HomeMy Public PortalAboutOrd. 00197 ORDINANCE NO( 6 9 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF LYNWOOD, CALIFORNIA, 6REATING FIRE LIMITS FOR SAID CITY, The Board of Trustees of the City of Lynwood do ordain as follows: Section 1. The General fire limits of the City of Lynwood shall enclude all that portion of said City of Lynwood bounded and described as follows to witt:- Long Beach Blvd.,. from Fernwood Ave., on the south to Beachwood Pye., on the north and extending back to alley on both sides of said Long Beach Blvd., Trash burners must be installed and passed on by Building Inspector. Section 2. All buildings hereafter erected within the limits of .general fire limits of the City of Lynwood shall be B Class Buildings and for the purpose of this ordinance a "B" Class" building'shall be understood to be a building with all its exterior wall built of brick, stone or concrete, and having a metal, slate, tile, brick of composition roof and side walls extending above the rood', y Section 3. No Wooden building now within the limits prescribed in this ordinance, which may be damaged or destroyed by fire to the extent of fifty per centum of, the value, thereof, shall be repaired or rebuilt, nor shall any such building when the damage to or destruction thereof, as aforesaid, is less than fifty per centum of its value, be so repaired or rebuilt as to enhance the value of such building over what the same was prier to such damage or destruction, or so that such building shall occupy any greater space or be of any larger dimensions than before such damage thereto or partial, destruction thereof. Any person who shall violate the provisions ofthis section shall, on conviction thereof, be punishable by a fine of not less than Forty Dollars, or more than Forty -five Dollars, or by imprisonment,in the city jail for not less than ten days nor }Wore than three months. Section 4. The amount or extent of damage that may be done - 2- to any building or structure shall, for the purposes of this ordinance, be determined by three disinterested persons, residents of said City and freeholders therein, one of which shall be selected by the owner of such building or structure, one by the president of Board of Trustees of said City, and the two then.chosen shall select the third. In the event that the owner of such building be convicted of constructing, erecting, placing, repairing or rebuilding any wooden building or structure within the purview and meaning and violation of the provisions of this ordinance, shall, within five days after such conviction cause such wooden building or for the erection, i construction, placing, repairing or rebuilding of which he shall have been convicted as aforesaid, to be removed, and and on his failure, neglect, or refusal so to do, for each day that said failure, neglect or refusal shall thereafter continue, it shall be a separate offense, and if convicted thereof such person shall be punished by a fine of not less than Fifteen Dollars nor more than One Hundred Dollars for each said offense;,, for each day during which such failure. neglect, or refusal shall continue. section 5. Any person who shall fail, or neglect or refuse to choose such disinterested person as hereinbefore provided for the space of two days after he has been notified so to do by the Board of Trustees of said City, by a n6tice in writing, either served upon him personally or left with the o� �a.%d aUir�G2 0'Z fNywOn, .µ„ �i pycLvaCOry age:4t, of said building or structure, or conspiciously posted upol said building or structure, as said Board may elect, then in that case the Board of Trustees of said City may themselves appoint a second disinterested person as herein - before provided, and the two then appointed by said Board shall appoint a third. In the event that any two of such disinter- ested persons fail to agree VpoA a third disinterested person to act with them, such third person shall be appointed also by said Board of Trustees. A. decision of - 3 - j' a majority ofthe persons so appointed shall be in writing, signed by the persons rendering said decision and filed with the City Clerk, and said decision shall be final and conclusive on the question of the value aforesaid. Section 6. When any person shall be convicted as aforesaid, and provided in the fifth section of this ordinance, it shall be the duty of the President of the Board of Trustees of said City to issue to the Marshal of said City a certificate signed by the President, as such and bearing the seal of said City, stating the fact and the time of said conviction, and designating the building in regard to which said conviction has been had and such certificate shall be sufficient warrant to'the Marshall of said City, and it is hereb,r made his duty to cause such b;Alding or structure, to be removed or demolished, and the cost and edpense thereof shall be recovered by an action, in the name of said.City faom the person or persons so convicted of erecting the same aH aforesaid, providing., however, that this Ordinance shall not apply to the building or construction of any barn, shed or chicken corral, providing the same is made of galvanized iron, and also providing that said building shall be placed not further than twenty -five feet from the rear of said lot. Section 7. "D" Class buildings may be built anywhere within the City Limits of the City of Lynwood, except within the fire limits, as provided Section 1 of this Ordinance, and for the purpose of this Ordinance a "D" Cass building is every building or structure which do6e not, conform to the provisions of this Ordinance relating to the construction, and requirements of buildings of Class "B'.' as provided for in this.Ordinance, Section S. This Ordinance is urgently required for the im- Itediage preservation of the public peace, health and safety, I Section 9. The City Clerk shall certify to the passage of this Ordinance by a vote of four- fifths of all the member:eooftthe Board of Trustees of said City of Lynwood, and its approval by the President of said Board, and there being no newspaper ofXgeneral circulation published and circulated in said City., he shall cause the same to be printed and posted in three 4 - public places in said City of Lynwood, to -wit; One copy upon the bulletin board at the entrance to the office of the Board of Trustees of said City at 205 West Mulford Ave.,. One copy upon the bulletin board at the Pacific Electric Railway Station known as LynwoodStation at the intersection of Long Beach Boulevard and Fernwood Avenue in said City, and One copy upon the bulletin board at the northwest norner of Mulford Avenue and Long Beach Boulevard in said City, and thereupon and thereafter this Ordinance shall be in full force and effect.
