direction of lawful traffic movement on one -way streets.or alleys shall be placed at every intersection where movement of traffic in the opposite direction is prohibited. Section 81: Obedience to One -way Signs when signs are erected on any one-way street or alley giving notice thereof, no person shall drive any vehicle in a direction contrary thereto. ARTICLE VII SPECIAL STOPS REQUIRED Section 90: The Chief of Police is authorized and directed to establish in accordance with law, stop signs at the intersections of through streets or any intersection at which vehicles are required to stop at one or more entrances thereto or at any railway grade cross- ing at which vehicles are required to stop. Every such sign shall con- form with and shall be placed as provided in Section 471 of the Vehicle -10- b Code. The Chief of Police shall advise the City Council in writing of the establishment or discontinuance of any such stop signs; the failure of the Chief of Police so to do, however, shall not affect the validity of such stop signs. .Section 91: Stop at Through Street or Stop Sipn. (a) Those streets and parts of streets described in Section 191 hereof are here- by declared to be through streets for the purposes of this ordinance. (b) The provisions of this section shall also apply at one or more entrances to the intersections as such entrances and intersec- tions are described in Section 192 hereof. (c) The provisions of this section shall apply at those highway railway grade crossings as described in Section 1 93• (d) When stop signs are erected as herein provided at any through street or the entrance to any intersection or at any railway grade crossing, every driver of a vehicle and every motorman of a street car shall stop as required by the vehicle code. ARTICLE VIII MISCELLANEOUS DRIVING RULES AND REGULATIONS RELATING TO THE USE OF STREETS Section 100: Interference with Fire Apraratus (a) No driver of a vehicle excepting an authorized emergency vehicle, or a vehicle of a duly authorized member of the Fire Department of said City, -shall follow any fire apparatus answering a fire alarm, closer than 300 feet, or park any vehicle within 300 feet of a fire, or oper- ate or park any vehicle in such manner as to interfere with any fire apparatus or line of fire hose when in use at a fire or when in place for use in response to a fire alarm. (b) Crossing Fire Hose No street or interurban car or vehicle shall be driven over any unprotected hose of the Fire Depart- ment when placed or laid down on any street, private driveway or street or interurban car track, to be used at any fire or alarm of fire with- out the consent of the members of the Fire Department in command. -11- 0 Section 101: Driving Through Funeral Processions No driver of a vehicle or motorman of a street car or interurban street car shall drive between vehicles comprising a funeral procession while they are In motion and when the vehicles in such processions are conspicuously so designated. Section 102: Riding on Motorcycles and Bicycles A person operating a motorcycle or bicycle upon a street shall not ride other than upon the permanent and regular seat attached thereto, or carry any other person upon such motorcycle or bicycle other than upon a firmly attached seat to the rear of the operator, nor shall any person ride upon a motorcycle or bicycle upon a street other than as above authorized. Section 103: Unlawful Riding No person shall ride on any street car or interurban car or vehicle upon any portion thereof not designed or intended for the use of passengers. This provision shall not apply to any employees engaged in the necessary discharge of a duty, or to persons riding within truck bodies in space intended for merchandise. Section 10 Clinging to Moving Vehicles Any person riding upon any bicycle, motorcycle, coaster, roller skates or any toy vehicle shall not attach the same or himself to any street car or moving ve- hicle upon any roadway. Section 105: Vehicles and Bicycles Shall Not be Driven or Animals be Ridden on the Sidewalk. The driver or operator of a vehicle or bicycle shall not drive or operate the same nor shall the rider of any animal ride or drive such animal, within any sidewalk area or any parkway except at a permanent or temporary driveway. A temporary driveway for the purposes of this section is defined to mean a crossing or driveway suitably planked or otherwise protected to prevent injury to the curb or sidewalk. This section shall not apply to invalid care or vehicles. -12- Section 106: New Pavement No person shall ride or drive any animal or any vehicle or bicycle over or across any newly made pavement or freshly painted marking in any street when a barrier or sign is in place warning persons not to drive over or across such pave- ment or marking, or when a sign is in place stating that the street or any portion thereof is closed. Section 107: Sidewalks, Coasting. Etc. No persons shall coast or propel himself down, along, upon or over any sidewalk in any wagon, cars, hand - wagon, coaster, roller skates, bicycle or other ve- hicle, except at a permanent or temporary driveway. Section 108: Restricted Access No person shall drive a vehicle onto or from any limited access roadway except at such entrances and exits as are established by public authority. Section 109: Emerging From Alley or Private Driveway The driver of a vehicle emerging from an alley, driveway, or building, shall stop such vehicle immediately prior to driving onto a sidepra.lk or into the sidewalk area extending across any alley way. Section 110: Miscellaneous Regulations Relating to the Use of Streets It shall be unlawful for any person, without first obtain- ing a permit from the City Council of the City of Lynwood to engage in any game, dance, public meeting, parade, or exhibition upon any street or alley. Section 110.1. Obstructions in Streets No person shall erect, construct, place, maintain, leave or abandon any building, fence, porch, steps, post, pole, track, wire, pipe, conduit or other structure in whole or in part in or upon any street or alley within said City; and no person shall place, affix, paint, maintain, leave, or abandon any sign, placard, notice, advertisement, seat, bench, table stand, material or other obstruction in any street within said City; without a special permit in writing so to do first had and obtained from the Chief of Police, or the Street Superintendent, or the City Council of -1?- said City; provided, ho-rever, that the provisions of this Section shall not apply; (a) To United States Mail boxes; (b) To poles and facilities of public utilities lawfully using the public streets of said City. (c) To portable and usual garbage and rubbish receptacles when conforming to and placed in accordance with the rules and regulations of said City with reference thereto; (d) To notices, placards, posters or any of the other articles or means above mentioned or referred to, erected or placed by any City or other public officer, official or employee acting within the scope of his or her office or employment as such public officer, official or employee. Section 110.2: Excavations in Streets No person shall dig in, excavate, tear up, deface or injure any street without an express written permit so to do first had and obtained from either the Super- intendent of Streets or the City Council of said City and it shall be unlawful for any person to violate or permit or cause to be violated any of the terms or conditions imposed in any such permit if and when issued. Section 110.3. Lights on Obstructions. No person placing or maintaining any obstruction or making any excavation in any street shall fail or neglect to provide, during the period between sunset of any day and sunrise of the succeeding day, a suitable and adecuate light to warn users of such street of any such obstructions or excava- tions. Section 110.4: Deposit of Rubbish in Streets No person shall throw, deposit or place in or upon any street any glass, bottles, paper, rubbish, garbage (except in proper containers as permitted by law), or any unsightly, foul, or noxious substance. Section 110.5: Expectoration in Streets and Public Places Etc. No person shall expectorate on the floor or any other'portion of any public building, hall or stairway or upon the floor or any other portion of any street car, bus, or other public conveyance, or upon -14•- any sidewalk within said city. Section 110.6: Closing Streets Temporarily The Chief of Police shall have the right, authority and power at any time to close any street or any portion thereof temporarily to vehicular, pedestrian or other traffic when in the opinion of such Chief of Police the public peace, health or safety requires such temporary closing; provided, how- ever, that in all such cases, suitable signs shall be conspicuously posted giving notice of the fact that such street or portion thereof is closed, or a police officer or person designated by the Chief of Police is present thereat for the purpose of giving such notice. No person shall, in case any such street or portion thereof is so closed, enter into or upon such closed portion or drive any vehicle into or upon the same contrary to any such notice or notices or the order or orders of any such pollee officer or,person so designated. Nothing herein con- tained shall be construed as depriving the City Council and /or Street Superintendent of said City from concurrent power to likewise tempor- arily close any street or portion thereof within said City, but the delegation of power to the Chief of Police herein made shall be con- strued as in addition thereto. Section 110.7: Sidewalks, Parkways, Merchanidse Etc No. person shall leave or permit to remain in or upon any street, alley, sidewalk, or in or upon any parkway in any street within said City, any merchandise, fruit or fruits, melon or melons, vegetable or vegetables, meat or meats or any baggage or any article of personal property. ARTICLE IX PEDESTRIANS Section 111: The Chief of Police to Establish Crosswalks (a) The Chief of Police shall establish, designate, and maintain cross- walks at intersections and other places by appropriate marks or lines upon the surface of the roadway. Crosswalks shall be established at such intersections and at other within the City of Lynwood -15- ' where the Chief of Police determines that there is a particular hazard to pedestrians crossing the roadway. The Chief of Police shall report the contemplated installation and removal of crosswalks to the City Council, giving his reasons therefor. Failure to so report shall not affect the validity of any such crosswalks. (b) Other than crosswalks at intersections established pur- suant to subdivision (a) hereof, no crosswalks shall be established in any block which is less than 400 feet in length. Elsewhere, not more than one additional crosswalk shall be established in any one block and such crosswalk shall be located as nearly as practicable at mid - block. Section 112: When a Pedestrian Must Use Crosswalk No pedes- trian shall cross a roadway other than in a crosswalk in any business district in the City of Lynwood. Section 113: Crossing at Right Angles No pedestrian shall cross a roadway outside of a business district at any place other than by a route at approximately right angles to the curb or by the shortest route to the opposite curb, except in a marked crosswalk. Section 114: Standing in Roadway. No person shall stand in any roadway other than in a safety zone or in a crosswalk, if such action interferes with the lawful movement of traffic. This provision shall not apply to any public officer or employee or employee of a pub- s lic utility when necessarj:gn the street in line of duty. ARTICLE X STOPPING, STANDING AND PARKING. Section 120: Application of Regulations (a) The provisions of this ordinance prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device. -16- (b) The provisions of this ordinance imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the state vehicle code or the ordinances of this city, prohibiting or limiting the stand- ing or parking of vehicles in specified places or at specified times. Section 121: Standing in Parkways Prohibited No person shall stop, stand, or park a vehicle within any parkway. Section 122: Use of Streets for Storage of Vehicles Pro hibited In the event a vehicle is parked or left standing upon a .street or alley in excess of a consecutive period of 120 hours, any member of the Police Department may remove said vehicle from the street or alley in the manner and subject to the requirements of Sections 585 and 585.1 of the Vehicle Code. Section 123: Parkinp for Certain Purposes Prohibited No person shall park a vehicle upon any roadway for the principal purpose of: 1. Displaying such vehicle for sale. 2. dashing, greasing, or repairing such vehicle except repairs necessitated by emergency. Section 124; Parking Parallel with Curb (a) Subject to other and more restrictive limitations, a vehicle may be stopped or parked within 18 inches of the left -hand curb facing in the direction of traffic movement upon any one -way street unless signs are in place prohibiting such stopping or standing. (b) The Chief of Police is authorized. to determine when standing or parking shall be prohibited upon the left side of any one - way street or when standing or parking may be permitted on the left hand side of any one -way roadway having two or more separate roadways, and shall erect signs giving notice thereof; no person shall violate any such notice. Section 125: Signs or Markings Indicating Angle Parking (a) Angle parking shall be permitted upon those streets and part's of -17- N streets described in Section 194- hereof and prohibited on all other streets or parts of streets in the City of Lynkrood. (b) The Chief of Police shall mark the streets designated in Section 194 hereof, indicating the angle at which vehicles shall be parked. (c) l'Then signs or marks are in place indicating angle parking as herein provided, no person shall park or stand a vehicle other than at the angle to the curb or edge of the roadway indicated by such signs or markings. Section 126: Parking AdJacent to Schools (a) The Chief of Police is hereby authorized to erect signs indicating no parking upon that side of any street adjacent to any school property when such park= ing would, in his opinion, interfere with traffic or create a hazardous situation. (b) When official signs are erected indicating no parking upon that side of a street adjacent to any school property, no person shall park a vehicle in any such designated place. Section 127: Parking Prohibited on Narrow Streets (a) The Chief of Police is hereby authorized to place signs or markings indi- cating no parking upon any street when the width of the roadway does not exceed 30 feet, or upon one side of a street as indicated by such signs or markings when the width of the roadway does not exceed 40 feet. (b) when official signs or markings prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign or marking. Section 128: Stopping or Parking Prohibited - -Signs Required The Chief of Police shall appropriately sign or mark the following places and when so signed or marked no person shall stop, stand or park a vehicle in any of said places. 1. At any place within 15 feet of a point on the curb immediately opposite the mid -block end of a safety zone. -18- k 2. At any place within 15 feet of an intersection in the central traffic district or in any business district except that a bus may stop at a designated bus stop. 3. Within 15 feet of the approach to any traffic signal, boulevard stop sign, or official electric flashing device. 4. At any place where the Chief of Police determines that It is necessary in order to eliminate unusual traffic hazard. Section 129: Unlawful Parking -- Peddlers, Vendors (a) Ex- cept as otherwise provided in this section no person shall stand or park any vehicle, wagon or push -cart from which goods, wares, merchan- dise, fruits, vegetables or food stuffs are sold, displayed, solicited or offered for sale or bartered or exchanged, or any lunch wagon or eating car or vehicle, on any portion of any street or alley within this city, except that such vehicles, kagons, or push -carts may stand or park only at the request of a bona fide purchaser for a period of time not to exceed ten (10) minutes at any one place. The provisions of this subsection shall not apply to persons delivering such articles upon order of, or by agreement with a customer from a store or other fixed place of business or distribution. (b) No person shall park or stand on any street or alley any lunch wagon, eating cart or vehicle, or push -cart from which tamales, peanuts, popcorn, candy or other articles of food are sold or offered for sale without first obtaining a written permit to do so from the legislative body which shall designate the specific location in which such cart shall stand. (c) No person shall park or stand any vehicle, or wagon used or intended to be used in the transportation of property for hire on any street or alley while awaiting patronage for such vehicle or wagon without first obtaining a written permit to do so from the legislative body which shall designate the specific location where such vehicle may stand. (d) Whenever any permit is granted under the provisions of this section and a particular location to park or stand is specified -19- therein, no person shall park or stand any vehicle, wagon, or push -cart on any location other than as designated in such permit. Section 130: Emergency Parking Signs (a) Whenever the Chief of Police shall determine that an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings or functions, or for other like reasons, the Chief of Police shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the Chief of Police shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the Chief of Police shall cause such signs to be removed promptly there- after. (b) When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. Section 131: Display of Warning Devices I Commercial Vehicle Disabled Every motor truck having unladen weight of 4,000 pounds or more, and every truck tractor irrespective of weight when operated upon any street or highway during the time specified in Section 618 of the Vehicle Code shall be equipped with and carry at least two flares or two red lanterns, or two warning lights or reflectors, which reflectors shall be of a type approved by the California Highway Patrol. When any vehicle above mentioned or any trailer or semi- trailer is dis- abled upon streets or highways outside of any business or residence dis- trict within this city and upon which street or highway there is in- sufficient street lighting to reveal a vehicle at a distance of 200 feet during any time mentioned in Section 618 of the Vehicle Code, a warning signal of the character indicated above shall be immediately placed at a distance of approximately 100 feet in advance of and 100 feet to the rear of such disabled vehicle, by the driver thereof. The -20- warning signals herein mentioned shall be displayed continuously during the times mentioned in Section 618 while such vehicle remains disabled upon such street or highway. ARTICLE XI STOPPING FOR LOADING OR UNLOADING ONLY Section 140: Authority to Establish Loading Zones (a) The Chief of Police is hereby authorized to determine and to mark loading zones and passenger loading zones as follows: 1. At any place in the central traffic district where, in the opinion of the Chief of Police, such loading zones are necessary including the entrance to any place of business, hall, or place used for public assembly. (b) Loading zones shall be indicated by a yellow paint line at least 21 feet in length, stenciled with black letters, "LOADING ONLY", on the top of all curbs within such zones. (c) Passenger loading zones shall be indicated by a white line at least 21 feet in length stenciled with black letters, "PASSEN- GER LOADING ONLY" upon the top of all curbs in said zones. (d) In no event shall more than one - seventh of the total curb length on one side of any street in any block be reserved for loading zone and passenger loading zone purposes. The Chief of Police shall report to the City Council in smiting the establishment and dis- continuance of all loading zones and all passenger loading zones, giving his reasons therefor. Failure of the Chief of Police to so report the establishment of such zones shall not affect the validity thereof. Section 141: Curb Markings to Indicate No Stopping and Parking Regulations (a) The Chief of Police is hereby authorized to establish the following curb markings to indicate parking or standing regulations and said curb markings shall have the meanings as herein set forth. 1. "Red" shall mean no stopping, standing or parking at any time except as permitted by the Vehicle Code, and except that a -21- bus may stop in a red zone marked or signed as a bus zone. 2. "Yellow" shall mean no stopping, standing, or parking at any time between 7:00 a. m. and 6:00 p. m. of any day except Sundays and holidays for any purpose other than the loading or unload- ing of passengers or materials, provided that the loading or unloading of passengers shall not consume more than three (3) minutes nor the loading or unloading of materials more than twenty (20) minutes. 3. "White" shall mean no stopping, standing or parking for any purpose other than loading or unloading of passengers which shall not exceed three (3) minutes and such restrictions shall apply between 7:00 a. m. and 6:00 p. m. of any day except Sundays and holidays. 4. "Green" shall mean no standing or parking for longer than twenty (20) minutes at any time between 7:00 a. m, and 6:00 p, m. of any day except Sundays and holidays. 5. The Chief of Police is authorized, pursuant to this ordinance, to cause curb markings to be placed as aforesaid, provided that he shall report the establishment of all such red, yellow, vihite, or green zones, in writing, to the City Council. The Chief of Police shall report the discontinuance of any such zones to the City Council. The Chief of Police shall state his reasons for completed installation or discontinuance. The failure of the Chief of Police to so report shall not affect the validity of any such zones. 6. No person shall stop, stand, or park a vehicle adjacent to any such legible curb marking in violation of any of the provisions of this section. Section 142: Effect of Permission to Load or Unload (a) Permission granted by Section 141 to stop or stand a vehicle for pur- poses of loading or unloading of materials shall apply only to commer- cial vehicles and shall not extend beyond the time necessary therefor, and in no event for more than twenty (20) minutes. (b) The loading or unloading of materials shall apply only to commercial deliveries, also the delivery or pickup of express and -22- parcel post packages and United States Nail. (c) Permission herein granted to stop or park for purposes of loading or unloading passengers shall include the loading or unload- ing of personal baggage but shall not extend beyond the time necessary therefor and in no event for more than three (3) minutes. (d) Within the total time limits above specified the pro- visions of this section shall be enforced so as to accommodate neces- sary and reasonable loading or unloading but without permitting abuse of the privileges hereby granted. Section 143: Standing for Loading or Unloading Only No person shall stop, stand or park a vehicle in any yellow loading zone for any purpose other than loading or unloading passengers or material for such time as is permitted in Section 142. Section 144. Standing in Passenger Loading Zones No person shall stop, stand or park a vehicle in any passenger loading zone for any purpose other than the loading or unloading of passengers for such time as is specified in Section 142. Section 145: Standing in Any Alley No person shall stop, stand or park a vehicle for any purpose other than the loading or un- loading of persons or materials in any alley. Section 146: Bus Zones to be Established (a) The Chief of Police is hereby authorized to establish bus zones opposite curb space for the loading and unloading of passengers of common carriers and to determine the location of such bus loading zones. The Chief of Police shall report the establishment of such bus loading zones, in writing, to the City Council. Failure to so report shall not affect the validity of such zones. (b) The word "bus" as used in this section shall mean any motor bus, motor coach, trackless trolley coach, or passenger stage used as a common carrier of passengers. (c) No bus zone shall-exceed 60 feet in length. (d) No bus zone shall be established opposite and to the right of a safety zone. -23- ;Y a (e) The Chief of Police shall paint a red line stencil with white letters "NO STANDING ", together with the words "BUS ZONE" upon the top and side of all curbs and places specified as a bus zone. (f) No person shall stop, stand or park any vehicle ex- cept a bus in a bus zone. No bus shall stop or park in the bus zone except for the length of time necessary to pick up and discharge pass- engers. ARTICLE XII STOPPING STANDING OR PARKING RESTRICTED OR PROHIBITED ON CERTAIN STREETS Section 151: Parking Time Limited in Business Districts Whe n authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle on any of the streets enumerated in Section 195(a) hereof between the hours of 7:00 a.m. and 6:00 p.m. of any day except Sundays and holidays for a period of time longer than one hour. Section 152: Parking Time Limited on Certain Enumerated Streets When authorized signs are in place giving notice thereof no person shall stop, stand, or park any vehicle on any of the streets enumerated in Section 195(b) hereof for a period of time longer than two (2) hours at any time between the hours of 7:00 a. m. and 6:00 p.m. of any days except Sundays and holidays. Section 153: Parking Prohibited at All Times - on Certain Streets When signs are erected giving notice thereof no person shall park a vehicle at any time upon any of the streets or parts thereof described in Section 196 of this ordinance. Section 154: All Night Parking Prohibited No person shall stop, stand or park a vehicle on any street for a period.of time longer than two (2) hours between the hours of 1 and 6:00 a.m, of any day. Section 155: Authority to Establish Parking Signs The Chief of Police is authorized to post signs giving notice of the parking -24- 1 limitations set forth in this Article XII on the streets designated and enumerated in this ordinance. ARTICLE XIII RESTRICTED USE OF CERTAIN STREET'S Section 163: Truck Routes (a) Those streets and parts of streets described in Section 197 hereof are hereby declared truck traffic routes for the movement of the following.,described vehicles: `1. Vehicles exceeding a manufacturers rated capacity of 2 tons. 2. Any freight vehicle with a trailer. 3. Any vehicle conveying refuse, rubbish, garbage, or dirt; except any such vehicle conveying refuse, rub- bish, garbage, or dirt for and on behalf of the City of Lynwood. 4. Any vehicle transporting`crude or fuel oil, gasoline, or other inflammable material. (b) Whenever any streets or parts of streets described in Section 197 hereof, the use of which is permitted by any of the fore- going described vehicles, the Chief of Police is hereby authorized to designate such street or streets by appropriate signs as "Truck Traffic Route" for the movement of any of the above mentioned vehicles. (c) When any such truck traffic route or routes are estab- lished and designated by appropriate signs, the operators of any vehicle Sub - described in /Section (a) hereof shall drive on such route or routes and none other except when necessary to traverse another street or streets to his destination for the purpose of loading or unloading or other lawful purpose,within the City of Lynwood or its immediate en- virons or for the purpose of gaining access from within the City of Lynwood to any such truck route; or for the purpose of storing or parking of any such vehicle within the City of Lynwood_. (d) Subdivision (a) of this section shall not be construed as to be applicable to passenger busses operating as common carriers. Section 164: Commercial Vehicles Prohibited from Using Certain Streets (a) The streets referred to in Section 198 hereof shall not be used by any commercial vehicle when appropriate signs have been -25- erected and maintained indicating that such streets are not to be used by commercial vehicles. The Chief of Police is authorized and empowered to erect such appropriate signs. (b) Those streets and parts of streets described in Section 198 hereof are hereby declared to be streets the use of which is pro- hibited by any commercial vehicle exceeding a gross weight of 4 thou- sand pounds. The provisions of this section shall not apply to pas'sen- ger busses under the jurisdiction of the Public Utilities Commission. ARTICLE XIV TRAINS STREET CARS Section 170: Railway Gates No person shall drive any vehicle through, around, or under any crossing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being opened or closed. Section 171: Trains Not to Block Streets No person shall operate any train or train of cars, or permit the same to remain standing,) so as to block the movement of traffic upon any street for a period of time longer than five (5) minutes. ARTICLE -XV SPECIAL SPEED ZONES Section 180:. Decrease of State Law Maximum Speed It is hereby determined upon the basis of an engineering and traffic investi- gation that the speed permitted by State law outside of business and residence districts as applicable upon the following streets is greater than is reasonable or safe under the conditions found to exist upon such streets and it is hereby declared that the prima facie speed limit shall be as herein set forth on those streets or parts of streets herein designated when signs are erected giving notice thereof. ARTICLE XVI SCHEDULES OF DESIGNATED STREETS REFERRED TO IN ORDINANCE Section 190: One -Way Streets In accordance with Section 80 and when properly signposted, traffic shall move only in the direction indicated upon the following streets: Plaza Street, between Mulford and Court Street; State Street between Lynwood Road and Long Beach Blvd; Fernwood Avenue from east to west boundaries; Los Flores Blvd, from Bellinger Street to Long Beach Blvd. Section 191. Through Streets The following streets and parts of streets are hereby declared to be through streets, or high- ways, within the City of Lynwood: 1. Atlantic Ave. from the northerly to the southerly City limits; 2. Long Beach Blvd., from the northerly to the southerly City limits; 3. Alameda Street from the northerly to the southerly City limits; 4. Imperial Highway, from Atlantic Ave. to Alameda St.; 5. Abbott Road, from San Antonio St. to Atlantic Ave.; 6. Century Elvd. from Atlantic Ave. to Alameda St.; 7. Tweedy Road from the easterly to the westerly City limits; "% I ^ ' 8. Fernwood Ave, from the easterly to the westerly City limits; 9. Morton Road from Bullis Road to Atlantic Avenue; 10. Lynwood Road from State Street to Alameda Street; 11. Bullis Road from Imperial Highway to Carlin Avenue; 12. California Ave. from Fernwood Ave. to Century Blvd.; 13. State street from Tweedy Road to Cedar Street; 14. Santa Fe Ave. from Cedar Street to southerly City limits; 15. Norton Avenue from State Street west; 16. Los Flores Blvd, from Santa Fe to Bellinger Avenue; 17. Santa Fe Ave. from Fernwood Ave. north; 18. Bellinger Street from Los Flores to Norton Avenue. In accordance with Section 125 and when signs or markings are in place giving notice thereof, drivers of vehicles may stand or park a vehicle only as indi- cated by such marks or signs on the following streets or portions thereof: Plaza Street between Mulford and Court Imperial Highway, wherever marked. Section 195: Parking Time Limited on Certain Enumerated Streets. (a) In accordance with Section 151, parking is limited to one (1) hour between the hours of 7:00 a. M. and 6:00 p. m, of any -28- - e day except Sundays and holidays upon any of the following enumerated streets: Long Beach Blvd. between Oakwood Avenue and Magnolia Ave. Atlantic Ave. from Abbott Road to Fernwood Avenue. (b) In accordance with Section 152, parking is limited to two (2) hours between the,hour of 7:00 a.m. and 6:00 p.m.,of any day except Sundays and holidays upon any of the following enumerated streets: On all streets intersecting Long Beach Blvd, from Oakwood Ave. to and including Magnolia Ave., approxi- mately 300 feet east and west of Long Beach Blvd. on said intersecting streets. Abbott Road from Rosewood Avenue easterly to the east City limits. Imperial a ighway from Elm Ave. easterly to the east City limits. Section 196: Parking Prohibited at All Times on Certain Streets In accordance with Section 153 and when signs are erected giving notice thereof, no person shall at any time park a vehicle upon any of the following described streets or parts of streets: Alameda Blvd. east side of the west roadway, north city limits to south city limits. Fernwood Ave. South side of north roadway Alameda to Atlantic Avenue. Plaza Street, West side,, Mulford to Court.` East side, Court to Sanborn. Court Street. East side, Mulford to Plaza. Mulford Avenue, North side, Plaza St. to Court. North side, California to Birch. Magnolia Ave. North side, School St. to Bullis Road. Lynwood Road, North side, Long Beach Blvd. to alleyway east of Lewis Street. South 'side, School Street to Fir Street. Orchard Avenue. South side, Long Beach Blvd. to Bullis Road. State Street. West side of, east roadway, Beechd..iood to Oakwood. East side of west roadway, Beech - wood to Oakwood. Locust Avenue, both sides, Alberta to Sanborn. Peach Street, east side, between Fernwood and Beechwood. Section 197: Truer Routes. In accordance with Section 163 and when signs are erected giving notice thereof, the following streets or portions of streets are hereby declared to be truck traffic routes for the movement of vehicles described in Section 163: 1. Atlantic Avenue - 33 Century Blvd. 2. Alameda Blvd. -' Imperial Highway 5. Long Beach Blvd. between Century & Tweedy -29- % Section 198: Commercial Vehicles Prohibited In accordance with Section 164, the following streets and parts of streets are hereby declared to be streets the use of which prohibited by any commercial vehicle; exceeding 4000 pounds: When marked, all streets in the City of Lynwood except those designated in Section 191 hereof. ARTICLE XVII TRAFFIC CITATIONS Section 210: When Person Arrested Must be Taken Immediately Before Judge or Magistrate Whenever any person is arrested for any violation of this ordinance the arrested person shall be immediately taken before the City•Judge of the City of Lynwood or a magistrate acting for and on behalf of said City Judge: (a) When the person arrested demands an immediate appearance before a magistrate, or (b) When the person arrested refuses to give his written promise to appear in court as hereinafter provided for in this ordinance. Section 211: Court Procedure When Person Arrested Immediately Taken Before a Judge or Magistrate (a) Whenever any person is arrested for a violation of any provision of this ordinance and is immediately taken before the City Judge or a magistrate acting for and on behalf of the City Judge, the arresting officer shall file with said Judge or magistrate a complaint stating the offense with which such person is charged. (b) The person so taken before said Judge or magistrate shall be entitled to at least five days continuance of his case in which to plead and prepare for trail and said person shall not be re- quired to plead or be tried within said five days unless he waives such time in writing or in open court. (c) The person so taken before such City Judge, or magistrate, shall thereupon be released from custody upon his own recognizance or upon such bail as the City Judge or iagistrate may fix. -z,0- Section 212: When Person Arrested to be Given Notice to Appear in Court (a) whenever any person is arrested for any violation of any provision or provisions of this ordinance and such person is not immediately taken before the City Judge or a magistrate acting for and on behalf of said City Judge as hereinbefore required or permitted, the arresting officer shall prepare in duplicate a written notice to appear in court containing the name and address of such person, the license number of his vehicle, if any, the offense charged and the time and place when and where such person shall appear in Court. (b) The time specifted.in said notice to appear must be at least five days after such arrest. (c) The place specified in said notice to appear shall be before said City Judge or magistrate acting for and on behalf of said City Judge, within said City of Lynwood. (d) Said officer shall deliver one copy of said notice to the arrested person and said arrested person, in order to secure release, must give his written promise to so appear in Court by signing the duplicate notice which shall be retained by said officer; thereupon, the arresting officer shall forthwith release the person arrested from custody. (e) Said officer shall, as soon as practicable, file said duplicate notice with the City Judge or magistrate acting for and on behalf of said City Judge. Thereupon, the said City Judge or magistrate shall fix the amount of bail which in his ,judgment, in accordance with the provisions of Section 1275 of the Penal Code of the State of Calif- ornia, will be reasonable and sufficient for the appearance of the de- fendant and shall endorse upon said notice a statement signed by him in the form set forth in Section 815A of said Penal Code. The defendant may, prior to the date upon which he promised to appear in Court, de- posit with the City Judge or magistrate or officer authorized by such Judge or Magistrate to receive a deposit of bail, the amount of bail thus set. Thereafter, at the time when the case is called for arraign- -31- ment before the City Judge or magistrate,'if the defendant shall not apnea either in person or by counsel, the magistrate may declare the bail forfeited and may in his discretion order that no further proceedings shall be had in the case.% Upon the making of such order that no further proceedings be had, all sums deposited as Bail shall f6rthwith be paid into the City Treasury of said City. (f) No warrant shall issue on such charge for the arrest of a person who had given such written momise to appear in Court unless and until he has violated such promise or has failed to deposit bail, to appear for arraignment, trial,.or judgment, or to comply with the terms and provisions of the judgment, as required by law, or unless in the discretion of the City Judge or magistrate such person should be required to appear before such Judge or magistrate. Section 213: Waiver of Filing of Written Complaint Whenever written notice to appear has been prepared, delivered, and filed with the court, as provided in this ordinance, or whenever notice of illegal parking has been given pursuant to the provisions of this ordinance, an exact and legible duplicate copy of said notice when filed with the magistrate specified herein, in lieu of a verified complaint, shall notwithstanding the provisions of Section 1426 of the Penal Code, con- stitute a complaint to which the defendant may plead "Guilty". If, however, the defendant shall violate his promise to appear in court or shall not deposit laTaful bail, or shall plead other than "Guilty" of the offense charged, a complaint shall be filed which shall conform to the provisions of Section 1426, Penal Code, and which shall be deemed to be an original complaint, and thereafter proceeding shall be had as provided by law; provided that a defendant may, by an agree- ment in writing, subscribed by him and filed with the court, waive the filing of a verified complaint and elect that the prosecution may pro- ceed upon the written notice provided in this ordinance. I -32- ARTICLE XVIII PENALTIES AND EFFECT OF ORDINANCE Section 220: Any person,firm, or corporation violating any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be punishably by a fine of not to exceed five hundred dollars 0500.00) or imprisonment in the City Jail of the City of Lynwood or the County Jail of Los Angeles County, State of California, for a period of time not to exceed six months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for every day during any portion of which vio- lation of any provision of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided by this ordinance. Section 221: Effect of Ordinance If any section, sub- section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Legislative Body hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 222: Repeal Ordinance No. 404 and 436 of this city is hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or pre- vent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 223: Publication of Ordinance The City Clerk of the City of Lynwood shall certify to the passage of this ordinance and cause the same to be published in the Lynwood Press, a weekly -33- d newspaper published, printed, and circulated in the City of Lynwood,.,.
