AN ORDINANCE PROVIDING FOR AND DECLARING THE REMOVAL FROM ANY
LOT, PARCEL. TRACT OR PIECE OF LAND: IMPROVED OR UNIMPROVED
OF GRASS,,WEEDS DEAD TREES RUBBISH OR OTHER REFUSE OR WASTE MATER
IAL WHICH IS OR MAY BECOME A MENACE TO LIFE OR HEALTH AND
PROVIDING FOR THE ASSESSMENT AND COLLECTION OF LOT CLEARING TAXES,
The Board of Trustees of the City of Lynwood do ordain
as follows:
SECTION one; It shall be the duty of the owner and the
agent of the owner A* and the person in possession of any lot,
parcel, tract or piece of land improved or un improved, in the Iti
city of Lynwood to at once remove from such lot, tract or piece
of land and to keep the same free from all grass, weeds, dead tto
trees, rubbish, refuse and waste material of all kinds which may
endanger or injure neighboring property, or the health or
welfare of the residents of the vicinity of such property or
which is or may become a menace to life or health or to the safei
y of property or which is liable to start or spread fire thereon
SECTION two: If such owner , agent or person in possession
of such property, fails to remove such vegetation or other waste
material as set forth in Section One, of this Ordinance from
such lot, parcel ,tract or piece of land, by May t5,of each
calendar year, it shall be the duty of the Health and Safety
Commissioner to cause the removal of such vegetation or other
waste materialtherefrom and to assess upon each such lot,pareel,
tract or piece of land severally the actual cost of removal,
together with the cost of administration, including the procur
ing of maps, letting of contracts, supervision, necessary inspect
ion,clerical work and other costs and expenses.
SECTION three: The said amount so assessed shall consti
tute a lien upon the property upon which it is assessed from
12 O'clock noon of the day on which the entry thereof is made
upon said assessment roll by said Health and Safety Commissioner,
the said amount so assessed shall be known as a Lot Clearing Tax.
SECTION four: The Health and Safety Commissioner shall keep
an account of the cost of abating said nuisance, against each lot
or parcel of land or sidewalk in front thereof and present a elaffi
claim therefor against the City of Lynwood, which claim shall be
payable out of the General fund of the Municipality.
A complete list of all Lot or Sidewalk Clearing Taxes shall
be published by posting in three public places in the City of
Lynwood a notice specifying each particular lot or parcel against
which a Lot or Sidewalk Clearing Tax is levied and a statement to
the effect that each tax is due and payable, and that u nless
each item is paid in full on or before a certain day, not less
than 15,nor more than 40 days after the publication of said
notice the particular item will become delinquent and ten percent
will be added to the amount filed as a lien against the particul
ar lot,parcel, piece or or tract of land.
SECTION 5: If said lot or sidewalk clearing tax is not paid
at the time
of levying the annual tax, the Tax Collector shall note upon the
tax bills the statement of the amount of such claim and the same
shall be collected in the same manner as all other property taxes
are collected, providing, however, that the City may by proper
action foreclose said lien by a proper suit or otherwise, and -
provided futher, that the expense of abating such nuisance
shall constitute a debt of the owner of said property to the
City of Lynwood.
SECTION 6: Whereas the City of Lynwood has no Ordinance
Providing for the removal of grass, weeds, dead trees, rubbish
or other waste or inflamable material which is or may become a
menace to the public peace, health or safety, and whereas there
is now within the limits of the City of Lynwood much grass,weeds,
dead trees, rubbish and other waste or inflamable material
which is, unless promptly removed, a menace to the peace, health
and safety of the inhabitants of said City.
Now therefore, this Ordinance is urgently required for the
immediate preservation of the public peace, health and safrty of
the inhabitants of the City of Lynwood and the City Clerk shall
certify to its passage by a vote of four fifths of all the membe
rs of the Board of Trustees of said City of Lynwood, and its ap
proval by the President of said Board and he shall cause the
same to be printed and posted in three public places in said
City of Lynwood, to wit: One copy on each of the three pupublic
Bulletin Boards of the City of Lynwood and thereupon and thereaft
er this Ordinance shall be in full force and effect.
