ORDINANCE NO.
AN ORDINANCE CREATING THE OF'F'ICE OF HEALTH
OFFICER OF THE CITY OF LYNWOOD, CALIFORNIA, AND
PROVIDING FOR THE APPOINTMENT AitD COMP ENSATION OF
SUCH OFFICER AND PRESCRIBING HIS DUTIES AND MAKING
REGULATIONS IN REGiM TO INFECTIOUS FIND CONTAGIOUS
DISEASES, AND FOR THE PROTECTION OF PUBLIC HEALTH
AND FIXING A PENALTY FOR THE VIOLATION THEREOF.
The Board of Trustees of the City of Lynwood do ordain as
follows:
Section 1. That the office of Health Officer of the City
of Lynwood shall be and is hereby created.
Section 2. That all appointments to such office shall be
made Resolution of the Board of Trustees of said City, duly passed
at a regular meeting thereof, which said Resolution shall also fix
the salary or compensation therein named and such appointee shall
19 hold office during the pleasure of said Board.
20 Section 3. That such Health Officer before entering; upon
21 the discharge of the duties of such office, shall take and subscribe
22 to the constitutional oath of office.
23 Section 4. Every attending or consulting physician, nurse'
24 or other person having charge of or caring for any person who is or
25 whom such physician or other person may have reasonable ground to
26 suspect is afflicted with cholera, plague, ,yellow fever, malaria,
g 27 eprosy, diphtheria, scarlet fever, smallpox, typhus fever, typhoid
28 ever, pars- typhoid fever, anthrax, glanders, epidemic cerebrospinal
29 meningitis, tuberculosis, pneumonia, dysentery, erysipelas, uncinaria-
30 is or hookworm, trachoma, dengue, tetanus, measles, German measles,
31 hickenpox, whooping cough, riumps, pellagra, beriberi, Rocky Mountain
32 potted (or tick) fever, rabies, poliomyelitis, or any other contagiou

or infectious disease, shall immediately report in writing to the
Health Officer of said City the nature of the disease, the name of
the person afflicted and the place of his or her confinement, and
to report in writing to the Health Officer of said City every case
of death from any such causes immediately after such death shall
have occurred, together with the cause and circumstances of said

Such report shall be made both by telephone and in writing
to the IIealth Officer immediately upon ascertaining by such physic—
ian or other person having such patient that such person is or may be
so affected.
Section G. all physicians, nurses, clergymen, attendants,
owners, proprietors, managers, employees and persons living in or
visiting any Bich- person in any hotel, lodging house, house, building
office, structure or other place where any person shall be ill of any
infectious. contagious or communicable disease, shall promptly report
such fact in writing to the Health Officer, together with the name
of the person. if Imowh, and place where such person is confined, and
ure of the disease if Lnown.
Section 6. rJhenover the Health Officer shall have been
notified of the existence of u case of Asiatic cholera, yellow fever,
typhus fever, plague, smallpox, scarlet fever, diphtheria, or any
other contagious or infectious disease declared quarantinable by the
State Board of Health, he must immediately place such case in quaran—
tine and shall cause to be firmly fastened in the most conspicuous
place upon such house, building, tent or other place a card or flag,
upon which is printed the name of the disease in plain and legible
letters at least 2�- inches in length.
Section 7. Whenever the Health Officor shall have caused
a card or flag indicating the o- .istence of any infectious or con—
tagions disease to be placed upon-or attached to a house or dwelling,
it shall be unlawful for any person or persons to obstruct the view

of or destroy, deface or remove said card or flag from any such
building, or to cause or permit the same to be done until such time
as the Health Officer may direct.
Section S. No person or persons shall remove, cause to
be removed, assist in removing, or'direct the removal of any person
sick with infectious or contagious disease, such as mentioned in
Section 6 hereof, from any house or piw e within the City of Lynwood
to another house or place without a permit in writing from the
Health Officer first procured for that purpose, and no person shall
drive or use any vehicle or pormit any vehicle belonging to him or
her, or under his or her charge or control, to be driven or used for
the conveyance or removal of any person sick.with any infectious or
contagious disease such as mentioned in said Section 4„ without first
obtaining a permit in writing from the Health Officer of said City.
Section 9, Any person attending upon any or otherwise
coming in contact with any infectious or contagious disease in such
a manner or to such an extent as to render him or her 'Liable to com-
municate such disease to another person, shall not go into any public
place or assembly or mingle with any other person not affected with
20 Isuch infectious or contagious disease wearing any infected clothing
21 or carrying any material that may convey infection.
22 Section 10. That such Health Officer shall have, subject
23 to the control of the Board of Trustees, general charge. supervision
24 or control of all sanitary matters and things within the corporate
25 limits. He shall have power and authority to do and perform all acts
26 u sually done by quarantine officers, to establish a pest house, or
27 h ospital for persons suffering from contagious or infectious disease,
28 and make such rules and regulations as may be necessary for the grope.
29 n anagement of his official busi4ess and the regulation and conduct of
30 a ny hospital established under the provisions of this Ordinance; to
31 devise. adopt and carry out measures necessary to collect and pre -
32 Serve information in regard to the existence, character, origin and

Propagation of contagious or infections diseases within the City
limits; to procure full and reliable statistics of mortality; to
cause all the public streets, alleys and places and all houses, lots
and premises, whether public or private, and. for whatever purpose
used or occupied, to be thoroughly cleansed and freed of and from
all filth, garbage and other things calculated to produce disease
or endanger the health and lives of citizens, and to cause the same
to be thoroughly disinfected and fumigated so as to prevent the
introduction, outbreak or spread of diseases; to inspect at int
of not more than four weeks, every part and quarter of the City
of Lynwood, and cause the removal or destruction of everything cal-
culated or likely to produce any malarial or contagious diseases
whatever, to take promptly all such measures as he or such Board
of Trustees may deem necessary for the prevention at any time, with-
in the City, of any kind of disease and the spreading of any con-
tagions or epidemic, and. to keep a record of all births, deaths and
interments that shall occur within the City, in a book or books duly -
prepared for such purpose, and to be furnished by the Board of Trust-
ees,
He shall do and perform all acts and duties required of
him as Health Officer the City of Lynwood by any law of the State
of California, or by the rules and regulations of the State. Board of
Health, or by any law or regulation of the United,States, and keep
all such records and transmit all such reports to the proper offic-
ials that may be required by any such laws, rules or reFulations.
Section 11. It shall be unlawful for any person who
shall have been exposed to or who shall have become infected with
bubonic plague, Asiatic cholera, smallpox, measles, typhus fever,
yellow fever, diphtheria, scarlet fever, typhoid fever, glanders,
leprosy or any other infectious or contagious disease, and, who shall
have been placed in quarantine, in any house, building or place, on
account thereof, by the Health Officer, or for any person who shall

be in any house, building or place that shall have been placed in
quarantine, or upon which a card shall have been posted indicating
the existence in such houso,.building or place of any such disease
mentioned in this section, to leave, absent himself or remove there-
from without a permit in writing signed by the Health Officer until
after such house, building or place shall have been released from
quarantine, and shall have been disinfected to the satisfaction of
the Health Officer, and such card shall have boon removed by or
under the c;irection of the said Health Officer.
It shall be unlawful for any person to enter any such
house, building or place while the same is quarantined or while a
card is posted thereon indicating the existence therein of any such
disease without a permit in writing from the Health Officer so to
do.
It shall be unlawful for any person, firru or,corporation
ovmi controlling, occupying or having charge of any house, build-
ing or premises in which shall have been any person affected with
any of the diseases mentioned in Section 1 6 hereof. to fail, refuse
or meglect to renovate, clean, purify, and disinfect such house,
building or premises in such manner and at such time as the Health
Officer may direct.
No person who shall have been suffering from or affected
with any infectious or contagious disease or who shall reside with
the family or in the same house in which a person so affected shall
be located, shall be permitted to attend any public or private school
or public gathering of any kind within the limits of the City of
Lynwood. AnW(every principal, teacher or other person in charge of
any such school shall exclude every such person from such school
til such person so excluded shall present a certificate from the
th Officer stating that there is no longer any danger from in-
fection or contagion.

I Section 12. It - i ' s hereby made unlawful for any person
z in said City of Lynwood to spit or expectorate on the floor, walls
3 or stairs of any public building, place of worship, place of amuse-
4 ment, street car, public vehicle, or upon any public sidewalk or
5 floor or platform of any electric car within said City Lynwood.
6 Section 13. It shall be unlawful for any person, firm
7 or corporation to sell or offer for sale, or deliver to any person
8 or persons within said City of Lynwood, for compensation, ally milk
9 or cream containing any formaldehyde, preservaline, or other foreign
10 substances, put into such milk or cream for the purpose of preserv-
11 ing the same or increasing the quantity thereof, or any milk below
12 the standard required by the ordinances of said city or the laws of
13 the State of California.
14 Section 14. It shall be unlawful for any person, firm
15 or corporation to distribute, or to cause or permit to 'be distrib-
16 uted to or among pedestrians, or to throw, leave, or place, or to
17 cause or permit to be thrown, left or placed, in or upon any car,
18 vehicle, or other conveyance, or in, along and upon any public street
19 or other public place, or in or upon any private building or prem-
20 ises, or to deliver to, or leave with, or to cause or permit to be
21 delivered to or left with any child under the age of fifteen years,
22 except by a regularly licensed physician or surgeon, or a regularly
23 licensed pharmacist or pharmacist's assistant, or the parents or
24 guardian of any such child, any drug, physic or medicine, or any
25 sample thereof.
26 Section 15. It shall be unlawful for any person to sell
27 or peddle from house to house, or in or upon any public street or
28 other public place, any medicine or drug unless such person shall
29 have first registered his name and address in the office of the
30 Health Officer of said City and shall have furnished the said Health
31 Officer with a sample and a formula of such medicine or drug, and
32 shall have received a permit in writing from the said Health Officer

1 to sell or peddle the same; provided, however, that the provisions
2 of this section shall not apply to traveling salesmen dealing
3 directly with physicians, surgeons, dentists. or druggists doing
4 business in the City of Lynwood.• Each such permit and each such,
5 registration shall expire one year from and after the date thereof.
6 unless sooner revoked by the said Health Officer.
7 Section 16. Whenever in the opinion of the Health Officer,
8 a nuisance shall be ascertained to exist on any premises or in any
9 house or other place in said city, said Health Officer of said city
10 shall notify or cause to be notified in writing such person or per-
11 sons having control of or acting as agent for such house or premises
12 or other place, to abate and remove such nuisance within a reason -
13 able time to be stated in said notice. Upon the neglect 61the re-
14 fusal of such owner or the agent of such owner, or other person'
15 having control of said premises, to comply with such notice, the
16 Health Officer may proceed to abate such nuisance and to put or have
17 the said premises placed in good sanitary condition, and the expense
18 of so doing shall be chargeable against the owner or person having
19 control of or acting as agent for such house or premises, and the
20 amount of such expense shall be deemed a debt due to said City of.
21 Lynwood, and such person or persons shall be liable to an action in '
22 the name of the City of Lynwood in any court of competent juris-
23 diction for such amount, with costs of suit, and in addition thereto
24 a penalty of Twenty -five Dollars (w25.00) must be added to the judg�-
25 went as costs, to be collected from the defendant or aefendants.
26 Section 17. The Health Officer of said: City may enter
27 u pon the premises or into the house or other place of any person
28 , 7ithin said City to ascertain and inspect any nuisance; to inspect
2 drains, vaults, cesspools, cellars, water closets, privy or sewers

in the yards of such promises; to examine into their condition, and
when satisfied that apartments used for lodging or other purposes
are liable from overcrowding or filth to become dangerous to public

1 health or to disseminate contagious or infectious diseases, or are
2 not properly provided with privies, water closets, drains or cess-
3 pools, properly trapped, dnd in accordance with the ordinances of
4 said City of Lynwood, such Health Officer of said city may proceed
5 to cause said nuisance to be abated in the manner provided'in
6 Section 16 of this ordinance and at the expense of the owner or
7 person or persons having control of or acting as agent for such
8 house or premises and. recoverable as in said Section 16 provided.
9 Section 18. Ido manure, old paper, straw, hay, sawdust,
10 excelsior or other material used in packing or otherwise used, shall
11 be thrown into any public street or alley, or upon any vacant lot,
12 but the sarue shall be burned, hauled away, or otherwise destroyed.
13 Section 19. It shall be unlawful for any person, firm
14
or corporation o`rning, leasing, acting as agent

Section 20.
It shall be unlawul for
any person, firm
21 r corpordtion to fail, refuse or neglect to troop tho sidevialk in
22 ront of his or its house. place of business or premises in a
23 lean and wholesome condition.
24 1 Section 21. It shall be unlawful for any person, firm
25 r corporation owning or having charge, custody, control or posses -
26 ion of any vicious dog or other vicious or dangerous an.nal to per-

27 it or all -ow the same to go free or unrestrained in, along or upon
28 ny public street or other public place.
29 Section 22. All refuse, vegetable or anumal matter must
30 e either burned or buried or removed from the city limits of said
31 ity of Lynwood.

Section 23. No grocer or produce merchant shall expose
for sale or permit or allow to remain upon his premises, any de-
cayed:or decaying vegetables.
Section 24. It shall be unlawful for any person, firm
or corporation to keep, maintain, operate or carry on, a slaughter-
house or the business of slaughtering animals, within said City of
Lynwood.
Section 25. No butcher,•or grocer, o.r merchant shall
keep.or offer for sale any putrid or decayed meats or vegetables
within said City of Lynwood, nor shall any butcher or grocer fry
out or render fats about the shops or on any'vacant lots within
the corporate limits of said city without permission in writing
so to do being first obtained from the Health Officer of said City.
Section 26. The Board of'Health or Health Officer of
said laity, or the City Marshal thereof, or his deputies, or any
police officer of said city, shall have power to inspect all food-
stuffs of whatever kind or description "offered for sale in said
City of Lynwood, and if found, on account of its condition, to be
unwholesome or unfit for use as food, to condemn the same and
thereafter the same shall not be sold or offered for sale within
the said Citv of Lynwood.
Section 27. It shall be unlawful for any person, firm
or corporation to permit or sniffer any, cellar, drain, pool, cess-
pool, sink, sewer or other place upon his or its premises, or prem-
ises occupied by him or it under his or its control, in said City
of Lynwood; to become or to remain wet, foul or offensive, or to
, overflow upon the 'lots or lands upon which such cellar, drain, cess-
(pool, sink, sewer or other place may be, or on to any adjacent lots
or streets, or lanes, or alleys.
Section 28. No butcher's offal or garbage nor any dead
animal, nor any putrid nor offensive animal nor vogetable matter
(shall be allowed to remain on the preulises of any person or be de-

posited on any street, lane or alley, or vacant lot, or into any
.
standing water or excavation.
Section 29. Any person carrying on the business of a
dealer in second -hand goods, or who buys, sells or offers for sale
for use by another,, in any established place in said City of Lynwood,
any secondhand goods sli.ch as, beds, bedding, bedsteads, mattresses,
carpets, linoleum, or any household goods or furniture of any kind,
or tents or detachable houses, shall., upon request of the Health
Officer or the City Piarshal of said city, or his deputies, or any
police officer of said city to inspect the same and t}e place or
places where the same are kept, at any reasonable hour of-the day,
permit such inspection, and if after such inspection it appears A o
said Health Officer, City Marshal, his deputies, or any police
officer of said city, so making said inspection that any of said
articles, or any articles kept for sale,at such place is unsanitary
or dangerous to the public health, the owner of such property or
person in charge thereof, or the keeper of such place, shall,.upon
and under the direction of the Health Officer, City Marshal, his
deputies or police officer so inspecting the said premises, thorough-
ly disinfect or fumigate such articles or place within twenty -four
hours after receiving such notice, and the same shall be so fum-
igated or disinf.ecteo in the manner and to the extent directed and
required by such .person making such inspection as aforesaid.
Section 3�. No person shall remove or cause to be re-
moved or take away from any premises within said City for burial,
or for transportation from the said city, or for any other Ijurpose,
any corpse of any person having died therein, without first having
( obtained from the City Clerk of said city a permit so to do, for
which said permit said City Clerk shall be entitled to collect a
fee of one dollar for the use and benefit of said City of Lynwood.
Section 31. The Health 'Officer of the City of Lynwood

notices which he! shall deem necessary or expedient to secure or pro-
mote the enforcement or observance of any law of the State of Calif-
ornia or of any ordinance of the City of Lynwood •rolating to the
quarantine regulations, or to the preservation of the public health,
or to the sanitary regulations of the said State or of the said City,
and he is'hereby authorized and empowered to .post or set up any ex-
traction or copy of any such law or ordinance whenever he shall
deem the same to be necessary or expedient.
It shall be unlawful for any person to destroy or de-
face, mutilate or tear down, or to cause to be destroyed, defaced,
mutilated or torn down, any such notice or its sur'f'ace or the words
or letters used on any such extraction, or copy of any such law or
ordinance.
it shall be unlawful for any person, firm or corporation
to fail, refuse or neflect to comply promptly with any order, notice
1.6 or direction of the said Health officer.
17 The Health officer shall cause every such order or no-
18 tice to be affixed conspicuously to the building or part thereof,.
19 and to be personally served on the owner, lessee, agent, occupant,

20 or any person having charge or control thereof. If the owner,
21 lessee or agent cannot be found in the City of Lynwood or does not
22 reside therein or evades or resists service, then such order or
23 notice may be served by depositing a copy thereof in the postoffice-
24 in the City of Lynwood. postage prepaid, properly enclosed and
25 addressed to such owner, lessee or agent at his last known place of
26 business or residence.
27 Any notice or order required or provider to be given
28 r served by this ordinance shall'be given and served in the manner
29 this section specified.
30 Section 32. That any person, firm or corporation violat-
31 ng any of the provisions of this ordinance shall be deemed guilty
32 P f a misdemeanor, and upon conviction thereof shall be punished by

a fine of not more than $100.00 or by imprisonment in the County
Jail of the County of Los Angeles not exceeding fifty (50) days or
shall zuffer. both such fine and imprisonment.
Each such person, firm or corporation shall be deemed
guilty of a separate offense for every day during any portion of
which any violation of any provision of this ordinance is commit-
tad, continued or permitted by such 'person, firm or corporation,
and shall be punishable therefor as provided by this ordinance.
Section 33. This ordinance is urgently required for
the i7aiodiate preservation of the public health, peace and safety.
The following is a specific statement showing the urgency of this
ordinance :That said City of Lynwood has no ordinance making regula-
tions for the protection of the public health of said City in
several particulars herein provided for, and such an ordinance is
now irnodiately required.
Soction 34. The City Clerk shall cortify to the passage
of this Ordinance by a vote of four - fifths of all the members of
the Board of Trustees of said City of Lynwood, and its approval by
the President of said Board, and there being no newspaper of general
circulation published and circulated in said City, he shall cause
the same to be printed and posted in three public places in said
City of Lynwood, to -wit:
One copy upon the bulletin board at the entrance to the
office of the Board of Trustees of said City at 205 West Riulford
Avenue.
One copy upon the bulletin board at the Pacific Electric
Railway Station known as Lynwood Station at the intersection of
Long Beach Boulevard and Fernwood Avenue in said City, and
One copy upon the bulletin board at the northwest corner
of PRulford Avenue and Long Beach Bo in said City, and there -
upon and thereafter this Ordinance shall be in full force and
leffect.
